An 18-year-old accused of pointing a gun at a Dallas police officer says he is apologetic for his alleged crimes, including one for which he has yet to be charged.

Darron Robinson will turn 19 on Saturday, a milestone he will mark in jail. He is charged with aggravated assault of a public servant and evading police.

"I just want to be at home," Robinson told NBC 5 in an exclusive jailhouse interview.

When asked how his life had spiraled, Robinson said he ignored the warnings from his mother and loved ones, who always told him to steer clear of older men on the block who were up to no good,

"I was being a follower; that's all I can say," he said.

Robinson admitted that he was scared and ran from police on Wednesday. An undercover Dallas police officer fired a shot while pursuing Robinson, a suspect in the armed robbery of a convenience store one day earlier.

"I just want everybody to know I ain't no menace or nothing like that," Robinson said. "I ain't trying to hurt anyone."

Robinson said he robbed the store but said he never pointed a gun.

"I used the gun but I never pointed it at his face," he said. "I just showed him that I had the gun."

As officers approached Robinson near the same store on Wednesday, he ran through an apartment complex. He said he still had the gun on him but denied pointing it at the officer,

"I grabbed it out my shirt, but just to throw it; never to hurt anyone," he said. "I was just trying to run away and get rid of the gun. I never pointed it at anyone. I threw it, and I just kept running while he shot at me."

According to police reports, Robinson ditched the gun, tossing it onto a patio in the apartment complex. He then hid beneath a car before police found him.

Robinson said he recently got a gun only for protection. He showed NBC 5 a fresh bullet wound in his lower back area, saying he was shot in recent weeks while he was passenger in a car. The shooter is still on the loose and neither he nor police know who is responsible, he said.

Robinson said he is afraid of guns and would never point them at anyone. All he could think to do when police came after him was to run and try to get rid of the weapon to avoid being charged with having a gun, he said.

Officials of the small central Texas town devastated by an April 17 fertilizer plant blast that killed 15 people have filed suit against the plant owner and supplier.

The lawsuit filed Friday seeks unspecified damages from plant owner Adair Grain and CF Industries, which supplied agricultural-grade ammonium nitrate toe the plant. A fire at the plant ignited the explosive chemical, flattening homes, schools and businesses and killing firefighters and other first-responders fighting the fire.

The lawsuit filed in state district court in Waco alleges Adair Grain was negligent in how it stored the chemical and that CF Industries was liable for an inherently hazardous product.

Adair Grain spokesman Daniel Keeney and CF Industries spokesman Dan Swenson told the Waco Tribune-Herald that they hadn't reviewed the lawsuit and declined to comment.

A man arrested Wednesday with bomb-making materials in his car had drugs and an alligator in his home, a federal agent testified Friday.

Clayton Earthman, 43, was arrested after police said he ran a stop sign near Fair Park.

An officer said Earthman had a gun in his car. A search later revealed he had bomb-making material and notes on how to make bombs, police said.

Earthman claimed to be a "Doomsday Prepper." A cable TV show by the same name profiles people preparing for the end of the world.

On Thursday, agents with the bureau of Alcohol, Tobacco, Firearms and Explosives searched his house near Pleasant Grove.

They found 15 marijuana plants, bomb-making material, and an alligator, according to a Dallas police report.

Neighbors say they saw agents carry two alligators from the home on Woodard Avenue.

"That's scary," said neighbor Susan Collins. "We didn't know he had all that."

At his court appearance, a judge ordered Earthman held without bond because he was a danger to the community.

Frisco's 911 Phone Lines Restored

The Frisco Police Department said Friday afternoon that all of its 911 phone lines were down.

Frisco police announced that service was restored at about 10 p.m. and all 911 lines have been repaired and are now working.

All 911 calls were rerouted to the McKinney Police Department during the outage, which is then transferring the calls to Frisco police.

The department instructed people who needed to call 911 to call the non-emergency line at 972-292-6010 until the issue was resolved.

Frisco police said they do not know the cause of the problem.

Driver Helps Woman Delivery Baby on Side of Road

A Good Samaritan helped an expectant mother and her husband on the side of the road deliver their baby.

A Good Samaritan helped a Gainesville, Texas couple welcome their first son a bit earlier than expected on Friday morning.

Baby Landon was born at about 7:30 a.m. just off the southbound lanes of Interstate 35W near Alliance Airport in Fort Worth.

The parents were planning to give birth in Fort Worth after recently moving from Arlington to Gainesville. 

Mom Karen Call - a certified EMT - was prepared in case the they didn't make it to the hospital.

"I brought two shoe strings and scissors, and some towels in case the baby came early," Karen Call said.

The couple didn't make it to the hospital.

Four people stopped alongside the road to help. One was them was Charles Harrell, owner of Tex Star Towing, who helped deliver the baby.

"I did what I had to do," Harrell said.

"I help everyone, that's why I started the business, so I could help people," Harrell said.

Harrell was bringing a stranded driver back from Oklahoma when stopped to help the expectant Calls.

"Just seen a car swerve off to the side of the road, seen a guy with a black blanket run out and the lady rolled out of the car," said Harrell. "And I went, 'she's having a baby.'"

Armed with blankets and gloves of his own, Harrell and his passenger sprung into action.

"The husband was kind of panicking and we just told her to push and everything will be all right," Harrell said.

About 10 to 15 minutes after pulling over, at 7:28 a.m. according to MedStar's 911 log, baby Landon was born.

"It was a beautiful baby, it didn't really set in until I got back into the truck to leave," Harrell said.

Mom and baby are doing fine now at Texas Health Harris Methodist.

When asked whether he'd ever delivered a baby before, Harrell smiled and simply said, "some puppies."

Landon is the couple's second child. The two already have a 17-month-old daughter.

The family expects to be back home in Gainesville by the end of the weekend.

FBI Makes Arrest in "Mesh Mask Bandit" Case

The FBI says it has finally arrested the North Texas man believed to be the "Mesh Mask Bandit."

The FBI said Luis Delagarza, 59, of Farmers Branch, has been charged in a federal criminal complaint with committing armed bank robbery.

Delagarza was once considered one of the most dynamic local leaders in the Latino community.

"This was somebody that associated with some of the most important people in Dallas," said Carlos Quintanilla, Accion America president and longtime community activist.

NBC 5's sister station Telemundo interviewed Delagarza several years ago about immigration reform.

The FBI said a witness identified Delagarza from a photo lineup.

