Dallas police are investigating two big jewelry holdups in hotel parking lots in broad daylight.

The latest armed robbery happened at about 3:30 p.m. Wednesday at the Hilton Anatole on Stemmons Freeway at Market Center. The thieves took $700,000 in gems, a computer and a cellphone from the victim, who worked for German company Wild & Petsch GmbH, according to a police report.

According to its website, the firm cuts and finishes fine gemstones for jewelers and goldsmiths.

The first robbery occurred at about 8 a.m. on Nov. 28 at the Hampton Inn on Composite Drive, just off the Stemmons Freeway at Walnut Hill Lane. Thieves stole about $55,000 in jewelry mountings, along with various personal items from the victim, who is from Hong Kong.

The Anatole is directly across the Stemmons Freeway from the Dallas Market Center.

DMC spokeswoman Margaret Hite said the center includes international jewelry wholesalers but that security determined that the Anatole victim was not a DMC visitor.

Danny Defenbaugh, a retired Dallas FBI special agent in charge, said the FBI typically participates in investigations that involve international or interstate commerce, at least by sharing intelligence information with local police.

Defenbaugh said large jewelry robberies often involve out-of-town thieves who have information about the victim.

"Particularly, there's gangs from South America who actually pick out and target the individual and will follow them a great distance until they see their opportunity, actually the higher percentage of which is in parking lots," he said.

Defenbaugh now works as a private investigator but also provide security advice to companies that deal in international commerce.

"There's certain things you can do to make someone look at you and realize, 'Here's an easy target," he said.

It is not clear if both of the Dallas robberies are related, but Defenbaugh said international jewel thieves may chose to travel when they know more than one target will be in a location.

"Many times, you're going to have a certain type of gang activity -- again, where their intelligence is almost as good as law enforcement's -- many times to where they're going to realize certain shipments are going to be coming in at a certain time. Then they're going to be aware of what to look for in a target," he said.

Dallas police declined comment on the cases Thursday.

Messages left at both hotels were not returned.

A telephone number listed online for a U.S. representative of the German gemstone company was disconnected.

Man With Gun Shot by Dallas Police

Dallas police said a man with a gun walking down Castlefield Drive Thursday afternoon didn't comply with orders to drop his weapon and instead raised the gun at officers, so they were forced to shoot the man.

Dallas police officers fatally shot a man who was walking with a shotgun in East Dallas near Pleasant Grove on Thursday afternoon.

Police said a witness told responding officers that a man was walking in the 9500 block of Castlefield Drive with a weapon at about 3:40 p.m. Sgt. Warren Mitchell said the man was carrying a shotgun.

The officers saw Robert Williams, 37, and told him to drop the shotgun. The officers opened fire when the man continued to walk toward them while raising the weapon, police said.

Williams was taken to a Dallas hospital, where he later died.

No police officers were injured.

Roughly two dozen officers were in the area shortly after the shooting, and a home was cordoned off with police tape. Some clothes, including a jacket and shoes, were in the street.

Neighbors told NBC 5 that they heard gunshots and saw a man walking down the street with what appeared to be a long gun such as a rifle or shotgun.

NBC 5's Omar Villafranca contributed to this report.

Dallas police have released surveillance footage of thieves stealing expensive, heavy planters off a front porch in Preston Hollow.

Last week, Highland Park police reported several strange thefts -- large planters costing hundreds of dollars each stolen from at least three homes.

Dallas police said Thursday that the bizarre crime spree appears to have continued in Preston Hollow, where three homes were hit overnight.

One of the thefts was caught on surveillance cameras at Erin and Andrew Hillman's house.

"I heard some noises out in the front," Erin Hillman said. "I thought maybe it was a squirrel. Then I heard the noise more, and I see some men with their car pulled up into my front, and they are loading something."

The Hillmans turned the video over to Dallas police. It shows three men get out of a vehicle, load the heavy planters into the back of a white sport utility vehicle and take off.

The couple said the stolen antique cast iron urns with spiral trees were worth $5,000.

"I hope they find these guys and keep them from stealing people's plants and invading their house," Andrew Hillman said.

