Bill Proposes Raising Tanning Bed Age to 18

advertisement

You have to be 18 to vote, buy a pack of cigarettes or enlist in the military, and a Texas lawmaker wants to add "use in a tanning bed" to the list.

Rep. John Zerwas has proposed raising the legal age to go into a tanning bed to 18.

Currently, Texans who are younger than 18 but at least 16 and a half years old can tan with a parent's consent. Zerwas' bill would treat tanning like buying a pack a cigarettes -- you must be 18.

The Houston-area lawmaker says his bill would protect young people from future medical issues.

"The evidence is so clear and evident in terms of what the increased risk is for subsequent development of skin cancer, that the bill simply addresses that, under 18, you know, no," he said.

Zerwas said medical experts came to him the idea for the bill and are now backing the proposed legislation.

"M.D. Anderson came to me, and the dermatological society came to me, so there is really a strong consensus around this, at least around the medical community," he said.

The legislation would only affect commercial tanning beds at tanning salons. Zerwas said some tanning salons might fight against the bill.

But not all of them.

Gino Vankuilenburg of Metro Tan in Carrollton told NBC 5 that many of his teen customers now prefer spray-tanning because it's cheaper and faster.

Leslie Lopez, co-owner of The Tan Bar in Dallas said she is seeing an increase in younger customers asking for spray tans.

"I think more kids are becoming more aware of the risks and the results of booths," said Lopez, whose business doesn't offer electric tanning. "Our business has grown since we started."

Lopez said she doesn't offer electric tanning beds to her customers, citing the danger of ultraviolet rays to the skin.

"I think it's long overdue, actually," she said. "We all know what happens to the skin when it goes into a tanning bed -- you could develop melanoma, and people could have prior histories. I just don't think younger [people] should be allowed to do it."

Three Dallas children reunited with their Marine father in a surprise homecoming after nearly a year apart.

Lt. Col. Patrick Johnson has served three deployments in Afghanistan.

"You focus on the mission; you focus on the requirements," he said.

But as a father, there's a weak spot for his children underneath that exterior.

"I'm not allowed to get broken down," he said. "I think about them frequently. I thought of this moment for a long time."

Hundreds of students at the Dallas Academy gathered a patriotic assembly Friday. Johnson's family, including 12-year-old Bryghte, 10-year-old Asher and 5-year-old daughter Madray sat in the front row.

There were bear hugs from his children and tears from their mother when he came out.

Bryghte, whose birthday is on Sunday, said his father's surprise homecoming is a tremendous birthday gift.

"It was probably the biggest surprise of my life," he said.

Johnson will be home for a while; there is no word whether or not he'll be deployed overseas again.

"The circle has been closed," he said. "It's great to be together again."

Bull Fighter Steals Show With Vault From Bull

advertisement

The Fort Worth Stock Show & Rodeo is already pretty entertaining, but at Thursday night's rodeo, one performer out did himself.

It's the video that's the talk of the Stock Show and Rodeo on Friday, the video of bull fighter Dusty Tuckness surviving a close encounter with a bull in an usual and spectacular way.

"Just felt like I timed it good and the bull just got underneath me," Tuckness said on Friday. "He threw me pretty good ways in the air, but praise to God we landed it on the rail and got out of their in good shape."

Two different camera angles show Tuckness running in to get in-between a rider and the bull. As he ran Tuckness took what's called a "shot in the shorts" in rodeo lingo, as the bull's horns and head got him in the buttocks and sent him flying anywhere from 6 to 20 feet, by some estimates.

Tuckness hit the top rail with one foot, landing on the back rail of the chute with both feet. He then hoped up, gave a fist pound to another rodeo worker, waved his hand and went right back to work.

Tuckness was humble about his highlight reel efforts Friday afternoon, just as he was about to enter the rodeo ring, yet again.

"That's what we're out there to do is to just distract the bull and take the hookings or the shots needed to keep these guys safe," Tuckness said.

Tuckness, 26, and from Wyoming, has been a bull fighter for seven years. And if you think his efforts are unusual, he would tell you otherwise.

"Sometimes we get thrown in the air and we do land them or make it out in good shape," Tuckness said. "So, when it works out like that it's really good. But when it works out the other way it's not so good for me, but you guys still get enjoyment from it."

Veteran rodeo watchers marveled at the effort on Friday, including the Stock Show's Manager Brad Barnes.

"You will not believe it, I don't think it's ever happened anywhere that anybody's ever known of," Barnes said. "He was almost even with the press box, which was very scary at that moment in time. I was really nervous. But then he landed on the top rail of the buck chute, just like it was planned. He landed just like he was a gymnast."

Barnes joked with Tuckness about performing the move every show, but it is something the Stock Show and Rodeo is glad to show off.

"Good for ticket sales," Barnes said.

But on Friday Tuckness said he kept to himself in his trailer.

"I just kept kind of a low profile," he said.

Thanking God for his solid landing right before he was back chasing bulls and protecting riders.

"We're good and ready to go," Tuckness said.

Tuckness said he's just ready for the last week of shows and will keep doing his job of protecting riders.

The number of new flu cases continues to go down in North Texas.

The Dallas County health department has reported a second straight week of decline in the overall number of new cases.

Positive test results dropped by 2 percent from a week earlier to 27 percent for the week that ended Jan. 26. The number of children staying home from school with the flu also dropped in Dallas County.

Tarrant County reported a bigger drop in new cases.

The percentage of positive test results there was down 5 percent to 26 percent for the week. And, like in Dallas County, fewer Tarrant County children are staying home from school sick.

Downtown Dallas Driver̢۪s License Office Disappears

advertisement

The only driver's license office in Downtown Dallas has closed, potentially adding to long lines at other license offices. This comes after DPS told NBC 5 Investigates there were no plans to close any DFW offices.

There is more frustration for North Texans trying to renew their driver's licenses.  The busy Department of Public Safety license office inside Dallas City Hall has shut down. Only an empty counter and some old computer wires remain after the DPS quietly moved out in mid-December.

Just last summer the top DPS official in charge of the Texas license offices told NBC 5 Investigates there were no plans to close any locations in the DFW area, as the DPS tries to reduce long lines and wait times that can last three hours or more especially during the busy summer months.

"We're not closing any offices.  We are opening brand new.  We are expanding our capacity to be able to serve that demand," said Rebecca Davio, director of the DPS License Division in an interview in July, 2012.

Davio was describing a multi-million-dollar DPS plan to open two new Dallas-Ft. Worth license Megacenters, one in Garland and one in Fort Worth.  The agency said the two giant facilities would only add to the current locations in an effort to cut wait times at all of the exiting offices.

So what changed?  Why would DPS close a busy license office when it's already struggling to keep up with demand?

DPS tells us it had no plans to leave Dallas City Hall.  Instead, the City of Dallas kicked them out.

"The decision was not a mutual one.  The city expressly asked DPS to leave the premises in October.  DPS had no plans to vacate the facility," said DPS spokesperson Tom Vinger.