According to the FBI's complaint and affidavit, the witness saw the face of the man who robbed a Wells Fargo Bank in the 13000 block of Josey Lane in Farmers Branch on April 22.

The bank is blocks from Delagarza's home.

The witness reported seeing the man's face both before he pulled on his dark mask and entered the bank with a handgun and after the robbery, when he removed the mask outside the bank.

"The identification of the 'Mesh Mask Bandit' by the FBI's Bank Robbery Task Force was the result of collaborative local and federal investigation across nine cities," said Diego G. Rodriguez, Special Agent in Charge of the FBI Dallas Field Division. "The arrest of this dangerous individual illustrates the effectiveness of task forces, the support provided by the U.S. Attorney's Office and cooperation within the law enforcement community."

The FBI had dubbed the bank robber the Mesh Mask Bandit because of his mesh mask that hid his face.

The Mesh Mask Bandit was linked to robberies at 19 banks in North Texas since New Year's Eve.

Bank customers said they are relieved an arrest has been made.

"I'm glad they caught him," Brandon Vidal said. "It's a good thing. Put him away."

Delagarza made his initial appearance in federal court Friday. A judge ordered that he remain in federal custody.

He will be back in court on Tuesday.

Delagarza was arrested twice before on charges of speeding and theft.

Safe Room Program to Open Wait Lists

After a flurry of applications forced a North Texas agency to close a storm shelter rebate program, a new waiting list for applicants in multiple counties is rolling out.

The North Central Texas Council of Governments will open an online wait list for Safe Room program rebates June 21-30.

All 16 counties in the NCTCOG region will have wait lists open in a rolled-out schedule. Once a wait list has been opened for a specific county, it will not close.

To be placed on the wait list, applicants will need to provide their name and address at www.nctsaferoom.com once the wait list for their county opens.

Those without Internet access can call 817-695-9235 and leave a voice mail with their name, phone number, address and county. All submissions online or via phone will have a time and date stamp, the NCTCOG said.

Here is the list of each county's open date and time:

  • Collin County: Friday, June 21 at 7 p.m.
  • Dallas County: Saturday, June 22 at 8 a.m.
  • Denton County: Sunday, June 23 at 8 a.m.
  • Ellis County: Monday, June 24 at 7 p.m.
  • Erath County: Monday, June 24 at 7 p.m.
  • Hood County: Tuesday, June 25 at 7 p.m.
  • Hunt County: Tuesday, June 25 at 7 p.m.
  • Johnson County: Wednesday, June 26 at 7 p.m.
  • Kaufman County: Wednesday, June 26 at 7 p.m.
  • Navarro County: Thursday, June 27 at 7 p.m.

Safe room rebate program officials said the wait lists will help the NCTCOG assess demand for the program and allow them to communicate the need to federal funding sources.

The NCTCOG said the safe room program is not retroactive, meaning applicants must be approved before installing a storm shelter.

Those who have already applied to the safe room program will be notified that their application has been received and do not need to apply again. The NCTCOG will contact applicants who join the wait list after the program receives additional funding. Organizers say the process could take three to 18 months.

The Metro Safe Room Rebate Program is funded by a $1.395 million Federal Emergency Management Agency grant.

The rebate program offers residents living or developing in North Texas counties a chance to qualify for half the cost of construction for an individual safe room, up to $3,000. But the rooms must be from a vendor approved by the National Storm Shelter Association or the American Tornado Shelter Association to qualify for reimbursement.

Girl at Center of Lung Transplant Controversy Out of Coma

Ten days after a successful double-lung transplant surgery, 10-year-old Sarah Murnaghan is out of a coma and responding to questions, according to a family spokesperson.

Murnaghan received her new lungs on June 12, after spending three months at Children's Hospital of Philadelphia with end-stage cystic fibrosis.

The Newtown Square girl made headlines after her parents battled national policy over how children under 12 are placed on the waiting list for donated lungs.

Her new lungs came from an adult donor, after a judge decided that the under 12 rule could be modified in her case-- a decision that put her on the adult list.

The transplant isn't a cure for cystic fibrosis, but it can extend her life by years.

San Francisco Church Hoping to House Dead Pets in Basement

During his lifetime, Saint Francis of Assisi was famously devoted to animals. Paintings and statues depict the saint frolicking with birds, dogs and other beasts.

The lore of San Francisco's namesake seemed an ideal fit for a city where dogs outnumber kids. Inside the National Shrine of Saint Francis of Assisi in San Francisco's North Beach, tributes to the saint's life abound, especially in its annual blessing of the animals.

On a recent weekend, the shrine's rector Father Gregory Coiro blessed some 500 pets during the two-day stretch.

"Mostly dogs," said Coiro, wearing a brown robe and tangled beard. "But there were a few cats and a few angora rabbits."

The Shrine has long opened its doors to living pets in the spirit of Saint Francis. But now, it's also opening them to the dead. In a newly discovered grotto beneath the shrine's front steps, Coiro has envisioned the building of a columbarium to house the ashes of the dearly departed of the pet world.

"The people who bring their pets here can be Catholic or they can be non-Catholic," said Coiro. "Cause afterall, the animals have no religion."

Currently the concrete pillared cave looks like the ruins of a Roman temple.

Though work on the site has not yet begun, the Shrine recently released a brochure with depictions of glass-walled partitions where pets' ashes will be interned.

Visitors will be greeted by a large portrait of Saint Francis himself, and a video monitor will play video loops of pets enshrined in the space. In another corner, a large memorial will pay tribute to police and rescue dogs, like those who searched for survivors and bodies amid the rubble of the Twin Towers in New York on 9/11.

"As somebody walks through and visits the columbarium it'll be like an on-going history of people involved with the shrine; animals that have been involved in families lives," said Bill McLaughlin, a church volunteer who's helping organize the construction.

Some of the shrine's neighbors have complained they weren't notified in advance of plans to store ashes amid hundreds of businesses. Fabio Giotta, one of the owners of nearby Caffe Trieste said he was surprised by plans to build a "pet cemetery in a national shrine." Coiro said the shrine hasn't yet applied for permits from the city.

Both the San Francisco Health and Planning Departments referred calls on the matter to each other. A Health Department Spokeswoman said the department was only interested in dead animals when people ate them.

Coiro admitted the columbarium would also help generate money for the upkeep of the shrine.