"I feel violated," Erin Hillman said. "I know it's only plants this time, but it makes me uncomfortable."

According to Dallas police reports, three homes in the neighborhood were hit, including one on nearby Tulip Drive.

Highland Park was hit last week, when at least six large pots stolen.

The Hillmans said they believe the thieves were driving a white Suzuki Samurai or similar vehicle. People in Highland Park also reported seeing a white SUV on the night their planters disappeared.

Supreme Court Taking Slow-Go Approach on Gay Marriage

advertisement

The U.S. Supreme Court will decide what it wants to do with a stack of cases filling its in-box on the subject of same-sex marriage as soon as Friday. Just don't expect a final up-or-down vote on the issue anytime soon.

The Supreme Court is in the process of deciding what cases it will rule on in the next year. Ten same-sex marriage cases are possibilities, including a challenge to California's ban on gay marriage and a number of disputes over the federal Defense of Marriage Act.

The issue has become politically and socially fraught, and the court doesn't appear to be taking this decision lightly. It has deferred its announcement in recent days, but it can't put it off much longer, experts said.

"It's hard to look the other way," University of Chicago law professor Geoffrey Stone said.

The cases land in front of the Supreme Court as Americans seem to be growing slowly more accepting of same-sex marriage. A variety of public opinion polls taken over the last decade illustrate that shift.

During that time, the number of states where gay marriage is legal has grown to nine (in addition to the District of Columbia), the most recent burst coming on Election Day this year, when voters in Maine, Maryland and Washington endorsed it. Five more states allow civil unions, a legal step short of marriage. Three states -- including California -- permit domestic partnerships. The rest of the country bans gay marriage.

In May, President Barack Obama said his feelings on the issue had evolved to the point that he was comfortable with same-sex marriage.

Maryland and Washington began issuing marriage licenses on Thursday.

"That these issues exist at all is because public attitudes about homosexuality have changed dramatically," said Stone, a constitutional scholar and author. "Attitudes have evolved about the meaning of equality over time, just as they did with separate but equal (the invalidated legal doctrine that justified racial segregation) and with women."

The court has a range of choices, from sidestepping the issue entirely by choosing not to hear any of the cases to tackling the heart of the issue: whether same-sex marriage should be legal under the constitution.

But legal experts expect the court to land somewhere in the middle. The Supreme Court typically does not run ahead of changes in social norms, legal experts say. That is why it is expected to take up the issue in a way that avoids making too broad an impact.

The court could announce which gay marriage cases -- if any -- it will hear during the upcoming term on Friday.

There are two types of cases that the high court is considering. Most are related to the 1996 Defense of Marriage Act, a federal law that defined marriage as between a man and a woman. That legislation prohibits same-sex couples in states that have legalized gay marriage from an array of federal benefits, including tax deductions, Social Security survivor benefits and federal employee health insurance.

Across the country, challenges have arisen from people who have been denied assistance that they would have had access to if they were in a heterosexual union. They charge that the exclusion violates their constitutional rights of equal protection, and several lower courts have ruled in their favor.

Under President Obama, the Justice Department has stopped defending DOMA in court, and the Republican-led House of Representatives has taken up the fight.

The Supreme Court is widely expected to take up at least one of those cases, because it rarely passes on considering decisions that have overturned federal law.

California's Proposition 8 is another situation. That measure, banning same-sex marriages, was passed by voters in 2008 in response to a state Supreme Court ruling that legalized gay marriage. A federal judge struck down Proposition 8, saying it violated the constitution's Equal Protection Clause. The 9th U.S. Circuit Court of Appeals upheld that decision, but under narrower grounds, saying the state could not take from gay couples a right that they had already been granted.

Stone believes the high court will take up at least one case and rule in a way that strikes down DOMA and/or Proposition 8 without addressing the broader legality of same-sex marriage itself.

"This is an inflammatory issue, and a way of dipping one's toe in the water," Stone said.

He and many other Supreme Court observers see a split decision, with Justice Anthony Kennedy casting a swing fifth vote in favor of same-sex couples.

Under that scenario, the much larger issue -- whether it is discriminatory to bar gays and lesbians from getting married -- will be put off, most likely to a different Supreme Court.