City of Dallas spokesman Frank Librio responded saying, "We really never had adequate space for them to conduct their operations."  He described the office as "inadequate and overcrowded."

Because of new security measures in the works at City Hall, Librio said the city wanted to clear out the space. He points out DPS is free to lease another office anywhere in downtown Dallas.

So far DPS has not done that.

But in an interview Thursday, DPS Director Steve McCraw said the agency will pull together money to open a new downtown Dallas location.

"Because of some of the savings we achieved in some other areas, we are going to prioritize a Dallas office in the downtown area and a Houston office in the downtown area because we've demonstrated the numbers need it", McCraw said.

DPS had plans to ask the legislature for millions of dollars to create new downtown offices in Dallas and Houston.  However, McCraw said the agency has decided to move ahead using existing funds instead.

Until DPS can find a new location, Downtown Dallas does not have a single driver's license office.

The office at City Hall used to serve an average of 180 customers a day, or about 45,000 customers last year alone, according to DPS records.

When NBC 5 Investigates visited that office over the summer we found it was so crowded people were sitting on the floor, some waiting for hours.

Since the City Hall location closed, a steady stream of customers continues to stop by during the day, surprised to find it's gone.

To get to the next closest DPS office they have to get on Interstate 35 and drive 10 miles south to Red Bird Lane, a trip that takes about 14 minutes each way if there's no traffic.

"It is an inconvenience, you know.  It's a waste of time and waste of bus fare," said Tobi Hicks who travelled to the City Hall office only to find it closed.

"You have to come down here waste gas and then go somewhere else I guess," said customer Emmanuel Dotson.

DPS hopes many customers will go to the new Garland Mega Center – which opened in December and is designed to handle 900 transactions every day above and beyond what the existing offices can handle. Now some of that new capacity will be taken up by thousands of customers who used to go to City Hall.

DPS is banking on the Mega Centers to reduce the long lines at all of the license offices. But the DFW population is growing fast and now the agency has lost an office in Dallas.  The Investigative Team will be watching over the spring and summer to see how well the Mega Centers really help improve wait times.

The new Mega Center in Fort Worth on Brentwood Stair Road opened Feb. 1.

Fake Energy Workers Tell Residents to Pay "Delinquent" Bills

NBC 5

Workers in the field will always carry identification, and people can ask for it if they are unsure if the worker is legitimate, Oncor says.

Dallas police are warning residents about schemers posing as energy workers.

Investigators said people posing as energy workers are going door-to-door and ask residents to pay bills that they say are unpaid. The bogus workers tell residents that their power will be shut off if they don't pay.

But Oncor Electric Delivery says that workers who go to homes will never ask for payment on the spot.

Representatives in the field will always carry identification, and people can ask for it if they are unsure if the worker is legitimate, Oncor says.

Police and Oncor say the scheme can also happen over the phone. Dallas police say people should never give out personal information to anyone over the phone.

People should also verify the credentials of anyone who contacts them and claims they need to pay a delinquent bill, police say.

NBC 5's Amanda Guerra contributed to this report.

Pet Store Accused of Selling Puppies With Parvo

advertisement

Mansfield Chief of Police Gary L. Fowler is opening an investigation into a local pet store after the NBC 5 Investigates Consumer Unit was alerted to claims by several families that they purchased puppies that were sick with parvovirus.

Three families who all said they bought their puppies at PetOrama in Mansfield told NBC 5 that their animals were diagnosed with parvovirus, a very contagious, aggressive virus that attacks a dog's intestinal track.

According to the families, two of the puppies had to be euthanized while one survived after an aggressive veterinary treatment that cost them more than $1,000.

While Fowler, who oversees animal control for the city, originally told NBC 5 he had no records of complaints against the store, he said he now plans to open an investigation.

In an unrelated move, PetOrama said it will stop adopting out puppies, but is holding one last adoption event this weekend to sell the remaining dogs at the store.

Families Claim Store Sold Them Sick Puppies

"Truly, I never thought that when you go into a pet store like that you would purchase a sick dog," said Penny Rivera, a Mansfield resident.

Rivera bought a shepherd-mix puppy named Leo as a Christmas present for 13-year-old Andrew Caraveo and his 21-year-old sister Jenny who had lost their beloved dog only a few months before.

"I picked Leo because he just looked really cute," said Jenny, who said she knew her brother would be delighted by the holiday surprise.

And he was.  Andrew immediately fell in love with the dog and made little Leo a doghouse out of a cardboard box.  He doted on him like any 13-year-old with a new puppy would.

But a few days later, Leo was vomiting, had diarrhea and was lethargic.

"He looked very sick," Andrew said.

A trip to the vet revealed Leo had a severe case of parvo.  Andrew and Jenny then made the gut-wrenching decision to put Leo to sleep.

"I knew how he looked and how tired he was, he wasn't going to make it," Andrew said.

"We just said, 'Goodbye.' I mean, it was just really hard.  There was nothing we could really say to him," said Jenny, as tears streamed down her face.

Joanna McCoy and Phillip Kriesman know that pain. The couple bought a long-haired dachshund named Hudson at the same Mansfield PetOrama and it was love at first sight.

"As soon as I picked him up I knew he was my dog," said McCoy. "I loved him. I was so happy."

They paraded Hudson to McCoy's mother's house and showed him off to other relatives. But that evening they rushed Hudson, who was throwing up, to an emergency veterinary hospital.  The veterinarian told the couple that little Hudson had parvo.

They too made the decision to put Hudson to sleep.

"I just couldn't feel myself afterwards. It was just so weird and upsetting," Kreisman said.

PetOrama to Stop Puppy Adoptions Due to Complaints

NBC 5 called PetOrama and spoke to Rochelle Browning, the daughter of the owner who said she manages the store for her father.

She insisted she takes good care of the puppies and that her dogs are checked by a veterinarian.

"My veterinary bills are outrageous," Browning said.

Browning admitted that Hudson, who died shortly after leaving her store, had parvo when she sold him. PetOrama's owner did refund McCoy and Kreisman for Hudson and she paid their vet bill, but they said it's little consolation.

"It's a heartache that no one should have to go through," said McCoy, who thinks about Hudson every day.

As for the other dogs, she believed they may have gotten sick after they left her store. Browning said her staff sanitizes cages daily but does not dispute the fact that parvo has up to a two-week incubation period.

The families said Leo and Hudson were visibly sick within days of being purchased.

Browning then became emotional, telling NBC 5 she's under extreme stress because so many puppies have gotten sick with parvo and customers have been very upset.

"I've never seen this before in my life.  Emotionally, I'm spent," Browning said. "I can't listen to people cry over the phone anymore."

On the company's Facebook page she told customers that PetOrama has decided to "stop adopting out puppies." But there will be one last adoption event this weekend to sell the remaining dogs.

"It's hard when you love pets like we do and have taken all the measures possible trying to prevent illness, but then get treated badly by customers when they do get ill," she wrote.

Parvo is extremely contagious because a dog can shed the virus before it ever shows signs of the illness.