He said the church hadn't determined the fees for housing pet cremains, although the brochure was seeking donations to the project in the $1000 to $40,000 range.

Coiro said he was moved by his childless sister who considered her dogs family, and was distraught when they died.

"I understand for many, many people, their animals are very dear to them," said Coiro.

Fired Employee Shot and Killed Former Boss: DPD

Dallas police say a man who was fired from his job at a barber shop shot his former boss late Friday afternoon.

Just after 5 p.m. Dallas police officers were called to a shooting at Roman's Barber Shop in the 300 block of West Jefferson Boulevard.

Police say 29-year-old Alejandro Fernandez had been shot and died later at Methodist Central Hospital.

Witnesses told homicide detectives 30-year-old Charles Dewayne Hooks walked into the barber shop and shot Fernandez. Hooks had been fired by Fernandez earlier in the day according to police.

Hooks was arrested and has been charged with murder.

DISD Faces Teacher Shortage for Summer School

The Dallas school district says it is working on plans to deal with a teacher shortage for summer school.

The Dallas Independent School District is not quantifying how many teachers are needed for summer school, saying only that the need is real. Summer school begins Tuesday.

"The need is critical, but we're not pushing the panic button just yet," district spokesman Jon Dahlander said.

Administrators are already working on contingency plans to accommodate classes, he said.

"Some of the changes that we are considering is having larger class sizes," Dahlander said. "We had planned to have class sizes at about 16 to 18:1. It may be a little bit more than that."

Bilingual and secondary math teachers are among the most critical of the district's needs.

Abigale Vera, an eighth-grader who needs a course to move on to the ninth grade, needs a bilingual teacher.

"I don't know English that much," she said. "I know Spanish better."

Without the course, she could be forced to repeat, but her mother, Irma, said her daughter would rather drop out than repeat eighth grade.

Angela Davis, president of the National Education Association, a teachers group, said this is the first time in memory that the district has had a summer school teacher shortage.

"We've never had a shortage for summer school, never," said Davis, who blames the lack of interest in teaching summer school on administrative policies.

She said DISD teachers are so fed up with random pop evaluations in class that they have decided to pass on summer jobs that promise more money and fewer hours so they do not have to face more scrutiny and stress.

Davis said it is all a reflection on a sour relationship between teachers and DISD Superintendent Mike Miles.

DISD administrators met Thursday to address the teacher shortage and will continue to meet until Tuesday morning. So far, no decisions have been made about closing summer programs at some schools, and the district promises to be ready for the thousands of enrolled children.

"We're going to have summer school ready to go on Tuesday," Dahlander said. "It may not be quite the way that we had planned, but we'll be ready for your child."

Three young boys were home alone in North Fort Worth playing video games when two masked men broke in on Thursday afternoon.

"We were playing games until I saw a shadow," 12-year-old Daniel Rodriguez said.

"I saw somebody with, like, a black bandana and yellow right here," 12-year-old Kevin Avila said.

Avila and his two cousins, Rodriguez and a 14-year-old, hid in a bedroom.

"I saw them, but they didn't see me," Avila said.

His mother happened to come home from work, unaware of what was going on inside.

"My mom came right in time," Avila said.

Without even knowing it, she apparently scared the burglars away.

"If I didn't show up on time, they would have been dead," Jessica Henderson said.

She called police.

"They got here in two minutes," she said. "Oh my God, it's crazy. You wouldn't think that somebody could come into your house with a freakin' mask on in broad daylight."

Three people were in custody Thursday evening and were being questioned, said Fort Worth police spokesman Sgt. Kelly Peel.

Pest control shops across Dallas-Fort Worth say they're seeing an increase in scorpions lurking in homes in several cities.

A lot of it has to do with the heat, but homeowners also could unknowingly be bringing them into their homes, said Marty Keane, with The Pest Shop in Plano.

Often, scorpions hide in sand. Keane said they can "stay in those areas for up to six months and stay alive without ever feeding."

Many homeowners use sand during housing construction and in gardening.

Parents should also be aware of the possibility of scorpions hiding in children's sandboxes.

"So six months, you know, after kids going back outside and start playing in sandboxes, they start shoveling and there you go -- there are the scorpions," Keane said.

The best way to prevent scorpions is to go to a pest control shop and buy a repellant that can spray around the home and at-risk areas such as sandboxes, she said.

Dozens of residents have been displaced by an apartment fire that destroyed eight units early Friday morning.

Neighbors reported seeing the fire start at about 3 a.m. Friday on the outside of the Spanish Garden Apartments at 2838 Royal Lane in Dallas.

Investigators said they are looking into whether an electrical program is to blame for the blaze. Fire crews said power lines run from a transformer on the backside of the building and into the complex.

Firefighters were able to keep the blaze contained to one building, but had trouble knocking down the fire after it spread to an area of flat line roof that had another, sloped roof constructed on top of it during a remodeling of the buildings. A Dallas fire chief told NBC 5's Kendra Lyn that situation was not uncommon.

A total of 29 people, 19 adults and 10 children, have been displaced by the fire. Residents were able to evacuate and no one has been reported as missing.

Firefighters have been able to enter the units to retrieve essential items like medications for some of the residents, but crews are concerned about the possibility of collapsing ceilings in areas where water is sitting on top of the roof.

Some residents reported that smoke alarms did not go off when the fire started. Investigators said they are looking into those claims.

Dallas Stars General Manager Jim Nill announced Friday the team has hired Lindy Ruff as the new head coach.

Ruff, now in his second stint as a NHL head coach, was last with the Buffalo Sabres. The Sabres made eight postseason appearances, four trips to the Eastern Conference Finals, and an appearance in the 1999 Stanley Cup Finals (which they lost to your Dallas Stars) under Ruff's tenure.

Ruff is one of only 17 head coaches to reach net 500 victories and holds the third-most wins of any active coach.

"One of the trademarks of successful organizations is their ability to have continuity and stability for an extended period of time," Nill said in a press release. "It is clear from Lindy's record, and from our own conversations, that we have found the right person to provide that stability and lead this club to the next level. His steady hand and experience will prove invaluable in returning our team as a top-tier contender in the NHL."

"I am honored to be joining the Dallas Stars organization," Ruff in a press release. "After speaking at length with Jim Nill, it was clear that all the right pieces are coming together to return this club to the upper-echelon of the NHL. I look forward to leading its resurgence."

The Stars will hold a press conference at noon on Friday to introduce Ruff as head coach.