Lisa Soronen, executive director of the State & Local Legal Center, which represents state and local governments in Washington, predicted that the Supreme Court would pass on Proposition 8, allowing the lower court's ruling to stand. If that happens, gay marriage would become legal in California almost immediately.

But the DOMA battle is too important to ignore, she added.

If the court does not take up any DOMA cases, then the stack of challenges will continue to grow, and rulings from lower courts will create a "weird" situation where federal law applies in some places and not in others, Soronen said.

She sees those cases through the prism of state's rights: historically, the federal government has butted out of family law matters.

"This isn't a thumbs up or thumbs down on same sex marriage; it's about the federal government limiting who can get married," Soronen said.

That narrow sort of view will likely guide the Supreme Court, she said.

WATCH: David Axelrod Slashes the 'Stache

advertisement

David Axelrod has lost his signature mustache — for a good cause.

President Barack Obama's senior strategist had his trademark feature shaved off on MSNBC's "Morning Joe" on Friday, in an appearance also broadcast on the "Today" show.

But while Axelrod is now a few whiskers poorer, the epilepsy research non-profit his wife runs is now more than $1 million richer.

"How are we feeling, David?" Joe Scarborough, host of "Morning Joe," asked him on the set of the political talk show.

"Faint," Axelrod said from his seat in a barber's chair, with his wife Susan by his side. "I was up all night, to be honest with you," he added.

After 40 years with his trademark 'stache, Axelrod had promised to shave it off if Susan Axelrod's organization Citizens United for Research in Epilepsy — a condition the couple's oldest child suffers from — could raise more than $1 million.

By Friday morning, the group had raised $1,049,797, according to the campaign's website.

Initially, Axelrod had made a bet with Scarborough over his facial hair concerning the presidential election, not epilepsy, promising to shave it off if Obama lost three key states. Scarborough was supposed to grow a mustache if he lost.

Axelrod won that bet, but public interest in the possibility of his bare face had already been piqued. Scarborough skirted his end of the bet, and the threat of having to grow a mustache, by offering to donate $10,000 to epilepsy research if Axelrod shaved his anyway.

The epilepsy fundraising drive reflected that interest. Donald Trump donated $100,000, while Obama, Carole King and 25,885 others also donated, according to Axelrod and his website.

Trump, for one, said he felt his money was well spent and complimented Axelrod's new look, saying that it reminded him of his own father's.

"I think he looks great," Trump said in a phone call into "Morning Joe."

A Southern California millionaire has made his request to Santa loud and clear, and very public.

Marc Paskin, 62, purchased a billboard in the San Diego neighborhood of Barrio Logan that declares, "All I Want for Christmas is a Latina Girlfriend."

The outdoor ad also shows a picture of Paskin's smiling face next to a photo of a wishlist, accompanied by his email address.

Paskin, a La Jolla real estate investor, was featured on an episode of "Secret Millionaire" last year when he spent a week living on less than $50 a day.

According to "Secret Millionaire," Paskin has donated $125,000 to Detroit families in need in last year's episode.

He's also given more than $1 million to the UC San Diego Shiley Eye Center, which helps patients regain their sight.

Paskin lost his wife to diabetes and since then has felt compelled to help others in need, according to UCSD.

Failure to Follow Procedures Led to Inmate Escape: Sheriff

Dallas County Sheriff Lupe Valdez said Tuesday a failure to follow procedures led to an inmate's escape from Parkland Hospital.

Escapee Caught After Stealing Deputy's Gun

A capital murder suspect who stole a deputy's duty weapon and escaped from a Dallas hospital Tuesday night is back in custody.

More Photos and Videos

A failure to follow procedures led to the escape by a capital murder suspect who fled a Dallas hospital with a deputy's duty weapon, the county sheriff says.

Franklin B. Davis, 30, escaped from Parkland Hospital on Tuesday night, the Dallas County Sheriff's Office said. He was taken into custody later that night after a brief standoff.

On Wednesday, Sheriff Lupe Valdez said a failure to follow procedures, not an issue of manpower, let to Davis' escape.