"It's really hard to kill the virus. It's resistant to common disinfectants," said Dr. Nancy Turner, the Dallas District Director of the Texas Veterinary Medical Association.  "It's resistant to heat. It's resistant to sunlight. So, really, it's a tough bug essentially."

Turner, who practices at Bent Tree Animal Hospital in Dallas, said that by the time one puppy shows the signs there is a good chance other dogs could be infected.

State Offers No Legal Remedy for Purchase of Sick Dogs

Unlike some other states, Texas does not have a Lemon Law for dogs.

"There's no regulation of pet stores of any shape, form or fashion at the state level," said Skip Trimble, a Texas Humane Legislation Network board member.

Trimble's organization advocates for state animal welfare legislation. While there are rules and regulations for larger breeders at the state level, as of now, individual cities and towns may or may not have ordinances that can help pet owners.

"You're just totally at risk and virtually there is no warranty on these dogs," Trimble said.

The City of Mansfield does have an ordinance that gives animal control the authority to inspect pet stores.  It also mandates that anyone with care and control of an animal "maintain the animal in good health."

Fowler said that if a pet store fails to maintain the health of their animals they can impose a fine.

Fowler originally insisted he had no record of any complaints against PetOrama.  But McCoy said she called animal control and spoke with an officer several weeks ago.

"He said that unfortunately it's not in their jurisdiction and there's nothing that they could do for me,"  McCoy said.

However, after speaking with NBC 5, Fowler said he is now opening an investigation.

Rivera said Browning did not give her a refund for Leo or help with the vet bills.

Craig Haemker said he also received no help from the store after a puppy he purchased, Sophie, was diagnosed with parvo and required a $1,000 aggressive medical treatment to be rid of the virus.

Today, Sophie is a happy, healthy dog, but Jenny and Andrew are still reeling from losing Leo.

"That dog just meant the world to us," said Jenny.

They want to make sure other families don't suffer like they have.  That, they said, is Leo's legacy.

"Nurturing. Healing. Love."

Scarlett Lewis noticed the chalk-written message on her kitchen chalkboard when returning home for the first time – days after her son Jesse was taken from her on December 14th.  "It was in 6-year-old handwriting. Right about where he'd be standing," says Lewis from her Sandy Hook farmhouse.  "It's phonetically spelled. It's very clear what it says. I was stunned."

Lewis described her son as an "energetic, happy boy" whose personality could dominate a room. This type of message, however, was out of the ordinary for him but feels it was left for when she and her oldest son, J.T.  would need it most.

"He isn't the type of boy who would write that. He was loving and sweet and kind but that was a prophetic statement. I felt like it came from his spirit."

It was this same message that the single mom sent while eulogizing her son.  "I said 'I have something for you to do for us. That's to consciously change an angry thought into a loving one' because it is a choice."

It's now the mission of the newly formed Jesse Lewis Choose Love Foundation. Scarlet hopes it grows from the chalkboard to the pulpit to – one day – your child's classroom. She is meeting with professional educators to create a school curriculum that will be taught nationwide.

"This will be taught right along Math, Reading and Writing. It will be a life management course."
Lewis was the first family member to speak at Wednesday's Legislative Gun Violence Prevention and Children's Safety hearing held in Newtown. She says she is not looking to get involved in the political debate that has followed the shootings. Rather,  she will focus on a message that can be supported on all sides of the discussion.

"I feel like he wrote that message for a reason and handed me a torch. I'm gonna take it and hopefully – with everyone's help – change the world so this will never happen again."

Search Dog Finds Potential Evidence in "Black Dahlia" Murder

advertisement

Steve Hodel cannot let go.

And so he returned to a distinctive Hollywood mansion with another ex-cop, Paul Dostie, and Dostie's search dog, Buster. Hodel had a mission for them.

In his book "Black Dahlia Avenger," the retired LAPD detective and best-selling author convinced many skeptics that he had solved the gruesome 1947 murder that perhaps became LA's most notorious cold case.

The body of Elizabeth Short, 22, had been severed in two with surgical skill and technique, leading investigators to conclude early on that the killer likely had medical school training.

That killer, Steve Hodel ultimately concluded, was his late father, George Hodel, MD.

What's more, because there was no trace of blood in the empty Leimert Park lot where the remains were found, detectives realized she must have been killed elsewhere.

That elsewhere, Hodel concluded, was the landmark Hollywood mansion where Dr. Hodel made his home, the distinctive "Sowden House" designed on a Mayan theme by famed second-generation architect Lloyd Wright.

Steve Hodel lived there as a child. As he looked into the case, he was able to determine from records that he and his siblings were away with their mother at the time of the Black Dahlia murder.

Hodel marshaled considerable evidence, which was later corroborated after "Black Dahlia Avenger" was published, when the District Attorney Steve Cooley agreed to reopen decades-old case files.

Right at the top was a picture of Dr. Hodel; it turns out he had been the principal suspect. Investigators had even planted a bug in the house to listen for incriminating admissions. But before authorities brought charges, Dr. Hodel abruptly abandoned his family and relocated to Asia.

The likes of Steve Kay, then a head Deputy DA, concluded that Steve Hodel had made the case against his father.

But that wasn't good enough for Steve Hodel, who has continued seeking more evidence in hopes of convincing his former employer, the LAPD, to declare the case officially solved.

So when the opportunity arose to return to the Sowden house with Dostie and Buster, Hodel took it.

The arrangements with the current ownership had been made by producers of a segment for the "Ghost Hunters" program on the SyFy Channel.

Hodel knew that the sounds of blows and a woman's screams had been heard coming from the basement, according to the transcript of what police heard through the bug. The basement had never been finished and when Hodel, Dostie and the SyFy crew went there last November, the floor was still dirt.

With his keen sense of smell, Buster alerted in four locations, indicating he had picked up the scent of human decomposition, faint traces of which can remain for decades, Dostie said.

But is it corroboration? Dostie cannot say for sure. The decomposition of human tissue that Buster detected did not necessarily originate in the basement.

With the house on a slope, it is possible traces may have migrated downslope from the hillside lot above. Labwork may be able to pin down the possibilities. Hodel is waiting for the results.

Dostie and Buster have moved on to other searches, Buster hardly losing a step despite the fact that the black lab was diagnosed with a rare form of cancer in a hind leg, which had to be amputated.

Remembering Ed Koch, Emblem of a City

Written By Unknown on Jumat, 01 Februari 2013 | 22.29

Ed Koch, the larger-than-life politician who rescued the city from near-financial ruin during a three-term City Hall run, died of congestive heart failure Friday, Feb. 1, at the age of 88.

Here, New Yorkers — from politicians to reporters to friends, family and voters — share their reflections on the former mayor's life and legacy:

Angele Kassar Ekert: "I saw Mayor Koch walking down 52nd Street in NYC one day in the late 80s....a couple of tourists yelled to him from across the street 'Mayor Koch, we love you!' He yelled 'Wait, what did you say?' To which they repeated those praises He 'pretended' not to hear them and asked them to say it two more times, each time they yelled louder, to which he responded 'Oh that's what I thought you said!'"