Ruff is the latest change to the Stars organization, which fired head coach Glen Gulutzan and assistant coach Paul Jerrard in May. Those staffing changes were ushered in by new GM Nill, who replaced former GM Joe Nieuwendyk. The Stars finished last season Dallas 22-22-4 without earning a spot in the playoffs for the fifth season in a row.

The Joshua Independent School District has apologized to a high-school valedictorian whose microphone was switched off during a graduation ceremony when he deviated from prepared remarks.

Superintendent Fran Marek apologized to Remington Reimer after meeting with him and his attorney Thursday.

Reimer's microphone was switched off during the June 6 ceremony after he deviated from prepared remarks and began talking about his religious beliefs.

He also alleged that his principal threatened to contact the U.S. Naval Academy, where Reimer has been accepted, to complain about his bad character. But Marek said "the district has never intended to, nor will take, punitive action."

Reimer says he's thankful and knew the school district would support him.

The death of a Canadian tourist whose body was found in a rooftop water tank at a downtown Los Angeles hotel was ruled accidental due to drowning, according to the Los Angeles County coroner.

The report released Thursday in the death of Elisa Lam also lists "bipolar disorder" under other significant conditions. The 21-year-old's body was discovered when a maintenance worker was inspecting the tanks Feb. 19 atop the Cecil Hotel (map).

Lam, of Vancouver, was visiting Los Angeles and staying at the hotel on Main Street in late January when she was reported missing. Her parents called police after they had not heard from her for a few days.

Surveillance video from the hotel's elevator captured images of Lam on Feb. 1. The video shows Lam pressing several elevator buttons before stepping in and out of the elevator.

Her body was discovered in one of four 4-foot-by-8-foot tanks on the roof Feb. 19 when a worker inspected the tank after reports of water pressure problems at the 15-story hotel.

The tank was about three-quarters full when the body was discovered. The tank has a metal latch that can be opened, but authorities said access to the roof is secured with an alarm and lock.

The single-room-occupancy hotel has an unusual history. "Night Stalker" Richard Ramirez, who was found guilty of 14 slayings in the 1980s, lived on the 14th floor for several months in 1985. And international serial killer Jack Unterweger is suspected of murdering three prostitutes during the time he lived there in 1991. He killed himself in jail in 1994.

In 1962, a female occupant jumped out of one the hotel's windows, killing herself and a pedestrian on whom she landed.

Over 400 people will be tested starting Friday for tuberculosis after being in contact with a person carrying the disease at Lee High School in Fairfax County, Va.

The Fairfax County Health Department says two recent cases of TB have been confirmed at the high school this month. A third case, discovered in December 2012, is also under investigation, according to officials.

On June 17, letters were mailed to students and faculty members, notifying them of the Health Department's investigation. A second letter was sent to 400 students and 30 staff members recommending they be tested for the disease after it was determined they were at risk for exposure.

Fairfax County Health Director Gloria Addo-Ayensu said those requiring testing were identified as having 24 hours or more of contact with the three infected individuals. Addo-Ayensu said the specific strains of TB in those individuals have not been identified.

TB is spread through the air and can attack any part of the body, including lungs, the kidney, spine and brain, according to the Centers for Disease Control and Prevention.

Skin tests and blood tests are usually used to determine whether a person is infected with TB. Tests will be given at the school starting Friday morning.

"Even one fatality  is a shame because TB is so treatable and the medications are so cheap," Addo-Ayensu said. 

TB symptoms include a bad cough lasting for more than three weeks, weight loss, fever, chills, weakness, coughing up blood and chest pain.

If not treated correctly, the disease can be deadly.

New York City mayoral candidate Anthony Weiner is apologizing after a voter used a gay slur to refer to his opponent, Christine Quinn, who is a lesbian.

In the encounter observed by the Washington Post, Weiner was campaigning and asked a woman if she was a registered Democrat.

"I am," she said. "And I'm not voting for uh, what's her name? The dyke."

Weiner said, "OK. I just need you to sign the petition to get me on the ballot."

According to the Post, Weiner then noticed a reporter's incredulous reaction and added "and really, you shouldn't talk that way about people."

After she apologized, according to the Post, he said "that's OK. It's not your fault."

Weiner's campaign spokeswoman tweeted an apologetic statement from him Thursday, saying "homophobia is vile and destructive."

"I admonished the woman amid a large crowd on a street corner and by no means believe that anything about her comment was appropriate," he said. "If the impression is that I did, I apologize because behavior like this will absolutely not be tolerated in my administration."

Quinn told reporters Friday that Weiner had called her and "clarified the interaction."

"I think it is incredibly important for all New Yorkers, but particularly those in public life, to make very clear that in this city -- the most diverse city in the world, the city where the LGBT civil rights movement was born,- -- that that type of language cannot be tolerated," she said. "And I was grateful for him to call and clarify that."

Two planes came dangerously close to each other in the air over New York City, NBC 4 New York has learned.

The near-miss at 3:45 p.m. on June 13 is being investigated by the Federal Aviation Administration.

A Delta Airlines Boeing 747 arriving at Kennedy Airport missed an approach, and ended up in the same direction as a Shuttle America Embraer 170 regional jet leaving LaGuardia's Runway 13, according to the FAA.

"The two aircraft were turning away from each other at the point where they lost the required amount of separation," the FAA said in a statement.

The planes came within 200 feet of each other, according to a federal official.

It's not clear why the Delta pilot made the decision not to complete the landing at Kennedy Airport, but the standard procedure, called a missed approach, is regulated by specific procedures for both pilots and controllers.

In this case, air traffic controllers had attempted to vector the Delta 747 away from other air traffic, and the 747 lost required amount of separation with the Embraer leaving LaGuardia, aviation officials said.

Both planes landed safely. Flyers at LaGuardia Airport were startled to hear of the near-miss. Gary Margolis recalled a similar experience in which "we had to land and take off again because we were a little too close to a plane on the runway."

"That's a scary thing to be on a plane when that happens," he said.

Bob Brown of Danbury said passengers deserve stricter measures to make sure planes stay far apart.

"What is the corrective action?" he questioned. "You never hear about how they make sure it's never going to happen again."

A Tyler snake expert pleaded guilty in federal court Tuesday to smuggling seven Peruvian snakes into the United States by concealing them underneath his jacket.