"Standard procedure requires for all inmates to be escorted at all times while on medical visits to Parkland," she said. "Procedures were not totally followed; an error was made."

According to court records obtained by the Dallas Morning News, Davis asked his lone guard if he could take a shower. The guard then took off Davis' handcuffs and leg shackles.

Davis, who had been at Parkland since Saturday, then confronted the deputy with a sharp object and managed to wrestle away the deputy's gun after a two-minute struggle, the newspaper reported.

Valdez said it would not have mattered how many guards were watching Davis because policies were not followed.

The deputy was not injured but is struggling with what happened, she said.

Valdez said the heart of the problem is that prisoners must be taken to Parkland for treatment. There are about 4,200 transports between Lew Sterrett Justice Center and Parkland Hospital per year, she said.

She said a $40 million medical facility being built inside the jail should eliminate future incidents.

"It is incidents like this that confirm our need for a facility within the department," she said. "As you all know, we are working on that, and we are building a facility right here in the department so that we don't have to do the 20 to 25 visits back and forth per day."

Valdez said the incident is under investigation. The deputy is still at work.

Davis apprehended after brief standoff

Dallas police and Dallas County deputies searched the neighborhoods near the hospital for Davis and located him near Harry Hines Boulevard and Reagan Street.

Davis then barricaded himself inside a van in the parking lot of the old Telemundo building. Davis surrendered to police at about 10:45 p.m. after a standoff of a little longer than one hour.

No one was injured, and no shots were fired.

The standoff ended so quickly because police realized that Davis was not armed ,the sheriff's office said.

Authorities had recovered the gun, so officers went in to arrest him. Davis dropped the gun he took from the deputy at the hospital somewhere along Wycliff Avenue while fleeing.

Davis charged in slaying of 16-year-old high school student

He is charged in the September slaying of a 16-year-old Carrollton girl that he was accused of sexually assaulting.

Police said they believe Shania Gray was killed to prevent her from testifying against Davis, who was charged with four counts of sexual assault.

Carrollton police have said that Davis confessed to killing Gray.

According to an affidavit, Davis picked Gray up from school and drove her a trail head near Valley View Lane and Interstate 635, where he killed her. He told investigators that he posed as someone else and won the girl's trust with a fake social media profile and a prepaid phone.

NBC 5's Stefan Gorman, Ray Villeda and Scott Gordon contributed to this report.

The owner of a Hurst dry cleaning business who was arrested in October had fraudulent CIA credentials, various weapons and camouflage items, including raid gear, according to a federal search warrant obtained by NBC 5.

Until his Oct. 2 arrest, Azeez Al-Ghaziani, 30, owned a dry cleaner in the 700 block of State Highway 26.

Someone called Hurst police to report a damaged pickup parked behind his business.

When officers arrived, they saw what appeared to be fraudulent military identification cards inside the vehicle, police said at the time. They also found several guns and ammunition.

Police called in federal agents, and Al-Ghaziani's vehicle and business were searched later that day. He was arrested on a charge of tampering with a government document.

An agent with the Naval Criminal Investigative Service offered new details about the case in an application for a search warrant of Al-Ghaziani's computer, which is now in FBI custody.

The warrant was approved by a judge and executed last month.

According to the warrant, authorities found a number of suspicious items in Al-Ghaziani's pickup and business, including:

  • Fraudulent CIA credentials
  • Department of Defense military credentials
  • Assorted digital camouflage items
  • Body armor carrier
  • Raid jacket with duty belt
  • Half-gram of white powder which tested positive for methamphetamine

Al-Ghaziani's attorney, J. Warren St. John, declined to discuss why his client would have such things but did dispute the agent's information.

"The majority of the allegations aren't true," St. John said.

The NCIS agent noted in the court document that he is assigned to the FBI's Joint Terrorism Task Force, but there are no allegations Al-Ghaziani was involved in any terrorist plot.

Al-Ghaziani, a one-time soldier in the U.S. Army, is from Fort Worth, his attorney said.

A Fort Worth burglary victim has posted a neon green sign in his front lawn warning criminals he is armed and tired of break-ins.