Rafael Armstrong: "I didn't live in the city while he was mayor, but I was at a business lunch on the East Side in the late '90s, and I remember looking over and seeing him at lunch a few tables over. There was an energy and a charisma to the man, even after being out of office all those years."

Alice Benjamin: "My favorite moment was when my son's Boy Scout Troup led the parade down Ninth Avenue, and the mayor was right in front of them. He made it a point to shake hands with all the Scouts and say hello! I'll miss him -- he was a character!!"

Avala Maneeram: "I had the pleasure of meeting Mr. Koch when I was a little girl. He came to my school and talked to us about being active participants in our community. I was only 7, but I remember him as being so warm and friendly and had a general enthusiasm for N.Y that was infectious. He will truly be missed."

Mayor Bloomberg: "In elected office and as a private citizen, he was our most tireless, fearless, and guileless civic crusader. Through his tough, determined leadership and responsible fiscal stewardship, Ed helped lift the city out of its darkest days and set it on course for an incredible comeback. We will miss him dearly, but his good works – and his wit and wisdom – will forever be a part of the city he loved so much."

The Rev. Al Sharpton: "Although we argued about everything from my marching in Bensonhurst, to Florida and Trayvon Martin, and although we disagreed on politics from his views on President Obama to other matters, I have found that he was never a phony or a hypocrite. He would not patronize or deceive you. He said what he meant. He meant what he said. He fought for what he believed."

Gov. Andrew Cuomo: "Mr. Mayor was never one to shy away from taking a stand that he believed was right, no matter what the polls said or what was politically correct ... I will miss his friendship, and we will all miss his perpetual optimism and tireless commitment to continually striving to improve our city, state, nation and world."

Sen. Charles Schumer: "New Yorkers were particularly proud of Mayor Koch because he was so proud of New York. Every atom in his body lived, breathed, spoke and exuded the city. He helped save the city and, perhaps most important of all, gave it confidence when it was beginning to doubt itself, which helped pave the way for the growth and prosperity we're still experiencing today. Every New Yorker will miss Ed Koch, and his towering presence."

Police Commissioner Ray Kelly: "In many ways Ed Koch never stopped being mayor. He was personally engaged in the issues of the day ... I was privileged to consider him a friend and I am grateful that I had a few more times to be with him, on Tuesday and again last night, before he finally left New York for someplace better - although he'd probably argue that's not possible."

Attorney General Eric Schneiderman: "As a lifelong New Yorker, it's hard to imagine this city without Ed Koch. We will miss his keen mind, sharp wit, and absolute devotion to making a great city the best in the world. While we mourn his loss, we know that the legacy of his mayoralty, his commitment to civil rights and affordable housing, and his civic leadership long after he left City Hall, will live on for generations."

Manhattan DA Cy Vance: "New York would not be the safest big city in America today if Ed Koch hadn't spearheaded one of the most important criminal justice reforms in New York City's history as mayor: selecting criminal court judges based on merit instead of political connections. Every New Yorker has the right to walk the streets of our city without fear and all New Yorkers deserve equal access to justice. We'd be far, far further from these goals today if not for Mayor Ed Koch's foresight and vision and courage."

Rep. Peter King: "Ed Koch was a true friend and trusted adviser. Ed Koch personified the spirit of New York. New York's 'Mayor for Life' is now New York's 'Mayor for Eternity.' May he rest in peace."

Gun Rights Advocates March in FW Stockyards

More than a dozen men and women walked through the historic Fort Worth Stockyards armed with shotguns and semi-automatic rifles. But it wasn't an Old West re-enactment -- the group was there to push for the right to openly carry a handgun in Texas.

"It's part of my Second Amendment right," said Derek Hall, of Fort Worth. "It's written in the Constitution."

He brought along a semi-automatic Smith and Wesson M&P 15 and a Mossberg shotgun.

"They shouldn't have the ability to take it away from us or limit what we can have," Hall said.

Andy Welch, of North Richland Hills, also brought his semi-automatic rifle. He said he is worried that the current administration in Washington is trying to take his gun rights away.

Hall and Welch, along with other men and women of varying ages, brought along their weapons for a peaceful walk through the Stockyards. The group did a safety check beforehand to make sure the weapons were not loaded before the march started.

The march took place at a time when a bill in Austin, House Bill 700, would allow concealed handgun license owners to openly carry their weapons in public instead of concealing them.

Hall said it is a bill he can support.

"If you can conceal carry, why wouldn't you be able to open carry?" he said. "If the law tells you you're legal to own one, and you've gone through the classes and you're not a felon and you don't have everything against you, why shouldn't it be legal?"

Friend of Slain Asst. DA Speaks Out

advertisement

Mark Hasse, the Kaufman County prosecutor gunned down Thursday, was a hard-working lawyer who "loved to tell stories" and often put dangerous criminals behind bars, a longtime friend says.

Kaufman defense attorney Eric Smenner said he first met Hasse when the two worked in Dallas in the 1990's.

He said Hasse as a pilot who loved to fly and that he had survived a plane crash in the mid-1990s.

"He had some pretty serious head injuries. It took him a while to get back. He had noticeable mark on his head, some scarring from the accident. He recovered from it," said Smenner.

Smenner added that while it was too soon to say what may have led to the shooting, Hasse had dealt with cases involving methamphetamine in the county, gangs and white supremacist groups.

"Any prosecutor will make enemies. When you stand up at trial and point your finger at them, sometimes they take that personally," Smenner said.

Smenner said Hasse was not married and rarely talked about his family, but "was a story teller.  He would talk to you for hours."

Former colleagues of Hasse's say the news of his death spread through the Frank Crowley Courts Building and is sending "shockwaves" through the legal community in Dallas.

Hasse worked for the Dallas County DA's office from 1982 to 1988, having earned his law degree from SMU in 1981 according to the State Bar of Texas' website.

Former Dallas County assistant district attorney Toby Shook said that Hasse was a felony prosecutor when he joined the DA's office.

"When I was a young prosecutor we use to watch because he was that talented," Shook said. "You'd learn a lot from him, he would talk about his cases, didn't mind sharing information and that kind of deal. Very friendly guy, talkative with everyone that kind of thing."

Shook says Hasse was one of the most talented prosecutors and targeted major drug dealers. Shook says he put "a lot of folks in prison" and was at one point the head of the DA's office Organized Crime Division.

Shook echoed Smenner's thoughts that prosecutors often deal with unpleasant individuals who may wish to do them harm.

"It's always in the back of your mind that something like that could happen because you're dealing with prosecuting very violent people who know violent people," Shook said. "And sometimes you hear of threats but it rarely, rarely happens."

Former Kaufman County District Attorney Rick Harrison, who is now a criminal defense attorney, said it was stressful and shocking news when he emerged from a murder trial at lunch.

"He was a, you know, very experienced prosecutor," Harrison said, "and enjoyed being a prosecutor, you know, enjoyed the job."

Shook says prosecuting was Hasse's life.

"Mark Hasse loved prosecuting more than anything," Shook said. "It was a job that he loved getting up in the morning and going to, he truly loved it you can tell that when talking to him. It was his life and he died doing it."