William Lamar, 63, was caught with the snakes in August at Dallas-Fort Worth International Airport. He had purchased the snakes at a market in Lima, Peru, and flew with them in his jacket to Miami and then to DFW, where a Transportation Security Administration officer found them while Lamar was trying to board a commuter flight to Tyler.

The snakes were all small, about six inches long, according to the U.S. Attorney's Office. Lamar transported them in plastic cases in his jacket.

According to the U.S. Attorney's Office, five of the snakes were venomous. The five Peruvian pit vipers included three Bothrops barnetti and two Bothrops pictus. The other two snakes were an Oxyrhopus fitzingeri and a Pseudalsophis elegans.

Lamar is a partial owner of Colorado-based ecotourism company Green Tracks, according to a representative who answered the phone at the company's listed phone number Tuesday. His biography on the company website states that Lamar also conducts research on reptiles and amphibians for the University of Texas at Tyler.

A university spokesperson confirmed Tuesday that Lamar has been an adjunct professor there but was not able to confirm his current status with the school.

Lamar is the author of at least three books on snakes and reptiles and has been a speaker at an event for the Austin Herpetological Society, among other events in that field.

According to several articles posted online, Lamar has spent decades doing research in the Amazon and leading tours in the region.

According to U.S. Attorney John M. Bales, Lamar stated in an Eastern District of Texas courtroom that he knew he was violating the law by transporting the snakes in his jacket without proper authorization.

Lamar was not available for comment Tuesday.

He could face up to five years in prison at sentencing, according to the U.S. Attorney's office. A sentencing date has not yet been set.

A Good Samaritan helped rescue a Frisco woman's nearly blind dog from a storm drain on Wednesday.

Elizabeth Nunn says her 10-year-old – nearly blind and nearly deaf – Pomeranian named Rocky went missing on Tuesday.

Nunn and her husband were concerned for the Rocky's safety after spotting a bobcat in the neighborhood a few days earlier.

"I was devastated," Nunn said. "I knocked on everybody's door – this whole neighborhood."

Nunn said some of her neighbors were out for a family walk Wednesday night when they heard a dog barking. The family found Rocky stuck in a storm drain.

Nunn immediately called 911 to help rescue the dog. 

While dispatchers were sending animal control, Mike Stoll, an air conditioning technician who was in the neighborhood, opened the storm drain, climbed in and pulled Rocky to safety.

Rocky was uninjured after 24 hours away from home. He is back with Nunn and her family.

"I took a picture of him [Mike Stoll] with Rocky so he could remember his hero," Nunn said.

After a flurry of applications forced a North Texas agency to close a storm shelter rebate program, a new waiting list for applicants in multiple counties will roll out in the coming days.

The North Central Texas Council of Governments (NCTCOG) will open an online waitlist for Safe Room program rebates June 21-30.

All 16 counties in the NCTCOG region will have waitlists open in a rolled-out schedule. Once a waitlist has been opened for a specific county, it will not close.

To be placed on the waitlist, applicants will need to provide their name and address at www.nctsaferoom.com once the waitlist for their county opens. Those without Internet access can call 817-695-9235 and leave a voicemail with their name, phone number, address, and county. All submissions online or via phone will have a time and date stamp, according to the NCTCOG.

Safe Room rebate program officials said the waitlists will help the NCTCOG assess demand for the program and allow them to communicate the need to federal funding sources.

The NCTCOG said the Safe Room program is not retroactive, meaning applicants must be approved prior to an installation of a storm shelter.

Those who have already applied to the Safe Room program will be notified that their application has been received and do not need to apply again. Applicants that join the waitlist will be contacted by the NCTCOG after the program receives additional funding. Organizers say this process could take 3 to 18 months.

The Metro Safe Room Rebate Program is funded by a $1.395 million Federal Emergency Management Agency grant.

The rebate program offers residents living or developing in North Texas counties a chance to qualify for half the cost of construction for an individual safe room, up to $3,000. But the rooms must be from a vendor approved by the National Storm Shelter Association or the American Tornado Shelter Association to qualify for reimbursement. NBC 5 Investigates first told you about the federal funding May 23.

Irving police are investigating a shootout between officers and a wanted man.

Irving police are investigating a shootout between officers and a wanted man.

An Irving police representative said Wednesday that officers had received a call about a domestic dispute between a man and who officers believe is the man's wife.

Investigators said the man was threatening to shoot the woman and her children.

Officers obtained a description of the man's sport utility vehicle and, later that evening, spotted him driving in Irving. Officers attempted to pull the man over, but he took off, leading them on a short chase.

In the 600 block of Balleywood Road, the man pulled into a driveway and jumped out of the SUV with an assault rifle, police said. The man then started shooting, police said.

The officers fired back, hitting the man an unknown number of times.

Paramedics transported him to Parkland Hospital, where he was listed in critical condition Wednesday night.

The shootout unfolded in front of stunned neighbors. 

"Loose bullets everywhere, police got out, started shooting, one officer got out, got his shot gun, bent down, shot him.  He hit the floor, that's when the ambulance got here, picked him up and they put him in there," says witness Jennifer Marie Matamoros.  "From what I saw, the gentleman tried to run, but didn't get to escape, so that's when the policemen started shooting at him."

None of the officers were injured in the shooting.

"It's very crazy. My heart is still beating. I'm still scared even though it's not me. I'm just blessed to see no one else was hurt," says Matamoros.  "For me being a citizen of Irving, it's scary because you never know when something like this is going to happen and when your life is going to be in danger."

Police have not released the name of the gunman or the names of the officers that were involved in the shooting.

Euless police are asking for the public's help in finding two men wanted in connection with two armed robberies.

The first robbery happened on June 11 at Stevie's Car Wash on Industrial Boulevard. In a news release, police said the men parked in an open bay at the car wash at 2:15 p.m.

They got out of a Chevrolet Impala and approached a woman who was cleaning her car. One of the men grabbed the victim from behind, put a handgun to her neck and robbed her.

Police also believe the same two men robbed a woman at an apartment complex on El Camino Real Boulevard where they stole the woman's money, her cell phone and took her ATM card.

That same ATM card was used at two businesses. This time around the men were driving a dark-colored Toyota SUV.

A Waxahachie man is behind bars after he was stopped for a Dallas traffic infraction and found to be carrying bomb making supplies in his car. The man told federal agents he is a "Doomsday Prepper."

A Waxahachie, Texas, man was arrested in Dallas on Tuesday after bomb-making supplies were found in his car during a traffic stop.

