Cowboys player Josh Brent makes a statement about the fatal crash that killed Jerry Brown Jr.

Josh Brent muttered a few words on his way out of jail on Sunday afternoon.

His attorney George Milner paraphrased it, "he said my best friend died and I'm trying to deal with that."

Defensive lineman Brent, 24, is charged with intoxication manslaughter in the fatal crash that killed Jerry Brown Jr., a practice-squad linebacker, on Saturday. Milner said it's all Brent's been thinking about since being arrested early Saturday morning.

"He wasn't worried about the jail thing... He's having a very difficult time understanding what has happened, comprehending it," said Milner.

Brent's future is now uncertain. His attorney wouldn't comment on his future with the Cowboys, "That's a decision that has to be made within the Cowboys organization," Milner said. "I don't have anything to do with that. Then the NFL will have a say in this as well."

Milner adds that although he posted bond on Sunday, it was set too high, suggesting it had to do with his Cowboys status.

"They're doing that because he's a Dallas Cowboy, because it's a high-profile case and he's a Cowboy."

Jerry Brown, 25, was a passenger in the car Brent was driving when he crashed in the 1400 block of the State Highway 114 service road early Saturday morning.

Police release affidavit in case

According to an Irving police affidavit that was released Sunday, Brent refused a blood test but was forced to give a specimen in a mandatory blood draw because the crash was fatal.

The investigation into Saturday's crash is ongoing. Investigators are trying to determine where Brent and Brown spent the evening.

According to the affidavit, Brent admitted to drinking at a club before the crash but would not tell officers where.

Irving police are asking anyone who witnessed the crash to contact police.

Brent arrested for DUI in 2009

Brent was arrested in 2009 for driving under the influence, speeding and driving with a suspended license, according to court records in Illinois, where he went to college.

He served 30 days in jail for the misdemeanor DUI charge and finished probation in July 2011.

Brent had several off-the-field issues at Illinois and was briefly suspended before leaving school early for the draft.

Brent and Brown were teammates in Illinois and lived together in Irving.

"The family of Jerry Brown Jr. wish to express our sincere appreciation for all of your prayers, phone calls, flowers, visits and other acts of kindness shown during the death of our son," Brown's family said in a statement to the Fort Worth Star-Telegram. "We would also like to send our prayers out to Josh Brent and his family as well. With kindness and love, The Family of Jerry Brown Jr."

Jones talked about the tragedy before Sunday's game against Cincinnati during the Fox pre-game show, saying the grieving team is focused on Brown.

"Our team loved him," he said. "They certainly are conscious of him and want his family to know and have as much of them as they can give. At the same time, they know that one of the best things they can do for him and his memory is to come to the game today, is go out and play well."

Jones did not mention Brent.

"I am devastated and filled with grief, filled with grief for the loss of my close friend and teammate Jerry Brown," Brent said from jail in a statement through his agent late Saturday night. "I will live with this horrific and tragic loss every day for the rest of my life."