Cowboys' Ratliff Charged in Intoxicated-Driving Case

Dallas Cowboys defensive lineman Jay Ratliff has been charged with a Class A misdemeanor in connection with an intoxicated-driving arrest in Grapevine earlier this month.

Ratliff was arrested on suspicion of intoxicated driving after a collision with an 18-wheeler along state Highway 114 on Jan. 22.

Police were alerted to the crash by 911 calls shortly after the crash. The responding officers learned that Ratliff, who was driving a pickup truck, turned into the big rig before crashing into a barrier wall.

Grapevine police said lab results indicated that Ratliff had a blood-alcohol level of .16 at the time of his arrest.

After the crash, Ratliff failed a field sobriety test and then became verbally abusive as he refused to take a breath test. Officers obtained a warrant and forced him to submit to giving a blood sample.

Ratliff's arrest came less than a month after fellow defensive lineman Josh Brent was indicted on one count of intoxication manslaughter for his role in a one-car crash that killed teammate Jerry Brown Jr.

Ratliff will next appear in court Feb. 26.

If convicted, he faces up to a year in jail and a fine of up to $4,000.

UNT Students Perform Jingle on "Today Show"

advertisement

It was a busy week for two University of North Texas students who went from attending class to performing live on national television Tuesday morning.

UNT juniors Kayley Walker, a radio, television and film major, and Andrew Walker, a music major, make up the musical duo The Walkers. The musicians were one of three acts to perform live on NBC's "Today Show" as part of the show's "Quest for the Best" contest.

The two, who happen to share the same last name but aren't actually related, wrote a jingle for the show in Tuesday's "Quest for the Best" installment. The Walkers performed to see whose melody among the three contestants would be named the best.

The Walkers found out their submission had been selected as a finalist around mid-January.

"I called him like a hundred times," said Kayley Walker, who got the call while Walker was in class.

NBC flew the duo out to New York City on Monday for their Tuesday performance.

"We woke up at four in the morning and then we had to get there at the studio at six," said Kayley Walker. The two barely got any sleep in anticipation of their performance, Andrew Walker added.

As the two warmed up for their performance, they got a behind the scenes look at the show and got a glimpse of their favorite "Today Show" anchors.

The Walkers took the stage at about 8 a.m., performing second in the contest.

The duo's original jingle was not picked to win, but they say the experience and exposure was the real reward.

"Now they've seen us, like a lot of people watch the "Today Show,"' said Andrew Walker.

The Walkers first met back in middle school in Arlington. They became friends during their junior year of high school when they found out both would attend UNT.

"We found out we were both going to UNT and started writing music together freshman year," said Andrew Walker.

The two continue to play their acoustic sounds at coffee shops and other venues in Denton and Arlington.

The Walkers hope the "Today Show" buzz will help them reach new audiences.

"The Walkers aren't finished yet!" said Kayley Walker.

Prosecutor Shot, Killed Walking to Courthouse

Authorities are searching for the gunman who killed Kaufman County Assistant District Attorney Mark Hasse in a parking lot near the county courthouse.

More Photos and Videos

More information into the fatal shooting of Kaufman County Assistant District Attorney Mark Hasse may be released Friday.

The Kaufman Police Department plans to hold a press conference at 10 a.m. to update the public on the investigation. NBC 5 will carry that conference live online within this story.

Hasse was gunned down Thursday morning in what appears to be a targeted attack, police say. The prosecutor was shot multiple times while walking from the parking lot toward the county courthouse at about 8 a.m., officials said. He was transported to a nearby hospital, where he later died.

When asked if Hasse appeared to have been targeted by his attacker, Kaufman County Sheriff David Byrnes said: "I would say from all appearances it is, but we have no concrete information on that. We're pursuing every avenue right now."

Chris Aulbaugh, the Kaufman chief of police, said no official arrests have been made in connection with the shooting. Police are following up on several leads, including multiple witness reports from various angles around the crime scene, he said.

Multiple agencies are working with the Kaufman police, including the Bureau of Alcohol, Tobacco, Firearms and Explosives, FBI, the Texas Rangers and state troopers from the Texas Department of Public Safety.

Police said witnesses have reported two shooters wearing all black, one or both of them possibly wearing a tactical-type vest, and driving an older, silver Ford Taurus. Aulbaugh said they have not yet confirmed that there were two people involved in the shooting and if the shooter(s) were wearing a tactical jacket as described.

A reward of at least $34,000 from Kaufman County Crime Stoppers and other sources is being offered for information leading to the arrest and conviction of the gunman. Dallas County District Attorney Craig Watkins said he would match that reward as well.

Anyone with information is asked to call Kaufman County Crime Stoppers at 1-877-TIPS-KCC. As always, tipsters may remain anonymous.

Official Calls on Tarrant DA to Resign Over Sex Scandal

Written By Unknown on Kamis, 31 Januari 2013 | 22.29

Tarrant County Tax Assessor-Collector Ron Wright on Tuesday called on District Attorney Joe Shannon to resign over a sexual harassment scandal.

"As a fellow Republican elected official, I take no joy in this," Wright said in a statement. "In fact, it pains me to do it, but I believe it is the right thing to do."

On Friday, the county released documents in a sexual harassment complaint brought by former assistant district attorney Sabrina Sabin. She claimed Shannon touched her inappropriately, constantly commented on her breasts and harassed her in other ways over a period of about four years.

Tarrant County commissioners agreed to settle the complaint in September for $375,000. Shannon said he did not agree to the payment and denied the allegations.

The county also paid legal fees and hired a human resources company to investigate the complaint, bringing the total cost of the settlement to more than $500,000.

"To suggest that this leaves the district attorney and his office in a bad light would be a gross understatement," Wright said. "The optics (how this is seen by the average voter) are terrible:  the top law enforcement official in the county embroiled in a sexual harassment scandal that costs county taxpayers a half million dollars. Politically, the optics could scarcely get much worse."

In a statement, Shannon said he has no intention of resigning.

"The Tarrant County District Attorney's office is widely regarded as the best in the state," he said.

The statement did not directly address the sexual harassment accusations. Shannon has said he signed a confidentiality agreement that does not allow him to comment on specifics.

Wright said he cannot judge whether the allegations are true but added the settlement, "leaves the matter in a perpetual state of he said/she said."

"Joe Shannon should step down as Tarrant County District Attorney, and he should do so immediately," Wright said.

Officer Arrested for Armed Sexual Battery: Miami Police

Update in Teacher Sexual Battery Arrest Case

The teacher charged with sexually battering a young South Florida girl allegedly continued his inappropriate contact with her even after his arrest, the girl's mother told NBC 6 South Florida in an exclusive interview. The woman's attorney, Jeffrey Herman, also discusses the allegations.

More Photos and Videos

A Miami Police officer was arrested Wednesday on charges of armed sexual battery by a law enforcement officer and armed kidnapping, police said.

Luis Hernandez, 27, a seven-year member of the police department, was arrested by internal affairs detectives after DNA evidence backed up a woman's claims he kidnapped and sexually battered her in November 2011, police said.