Clayton Todd Earthman, 24, told federal agents he is a "Doomsday prepper."

"Doomsday Preppers" is a reality TV show on the National Geographic Channel that details the lives of people who are heavily armed in preparation for major natural disasters or national conflicts. Earthman is not listed as a participant in the TV show on the National Geographic Channel website.

Earthman was pulled over Tuesday afternoon after running a stop sign at the corner of Hilltop Street and Lovett Avenue in East Dallas, according to a federal complaint.

The complaint said police officers saw a Glock .357 pistol in plain view on the floor of Earthman's car.

Officers ordered him out of the vehicle, right in front of Maria Macedo's home.

Her grandson, Jonathan Macedo, said she has seen other police activity in the neighborhood but noticed the large number of officers at this arrest.

"Anybody can stop them, but she was scared about this," he said.

Witnesses said agents from the U.S. Bureau of Alcohol, Tobacco, Firearms and Explosives arrived with a large van to seize items from Earthman's car.

Juanita Holgin said she watched from her front porch.

"And they had all the doors and hood and stuff open, [and] they were taking all kinds of stuff out of the car," she said.

According to an ATF complaint against Earthman, agents found "large amounts of chemicals, supplies and literature suspected to be for bomb making purposes" and "handwritten notes describing now to build various explosive devices and booby traps."

The complaint said Earthman told the agents he had "used methamphetamine approximately three days prior."

Records show Earthman has a 2008 conviction for marijuana possession. The complaint said Earthman told the agents he is using methadone to quit using heroin, which he used for about a year.

According to the complaint, Earthman allowed agents to search his Waxahachie home, where they found more guns and explosive evidence.

The home is many miles away from the East Dallas Street where Earthman was arrested.

"I take care of my grandkids here," Holgin said. "There are a lot of kids here. This is just a family-oriented neighborhood, so I have no idea what he would be doing here."

ATF representatives did not respond to requests for additional information about the case and a Dallas police representative could find no Dallas police reports on the arrest.

Two major North Texas health care providers are planning to join forces.

Baylor Health Care System and Scott & White Healthcare have signed an agreement to form a new company that will combine hospitals and service companies.

"We were confident our cultures would be a good match. Our work together over the past few months has only cemented that belief," said Robert Pryor, MD, president and CEO, Scott & White Healthcare in a press release. "We share common values, most notably a commitment to teamwork and delivering the highest quality patient-centered care. With those intact, we have a strong foundation for success."

The deal will create a new parent organization, Baylor Scott & White Health, plus a service company, Baylor Scott & White Health Service, with leaders from both systems.

The parent company will be headquartered in Dallas, while the service company will be based in Temple. Both companies plan to employ people in both cities.

When finalized, the deal would create a $7.7 billion organization with a combined 43 hospitals. Additionally, the deal would include over 500 patient care sites, 34,000 employees, and more than 6,000 affiliated physicians.

The merger is pending approval from regulatory bodies, but is expected to close in 2013.

A crash on the Dallas North Tollway in Plano snarled morning traffic there in both directions Thursday.

A silver Infiniti was heading northbound on the tollway just before the exit for Parker Road when the driver clipped a box truck causing the truck to roll on its side, according to Department of Public Safety Trooper Lonnie Haschel. 

The driver of the Infiniti fled the scene on foot, Haschel said.

The truck driver was taken to Presbyterian Hospital in Plano with non-life threatening injuries.

When the truck rolled, it hit the center median, causing lanes in both directions to be closed. That had traffic backed up in both directions for miles.

Most of the crash was cleared around 7 a.m., but crews said the inside lanes would remain closed while NTTA crews inspected the center median for damage.

The search for the driver of the car is ongoing.

A Manhattan priest who was tired of neighborhood drug dealers and urged his parishioners during a sermon to take action got a threatening letter in the mail days later.

"Watch your back," read the letter to the Rev. Boniface Ramsey, at St. Joseph's of Yorkville on the Upper East Side.

The priest showed the letter to the NYPD, and police have added patrols near his 87th Street and First Avenue location, which is not far from Gracie Mansion, the historical mayoral residence.

"I feel really safe," Ramsey told NBC 4 New York. "I feel really protected by God. I feel that the parishioners are behind me."

Ramsey's battle against criminal activity in the neighborhood got immediate attention from his congregation. He gathered 600 signatures from locals, aimed at getting more police to combat loitering, drunkenness and suspected drug activity on the corner of the intersection just yards from the church.

"I've seen the people that use the drugs," said Allen Rogers, a retired police officer who has lived down the block for more than 40 years."Why should anybody make a threatening letter against a person that's trying to do what's right?"

Since Ramsey received the letter, an NYPD community affairs officer has been in touch with either the priest or the principal at St. Joseph's "on a daily basis," said Sgt. Brendan Ryan.

Facebook could be getting into the video sharing app game.

Sources are telling several media outlets that Facebook on Thursday will announce that its popular photo-sharing app Instagram will begin to let people take short videos, much like Twitter's Vine program.

TechCrunch reported the news, while hedging that the information could also be a big off.

The official announcement on Facebook's "new product" will be announced at the Menlo Park headquarters and livestreamed here at 10 a.m. PST.

If the news is true, TechCruch said it would make sense as a direct response to the rising popularity of video-sharing services like Twitter's Vine. Viddy, Cinemagram and Socialcam also sometimes get described as "Instragram for video" apps.

The Vine app — which lets users take six seconds of video footage on an iOS or Android handset and then share those clips to Vine's own network, Twitter or Facebook — has shot up in popularity since going live in January, TechCrunch reported.

Facebook bought Instagram for $1 billion last year.

Thursday's announcement comes after Facebook announced a new hashtag feature on June 12.

A former employee of a local, high-priced dating service, Dallas Singles, told NBC 5 Investigates Consumer Unit some individuals with a criminal past are allowed to be members.  

While the service is billed as a professional matchmaking service for upscale singles, the owner said in some circumstances members can have a criminal record.  However, he insisted no member has ever been hurt or harmed.

Stephanie Gardella said she was hired as a relationship counselor at Dallas Singles in January of 2012.  The single mother first thought it was the perfect job.

"I'm such a helper," she said, adding she was able to help connect people looking for love with potential matches.

But soon after she started, she said she noticed several red flags like giving free or discounted memberships to certain clients while others would pay thousands of dollars.

"We would give beautiful, young women free memberships," Gardella said.

She also recalled the time a potential member told her he just got out of prison for theft.  She said she brought this to the attention of her supervisor but was instructed to sign him up anyway.

On its website, the company promises to perform "a thorough background screening including a criminal history check on every client." 

But Gardella told NBC5 Investigates Consumer Unit if potential members were willing to pay thousands to join, little else mattered.

"We were supposed to have them sold in 90 minutes," Gardella said.

A Dallas Singles client also told NBC 5 a background check she did on her own showed one of her potential suitors had a criminal past. 

The company's owner, Ted Law, who, on repeated occasions declined to speak with NBC 5 on camera, insisted his company does do background checks.  But he also said "non-violent felons" can be members.  He said no client has ever been harmed or would have to go on a date with someone he or she found to be objectionable.

Law called Gardella a "liar," and said she was never told to sign up a felon. 

However, he confirmed non-violent felons had bought memberships and some members, like young attractive women and older men, would get complimentary memberships.

Ultimately, Gardella was fired after a few short months of working at Dallas Singles.

"She was let go because she refused to do things our way," Law said.

Gardella insisted she didn't have a vendetta against Dallas Singles and she did not speak with NBC 5 because she was fired.

"The best thing I ever did was to leave that place," Gardella said. "What they're doing is wrong.  It's so wrong."

Dating Disasters

Former client Carol Carrillo first came to NBC5 Investigates Consumer Unit after she said the service failed her and her one and only date was a disaster. 

She said getting a refund for the $2,200 she spent on the service was difficult at best.   After months of unanswered phone calls and certified letters she contacted NBC 5. Minutes after NBC called the company, Law reached out to Carrillo and promised to give her all her money back.

But the paperwork she received said her refund was conditional.  She had to agree "not to disparage Dallas Singles, Fort Worth Singles or Singles International, or its affiliates, clients or personnel in any way in the future."

"I'd rather lose all my money than not fight these people.  They haven't given me any of what was promised," Carrillo said.

Ultimately, Carrillo said she did get refund after contacting her credit card company and filing a dispute through the credit card.

However, Law insisted Carrillo "didn't give the service a chance."  He also said the company has given thousands of dollars in refunds to unhappy members.  And he said his business has led to many happy, long-term couples.

Ariel Osterreicher, 23, said he would like to be one of those success stories.  He signed up with Dallas Singles after having little luck with online dating.

"I'm a shy person," said the college student who lives modestly.

He said his mother spent $4,500 for the service, but in the seven months since signing up he has had no dates.

"It's just a giant chess game and I just fell into the trap," he said.

His complaint echoed those of a 2012 class action lawsuit.  It was filed against Ted Law and his wife, Rachel, and related to their former company, another matchmaking service.  Plaintiffs claimed they were deceptive, did not make promised matches and set pricing "based solely on a potential customer's ability to pay." 

Law called the allegations "ridiculous." But he said he settled the suit.

As for Osterreicher, Law said he is working with him to find a perfect match, but he so far, he's still waiting for his first date.

Dallas Sprays After Mosquitoes Test Positive for West Nile Virus

There have been no human cases of West Nile virus in Dallas County and health officials are urging cities to begin spraying for mosquitoes that carry the disease. Dallas will spray from trucks through Wednesday morning.

Duncanville has decided to move forward with ground spraying in areas that have large amounts of mosquitoes.

The City Council voted to approve spraying for the near future after finding more than a 1,000 mosquitoes collectively in three different traps.

One of the traps was placed on a street where a victim died of West Nile virus last year.

No mosquitoes have tested positive for West Nile virus.

Until now, Duncanville only conducted ground spraying with authorization from the City Council when there was a confirmed presence of the virus. On Tuesday night, the council agreed it would review the policy to allow spraying without its authorization or the presence of the virus.

Judy Uehara, who contracted West Nile virus last year, lives on one of the Duncanville streets where the extremely large mosquito population was detected this year.

"You can't come outside without getting bitten," she said. "I can't take my children outside."

She said she does not want delays to slow prevention measures that might save other people from what she suffered.

"I've told people it felt like somebody was cannibalizing my legs," she said. "It hurt so bad to stand up."

Meanwhile, Dallas plans to conduct ground spraying after discovering mosquitoes infected with West Nile virus for the first time this season.

On Wednesday night, the city will spray the area bounded generally on the north by Goldfield Drive, on the west by Lawton Drive, on the south by Suetelle Drive and on the east by Cliffview Drive.

Dallas was already spraying eight locations on Monday and Tuesday nights. West Nile virus had not been detected in those areas, but they had an extremely large mosquito population.

Dallas County health officials recommended the more aggressive prevention measure.

"That may be somewhat different, but you've got to remember, a lot of things have changed," said Zach Thompson, county health director. "We didn't have an epidemic in previous years until last year."

Twenty Dallas County residents who contracted West Nile virus during the 2012 mosquito season died, and hundreds more were sickened.

This month, Lancaster and DeSoto have also agreed to the preventive spraying of high mosquito population areas without West Nile virus confirmed.

Sometimes the most effective comfort comes from man's best friend.

Rush University Medical Center took that to heart, adopting a formal policy that allows pets to visit certain patients in their rooms. The hospital became the first facility in the area to officially set such rules in December.

Rush began researching requests for animal visitors in 2010, and in the end, officials decided the reward was worth the risk.

The hospital issued a 21-point list of rules outlining animal visits. Dogs and cats are the only pets allowed, for example, and any messes must be cleaned and sanitized by the handler. Before pets are allowed through the door, the doctor and of course patient must consent to the visit.

Pets must have proof of rabies vaccination and must be groomed and bathed before visiting. They aren't allowed to visit any rooms other than that of the pre-approved patient.

Bernadette Slesinski-Evans and her dachshund Sadie became the first patient to take advantage of the rules.

One Southern California city is looking for volunteers -- to monitor a new surveillance camera system.

With Banning, Calif., becoming the latest city in Inland Empire to add a surveillance system, Police Chief Leonard Purvis is hoping members of the senior community will apply at the department to join the watch.

The 12 cameras are located at the intersection of Ramsey Street and San Gorgonio Avenue, as well as Repplier and Roosevelt Williams Parks.

The cameras record 24 hours a day and keep up to 30 days of video. Some of the cameras can pan and zoom into areas hundreds of yards away with high-quality resolution.