"The findings were enough to have a Miami-Dade County judge sign an arrest warrant and charge Officer Luis Hernandez with sexual battery by a law enforcement officer, and armed kidnapping," Miami Police spokeswoman Officer Kenia Reyes said.

The charges stem from an early morning alleged attack by Hernandez on Nov. 26, 2011. That day, he was called in to relieve an officer going off-duty by transporting a 44-year-old woman to to the Miami-Dade County Jail. She had just been arrested after an earlier bar fight, police said.

Hernandez picked up the victim from a colleague at police headquarters just after one o'clock that morning. Soon after, she said, he drove her to a parking lot off the 2500 block of Northwest 2nd Avenue. She recalled that Hernandez told her, "I'm going to help you," police said.

Man "A Danger to the Women of the Community": Judge

The victim told police internal affairs investigators that Hernandez gave her some gauze and told her to clean up her face. With her shirt torn from the fight hours earlier, she recalled Hernandez poured a liquid onto a scratch on her breast. Then, she said, Hernandez lifted her shirt, and began fondling her.

Police documents note the victim told investigators that Hernandez, dressed in police uniform, removed his duty belt and exposed himself. According to the victim, the officer then told her to "get down," a demand, she believed, for oral sex.

The victim refused, and she claimed Hernandez began fondling her private parts. According to police, she said he then ordered her to turn around, and she begged him to stop.

Officer Arrested After Woman Accused Him of Having Sex With Her: Report

After the encounter, the victim said she was handed off to a detention officer, but because of her wounds, that officer asked Hernandez to come with him and the victim to jail. While being processed, the victim, who is a Spanish-speaking undocumented immigrant, felt comfortable sharing the story that would launch the investigation, police said.

Within months, DNA evidence linked Hernandez to the crime, they said.

Mayor Tomas Regalado told NBC 6 the investigation and arrest proves the city demands the best of its officers.

"To me, this is not a scandal, this is a clean up of the department," he said.

Hernandez is being held without bond, online Miami-Dade Corrections records said. It was not known if he has an attorney.

The Twisted Root Burger Co. is known for feeding hungry patrons, but the restaurant took it one step further on Wednesday -- by feeding hungry lions.

Owner and Chef Jason Boso said he received an interesting email in the morning from the In-Sync Exotics Wildlife Rescue Education Center in Wylie.

The center employees said they were desperate and had a very sick African Lion named Aramis, who would only eat elk meat.

The center called local hunters, but no one had the meat.

That's where Boso stepped in.

"I just so happened to get a shipment of 50 pounds of elk meat today and I was about to grind it into hamburgers, but no way! I'm going to take it to a lion!" Boso exclaimed.

Boso gathered up his staff and headed out to the center and sure enough, slowly but surely Aramis began to eat.

The staff was also able to slip medicine into the meat.

"I think it's awesome," said Boso. "I mean a lion and me, we have a lot in common. We eat buffalo and elk and venison, so I needed to help my brother out!"

Boso said the meat should last Aramis for two weeks. The center employees are hopeful he's healthy by then.

Kwame Harris: Chris Culliver Is Spreading Hate

advertisement

Former San Francisco 49er and openly gay football player Kwame Harris has responded to Chris Culliver's comments on gays in the NFL.

"It's surprising that in 2013 Chris Culliver would use his 15 minutes to spread vitriol and hate. I recognize that these are comments that he may come to regret and that he may come to see that gay people are not so different than straight people," Harris told NBC Bay Area.

Harris was outed as a gay man just this week. He was charged with assaulting a former boyfriend last summer outside a Menlo Park restaurant, and the charge became public after a recent court appearance.

Culliver's comments, in which the 49er suggested that gay players would not be welcome in the 49ers' locker room, came during an interview with shock jock radio host Artie Lange on Super Bowl Media Day Tuesday.

"I don't do the gay guys, man," Culliver told Lange. "No, we don't got no gay people on the team, they gotta get up out of here if they do. Can't be with that sweet stuff. Nah ... can't be ... in the locker room, man."

By 8:30 p.m. ET, Culliver released a statement apologizing for what he said.

"The derogatory comments I made yesterday were a reflection of thoughts in my head, but they are not how I feel. It has taken me seeing them in print to realize that they are hurtful and ugly. Those discriminating feelings are truly not in my heart. Further, I apologize to those who I have hurt and offended, and I pledge to learn and grow from this experience," Culliver's statement read.

The 49ers issued a statement as well, saying the team rejects Culliver's comments.

"The San Francisco 49ers reject the comments that were made yesterday, and have addressed the matter with Chris. There is no place for discrimination within our organization at any level. We have and always will proudly support the LGBT community," the statement read.

The chorus from Sandy Hook Elementary School will sing "America the Beautiful" before Sunday's Super Bowl between the San Francisco 49ers and the Baltimore Ravens, The Associated Press reported.

The chorus features 26 children from Sandy Hook Elementary in Newtown, Conn., where 20 first-graders and six adults were killed in a shooting rampage last month.

The performance will be part of CBS's pre-game show and will be broadcast live.

A few weeks ago, the chorus joined Grammy-nominated singer Ingrid Michaelson to record "Somewhere Over the Rainbow" for the one-month anniversary of the shooting.

According to Rolling Stone magazine, the children of the choir and Michaelson recorded the song in the home studio of Tina Weymouth and Chris Frantz of Talking Heads and the Tom Tom Club, who are longtime Connecticut residents.

Fort Worth police have arrested on man in connection with a convenience store robbery early Thursday morning where an unwitting taxi cab driver was employed as a getaway driver.

According to police, shortly after 4 a.m. a man walked into a Shell station on the 4900 block of Bryant Irvin Road and gave the clerk a note saying he was armed and would shoot her if she didn't hand over the money.

The man then left in the taxi and, according to police, directed the driver to take him to a QT gas station on Alta Mere.

When they arrived at the gas station, two Fort Worth police officers who were aware of the earlier robbery took the passenger into custody.

The name of the passenger has not yet been released.

Police said the cab driver didn't know he was being used as a getaway driver and is not expected to face any charges.

Bond Set for Teacher Charged in Fatal Hit-and-Run

advertisement

A judge on Wednesday set bond for the woman charged in the hit-and-run death of a 6-year-old Grand Prairie boy.

Tammy Lowe, 53, turned herself in to police on Tuesday in connection with the Jan. 24 hit-and-run crash that killed John Paul Raidy.

Her bond has been set at $100,000 for the felony manslaughter charge and an additional $100,000 for the charge of accident causing injury/death.

Lowe's attorney, Cameron Gray, said a judge ignored requests to reduce her $200,000 bond.

He said he met with his client two different times Wednesday. She will likely be transported from the Grand Prairie Jail to the Dallas County Jail on Friday.

Lowe's husband and Gray had a meeting at Grand Prairie police headquarters on Wednesday. Gray would not say what the meeting was about, saying it was "just tying loose ends up."