There are speakers above the cameras so the person monitoring the system can warn the public.

Neighboring Redlands has been using a similar system.

"The chief calls it effective policing," said Liza Kester, a technician with the Banning Police Department.

The idea of installing the cameras came up about two years ago when a 13-year-old girl was raped during daylight hours on a playground set at Roosevelt Williams Park.

Severe budget cuts also played a role, with the department downsizing from 41 officers to 27.

"Burglaries on the rise, thefts on the rise, we wanted to do our part and think outside the box," Purvis said.

Still, some critics don't like the idea of police recording the public 24 hours a day.

"I don't appreciate someone looking over me all the time. I think it goes against what this country stands for," said Matt Buckmaster, who works in Banning.

A former USC professor on the FBI's 10 Most Wanted fugitives list for alleged child-sex crimes has been arrested in the resort city of Playa del Carmen in Mexico, authorities said Tuesday - just a day after he was added to the list.

Walter Lee Williams, 65, is wanted on charges of sexual exploitation of children and traveling abroad for the purpose of engaging in sexual acts with children. Prosecutor Gaspar Armando Garcia Torres told the Associated Press that Williams was captured late Tuesday while drinking coffee near a park in the Caribbean beach town.

FBI officials confirmed the arrest Tuesday night.

Williams was added to the FBI's Ten Most Wanted Fugitives list Monday after being indicted on charges of producing child pornography and engaging in sexual acts with minors.

Walter Lee Williams, 64, was the 500th person added to the list since its creation in 1950, the agency announced.

Williams is accused of traveling from Los Angeles to the Philippines in January 2011 to engage in sex acts with two 14-year-old boys and taking sexually explicit pictures of one of them. He allegedly met the two boys online in 2010 and had Internet webcam sessions with them.

Williams was a tenured professor of anthropology, history and gender studies at USC. According to a profile that has since been removed from the USC website, Williams was a founding editor of the International Gay & Lesbian Review and also taught at the University of California, Los Angeles, in the 1980s.

The FBI said Williams preyed upon boys between ages 14 and 17, many of whom live in economically underdeveloped countries.

"Because of his status, he has the means and access to children, and that's what makes him dangerous," said FBI Special Agent Jeff Yesensky in a video released by the agency. "He preys on the most vulnerable children."

Williams was charged in Los Angeles on April 30 with one count of producing child pornography, one count of traveling for the purpose of engaging in illicit sexual conduct with a minor and two counts of engaging in illicit sexual conduct in foreign places.

The FBI is offering a reward of up to $100,000 for information leading directly to Williams' arrest.

He is a former Palm Springs resident who has an extensive history of travel through Southeast Asia -- specifically the Philippines -- and may travel to Mexico and Peru, the FBI said. He is also affiliated with the Buddhist Universal Association in Los Angeles.

Carrollton police have arrested a 20-year-old suspected of driving while intoxicated after police say he slammed a pick-up truck through the front of a house.

The incident occurred in the 2200 block of East Peters Colony Drive in Carrollton around 12:30 a.m. Wednesday.

Police arrested 20-year-old John White for allegedly driving while intoxicated. White may face additional charges.

Police said the truck clipped the family's minivan and smashed into a car parked in the street. The truck hit the car hard enough to move the car several feet into the yard. Officers said the truck then crossed the yard and slammed into the home.

The front of the truck ended up in the girls' bedroom. Luckily, both of the family's two daughters had been in the living room with their parents watching a movie.

"Thank God they were in the family room watching a movie with their parents when this happened, or this could have been tragic," said neighbor Brad Rogers, who heard the crash and rushed to help. "It was scary. Once I got 911 going, I made sure everyone was OK. Luckily no one was hurt."

The family and the pick-up driver escaped without injuries.

Rogers said this is the second recent incident where a vehicle has crashed into a house on that street. He said neighbors plan to ask the city to install speed bumps.

UTA Threat Cleared; Campus Reopened

The campus at the University of Texas at Arlington was closed and classes were canceled Wednesday morning due to reports of an armed man headed toward the school.

An alert sent on the MavAlert Emergency Notifications page on the UTA web site stated the campus was reopened around 9:29 a.m. and scheduled events, including classes, would resume at noon.

Additionally, the school has asked for all employees to report to campus as soon as possible.

UTA spokeswoman Kristin Sullivan said police are investigating the unconfirmed threat and there was no active incident on campus Wednesday.

Sullivan said a woman called UTA police to say a man with a gun was traveling to the school, though no such person has been spotted on campus.  

"UT Arlington takes these kind of threats very seriously which is why we closed the campus this morning and canceled classes until further notification," Sullivan said.

A UTA emergency alert shortly before 4:30 a.m. Wednesday indicated the campus was closed. Classes and other events were canceled as well.

"UT Arlington police are working with Dallas police to try to locate the suspect," Sullivan said. "They believe he is off campus."

"There is no imminent threat, however, as a precaution, we're going to make sure the campus is absolutely secure and safe. That's the most important thing," Sullivan said.

Campus police were not allowing anyone into UTA buildings on campus due to the alert, according to NBC 5's Keaton Fox.

At 7:30 a.m., a message posted to the MavAlert Emergency Notifications page on the UTA web site stated the following:

"The UT Arlington campus is closed, and classes, events and summer camps are canceled until further notice as police continue to investigate a report of a man traveling to campus with a gun. Anyone on campus should remain inside. No one should travel to campus."

Sullivan said several thousand people typically would be on campus for summer classes, camps and other activities. UTA's spring enrollment was nearly 34,000 students.

Early Confusion on Threat Details

The alert began as text posted to the school's web site at 4:28 a.m., which stated the following:

"Unconfirmed report Dallas PD informed UTA PD subj. w/ gun may be en-route to UTA campus. If on campus stay indoors/ off campus stay away until further notice."

UTA police said that Dallas police located the individual they believed was possibly headed to the campus. UTA police said that individual was inside an apartment in Dallas but was refusing to come out.

NBC 5 contacted the Dallas Police Department to confirm this information, but dispatch officers said they were unaware of any barricaded subject.

Previously, the university told NBC 5 they planned to release an "all clear" alert. However, an update at 6:17 a.m. stated the following:

"Police continue to investigate unconfirmed reports of a man suspected of traveling to campus with a gun. Stay away from campus or remain indoors until further notified."

NBC 5 has crews on the scene to gather more information. As this is a developing story, details may change as we uncover more information.