Bond Set for Teacher Charged in Fatal Hit-and-Run

Tammy Lowe, 53, has a bond has been set at $100,000 for the felony manslaughter charge and an additional $100,000 for the charge of accident causing injury/death in the hit-and-run that killed a 6-year-old boy.

Bond Set for Teacher in Hit and Run

On Wednesday Tammy Lowe was arraigned on charges of manslaughter and accident causing injury/death in connection with the fatal hit and run that killed 6-year-old John Raidy.

Police are not questioning Lowe's husband about the hit-and-run, Gray said.

He said his client is thinking about the crash.

"She's very sad about what happened," Gray said. "She feels a great deal of pain for the family of the child."

NBC 5 has obtained seven different calls made to 911 after the hit-and-run crash.

Heidy Cano, one of the callers, said she is still haunted by what she saw.

"It's like a video recorded in my mind, because it's hard to see that happen," she said.

Cano returned to the intersection Wednesday night for the first time since the crash.

"Right now, I'm standing here, and I can see it like it's happening again," she said.

Lowe, a teacher of 22 years who taught seventh-grade social studies at Adams Middle School, resigned before before surrendering to police on Tuesday.

Family members of Raidy said later that day that they never expected a teacher to be behind the wheel of the car that hit their son.

"You become a teacher because you want to spend your life teaching children, and to think that a teacher was so heartless to do this, it's unbearable," said Christina Raidy, the boy's great-aunt.

But Raidy's family said it was focusing on honoring his life, not on the woman charged in his death. His funeral was held Wednesday morning.

"It's about John; it isn't about her," said family friend Sean Martin.

NBC 5's Ellen Goldberg and Ray Villeda contributed to this report.

Fort Worth Officer Injured in Haltom City Shooting

A narcotics investigation led to a shootout in Haltom City Tuesday afternoon. A Fort Worth police officer was shot and is in serious condition.

More Photos and Videos

A suspect is dead and a Fort Worth police officer is in serious condition after a shooting in Haltom City Tuesday afternoon.

Haltom City police say a narcotics investigation led to a shootout between an armed suspect and Fort Worth police officers. One Fort Worth police officer was shot, as was the suspect.

The call came in at about 5 p.m. that an officer was shot on the 1900 block of Carson Street in Haltom City.

Cpl. Joe Hackfeld with the Haltom City Police Department said they were pursuing a vehicle involved in that narcotic investigation, but could not disclose the specifics of that investigation. Hackfeld says the man they were chasing ended up ditching his vehicle on Carson Street, just south of state Highway 121.

Haltom City officers set up a perimeter and searched neighboring businesses and homes.

A woman living behind the automotive shop, Lynsey Kendrick, told NBC 5 that her house was searched by police. Kendrick said she heard six shots from her porch.

Officer Sharron Neal, a spokesperson for the Fort Worth Police Department, says three Fort Worth police officers happened to be at 2nd Opinion Automotive talking with the owner, when they learned that a wanted man was behind the building.

Officer Neal says that as the officers went to confront the man, he opened fire on the officers. Neal says the officers returned fire. However, given the early nature of the investigation, it's unknown at this time how many of the officers returned fire and how many rounds were fired. It is also too early to know how many shots the man fired.

The injured suspect was taken to John Peter Smith Hospital with life-threatening injuries. He died from those injuries Tuesday night. His identity has not yet been released. An autopsy is scheduled for Wednesday afternoon, according to the Tarrant County Medical Examiner.

The officer was transported to Harris Methodist Hospital with serious, but not life-threatening injuries.

"A Fort Worth police officer has been shot," said Cpl. Tracey Knight with the Fort Worth Police Department. "He is in serious condition. He is being treated here by the best doctors in the city. And so we ask for all of our citizens to keep our officer in their thoughts and prayers."

Fort Worth police said the identity of the injured officer has not been released due to the nature of the investigation. Police did say the officer is a 21-year veteran with the department and is in serious condition.

Sources within the Fort Worth Police Department tell NBC 5 this officer was shot three times.

The investigation is ongoing.

The city of McKinney is promoting a grant program that provides money to clean up potential hazard sites as part of its revitalization of its historic downtown.

The city received state and federal grant money totaling about $400,000 in 2011 for the Brownfields Program, a tool property owners can use to look into whether or not their land has pollution or any kind of contamination.

If contaminants are identified on the property, the money helps clean up the area at no cost to the property owner.

The program focuses on the state Highway 5 corridor through the city's east side.

"When you're looking at the town center of McKinney, there were many uses -- manufacturing, industry; there was a lot that went on here," city spokeswoman Anna Clark said. "There weren't the same environmental standards in this area as there are now."

According to members of the city planning department, the grant money has a twofold purpose.

"One, identify potential contaminants or, two, give them a clean bill of health so that they can reinvest in their property," said Ross Altobelli, McKinney planning manager.

It also plays into the city's vision for the historic downtown, part of the Town Center Study Initiative to bring revitalization to the original city center.

"It's when we're looking at taking our downtown area and expanding it from the west side of Highway 5 to the east side of Highway 5, there's room for people to come and visit," said Clark, citing the use of grant money to study the safety of a parking lot near the old Flour Mill, which is undergoing a redevelopment.

"We want to maintain that historic element and the authenticity of our town center," Clark said.

At the beginning of the program, about 20 properties in the Highway 5 corridor were identified to undergo analysis.

Man Arrested in Laser Strike on DPD Helicopter

A Dallas man has been arrested in a laser strike on a police helicopter that was assisting officers who were looking for a car burglar.

A man accused of pointing a green laser pointer at a Dallas police helicopter flying during an investigation appeared in federal court on Tuesday.

Police say Kenneth Santodomingo, 22, pointed the laser at the aircraft from his home early Monday morning.

He is now is facing a federal count of aiming a laser pointer at an aircraft. The penalty for the offense is five years in prison and a $250,000 fine.

Santodomingo's hearing on Tuesday was continued because his attorney, Mark Fernandez, told the judge he needed more time.

Authorities say Santodomingo pointed the laser several times at a helicopter assisting officers looking for a car burglar. The pilot found where the light was coming from and directed officers on the ground to the location.

Dallas police released video of the incident on its YouTube page.

A plea is expected when his hearing continues on Thursday. The judge is also expected to either set a bond or keep Santodomingo in federal custody.

The FAA said pilots flying into North Texas airports in the last year have reported more than 100 incidents, including 37 at Dallas Love Field, 49 at Dallas/Fort Worth International Airport and 13 at Fort Worth Alliance, Spinks and Meacham airports.

Sharon Osgood of Hayward and her boyfriend are heading out to the Super Bowl, despite the fact that they were scammed out of nearly $6,000 when they thought they were buying the prized football tickets on Craigslist.

Turns out, she actually ended up a winner.

The Mercury News, which first reported her story, said that Ticketmaster CEO Nathan Hubbard called her to offer her four free tickets and set her up with breakfast with NFL Legend Troy Aikman. A 49ers representative is giving her a pair of tickets, too, because Osgood wanted to bring her nephew's girlfriend. Her boyfriend's daughter and her nephew are also going. She has one left over for another relative.

"I am so super excited," Osgood told NBC Bay Area on Tuesday afternoon. "I can't tell you how blessed I feel. We were crushed, and then we were elated."

Osgood's fortune has taken a happy twist. Her tale, at first, was a sad one.

She was scouring the Internet looking for good deals on Super Bowl tickets, so that she could see her beloved San Francisco 49ers play the Baltimore Ravens in New Orleans on Sunday.

Full Super Bowl coverage

She found an offer on Craiglist. She said someone named "R. Thomas Pham Quan" was selling four tickets for $5,900. He told her that he was a tax attorney in Boca Raton, Fla, and a Baltimore Ravens season ticket holder. She said she texted and spoke on the phone with this person for four days, she said. She wired the money to the man's credit union, and on Monday, she received a FedEx package. But there were no Super Bowl tickets inside.

But instead of tickets, Osgood was sent a picture of quarterbacks Colin Kaepernick and Joe Flacco with a message underneath that read: "Enjoy the game!!!! Go Ravens!!!

On Tuesday, the phone number she had been using was no longer working, but she said she filed a report with the Alameda County sheriff's department late Monday. A spokesman for the sheriff's office wasn't immediately available to confirm the details.

But she said the person sounded so convincing and she felt she sort of "knew" him because they had so many phone and text conversations about the transaction.

"I trusted the guy," she said.

Craigslist warns that buyers should not wire money directly to sellers. Best practices in this online marketing world are that buyers and sellers who connect on Craigslist should meet in public places and pay in cash. Buyers and sellers on sites such as eBay should heed seller's ratings listed online, which reflect their number of successful transactions, and pay through PayPal, a secured site owned by eBay.

Osgood was initially worried about going public with her story. But now, she's happy she decided she put a face on her saga. Not only did she score free tickets, but she said she wants to prevent others from falling prey to ticket scammers.

"Who knows? Maybe they scammed other people too," she said. "I won't ever do this again."

Super Bowl Chicken Wings Could Cost You More

Kevin Cokely, NBC 5 News

With chicken companies producing fewer birds in 2012 because of the drought, football fans could end up paying more this Super Bowl.

Fewer chickens are coming home to roost this year.

The National Chicken Council (yes, there really is such a thing) reports that Americans will consume 1.23 billion chicken wings this Super Bowl weekend -- down about 1 percent, or 12.3 million, from last year.

Chicken companies produced fewer birds in 2012 because of the drought and the resulting higher corn and feed prices.

"The big thing is, feed costs went up this year, so when you get the higher temperatures combined with increased feed costs you're not going to have as many chickens produced," said Bill Katz, owner of Frankie's Sports Bar & Grill.

With three locations in Dallas, Fort Worth and Lewisville, Frankie's expects to sell 15,000 wings this weekend.

The sports bar is paying a bit more for them this year but not charging customers any more.

"Having a large supplier, consistent quality, consistent pricing -- it makes it easy for me," Katz said.

But fewer chicken wings to go around may make them harder to find in some places -- or, at the very least, more expensive.

"If you're a smaller store or dealing with a smaller supplier and you're trying to piecemeal stuff together, they're going to be last in the pecking order," Katz said. "You know, it's like the big dogs eating at the bowl. The big dogs are going to get their food, and the little dogs [are] going to get the leftovers."

Wing prices normally spike each year right before the Super Bowl, but the wholesale price has never been higher -- about $2.11 per pound, up 26 cents from last year.

Moss Proclaims He's "The Greatest Receiver" in NFL History

The intense proximity of journalists and athletes at Super Bowl Media Day usually causes one or two moments noteworthy for their ridiculousness, despite most players endeavoring to maintain a low profile. Leave it to Niners wide receiver Randy Moss to make things interesting.

"I do think I'm the greatest receiver," declared Moss. "This year has been a down year for me statistically, the year before I retired was a down year and then in Oakland was a down year. So, I don't really live on numbers, I really live on impact and what you're able to do out on that field. So I really do think that I'm the greatest receiver ever to play this game."

As heads around the world shook in disbelief, NFL Network analyst Rich Eisen said what we all were thinking.

"And Jerry Rice just threw something at his television set," joked Eisen, who went on to express his gratitude to Moss for offering something other than the standard boilerplate so many athletes regurgitate.

But sometimes boilerplate is exactly what a team needs, and that's what deposed Niners starting QB Alex Smith offered up on Tuesday. Media Day can be a grind under the best of circumstances, so imagine the dread felt by Smith, who lost his starting job in November, after sustaining a concussion during a 24-24 tie with the St. Louis Rams.

In less than three months, Smith has gone from leading the offense of a first-place team to not even having a podium at Media Day. But Smith took it like a man, standing there amid a rotating throng of journalists, addressing the biggest loss of his career.

"It's tough, for sure. I'm not gonna lie to you," Smith said. "It hasn't been the easiest thing, it's been frustrating, disappointing, for sure. I really felt like I was playing my best football right before the injury, so that's been tough. But at the same time, you deal with it, you move on… Do I still deal with it? For sure. But this is a team game. I love the locker room, I love the group of guys we have, and that's bigger than me. I certainly wasn't gonna put myself before any of that."

Colin Kaepernick, the man who replaced Smith as the starting QB, made every effort to be equally gracious about the awkward situation.

"Alex is a great guy, he's been phenomenal this whole time," Kaepernick said when asked about his relationship with his predecessor. "He's done everything he can to help, and he continues to help me."

Kaepernick hopes to lead San Francisco to their sixth Super Bowl championship, which would tie them with the Steelers for most all time. Naturally, he turned to Steve Young, who in 1995 led SF to the last of those titles, for some advice.

"Steve Young gave me two words that he thought about when he thought about the Super Bowl: 'humility' and 'fierce.' Those are two things that resonated with me.

Nobody drew a bigger crowd at Media Day than Ravens linebacker Ray Lewis, one of the NFL's biggest, loudest, most controversial personalities.

Among the first question thrown his way was about the recent "Saturday Night Live" sketch spoofing his emotional outburst during the National Anthem ahead of the AFC Championship game against the Patriots.

"I'm a big comedian myself, so I love comedy," laughed Lewis. "I looked at it, I enjoyed it, like most fans enjoyed it."

On a more serious note, Lewis is mentioned in a Sports Illustrated story that went online shortly before Lewis faced the media, in which it is claimed that the future Hall-of-Famer had used a banned substance, deer antler velvet extract, to come back from injury. Lewis brushed aside questions about the report.

"Two years ago it was the same report, I wouldn't give that report or him any of my press," said Lewis. "He's not worthy of that. Next question."

Lewis offered a more formal denial via the Ravens.

"Ray has been randomly tested for banned substances and has never failed a test. We have never been notified of a failed test. He has never been notified of a failed test," Kevin Byrne, vice president of communications for the Ravens, told ESPN. "He denied using the substance discussed in the article and we believe him."

With five more days until the big game, you can be sure we haven't heard the last of deer antler velvet extract.