Thieves broke into Amer Ozzie's home in the Riverside/Carter neighborhood on Friday and stole musical equipment, a TV, tablets and a video game console.

"Since I put the sign up, other neighbors have been coming up to me and saying, 'I've been robbed. I'm glad you're doing this,'" he said. "Other neighbors say they're going to put the signs up, too."

Ozzie, a Prince impersonator, said he is lucky that the thieves didn't steal any of his expansive Prince memorabilia or the two custom Prince guitars he uses for performances. But the bad guys took two amplifiers, forcing him to cancel a booking he had for this weekend, he said.

While NBC 5 was out shooting the story, two residents pulled over to say that they, too, had been burglarized. They didn't want to be identified, but one man said bank deposits for his small business were stolen from his car and a woman said tools were stolen out of her garage.

Ozzie, who grew up in the neighborhood, said he wants Fort Worth police to patrol the area during the day, when burglaries are happening.

Dallas police are asking for help in finding a couple who drove their pickup truck into the Texas Rangers store in Uptown.

Store surveillance footage shows the truck smash through the glass storefront on McKinney Avenue early Saturday morning.

"I'm pretty horrified that anyone would do that," customer Nela Moore said. "This really is Dallas' team right now."

Surveillance cameras caught the truck smashing through the front of the store at 2:30 a.m. The footage shows a man and a woman spend about 30 seconds ransacking the store, stealing T-shirts and other Rangers paraphernalia.

"That's too bad," customer Karen Moore said. "It makes the cost go up for everybody."

The store manager doesn't think the thieves had ever been in the store before because they went straight for the clearance rack with last season's playoff gear instead of high-priced jerseys.

According to the police report, the couple got away with a "large amount of merchandise."

Detectives said they believe the thieves drove a white Ford Dually pickup. Anyone with information is asked to call Crime Stoppers.

A New Jersey teen started a campaign hoping to change the way toy company, Hasbro, markets Easy-Bake Ovens.

McKenna Pope, 13, has a younger brother who enjoys cooking and wants an Easy-Bake Oven for Christmas.

Pope searched for the toy and found that none were marketed toward boys. She only found marketing materials that featured girls using pink or purple-colored Easy-Bake Ovens.

Pope wants her little brother to know that cooking isn't only for girls.

The eighth grader started a campaign on Change.org, hoping Hasbro will acknowledge the bias and create gender-neutral Easy-Bake Ovens.

The petition is addressed to the CEO of Hasbro and senior executives.

The Dallas-Fort Worth International Airport Board will vote Thursday on a new $100 million development project that includes a hotel, postal center and retail complex.

The plan shows a potential 32-acre project, known as, Southgate Plaza, that would be built near the south entrance to DFW Airport, near the rental car facility.

The first phase would account for 17 acres, or more than half of that.

If approved, the project would result in a new 137-room Hyatt Place Hotel, a headquarters building to consolidate airport staff into one campus, a parking garage for 430 employees and a new United States Postal Service facility.

The estimated price tag for the first phase of the project is $92.1 million.

A Garland High School student will face a judge Thursday morning for bringing a loaded gun to school.

Carlos Rodriguez, 17, is facing a felony charge for having a prohibited weapon in a weapons-free zone.

Police said Rodriguez brought a loaded gun to school on Wednesday.

School leaders received a tip that Rodriguez might have brought a gun on campus. School authorities tracked him down and said they found a loaded pistol in his backpack.

The school resource officer arrested him and took Rodriguez to the Garland Detention Center. The teen spent the night there.

Staff at the detention center tell NBC 5 that Rodriguez is scheduled for an arraignment hearing between 10 a.m. and noon on Thursday.

The judge will set a bond for the teen.

Police haven't said why the teen may have brought the loaded gun to school or what he intended to do with it.

School leaders sent a letter to Garland High School parents and students on Thursday about the firearm possession.

Garland High School has increased security on campus since the gun was discovered.

The school district states that it frequently does weapons searched and will continue to monitor schools if any security changes need to be made.

A capital murder suspect who stole a deputy's duty weapon and escaped from a Dallas hospital Tuesday night is back in custody.

Franklin B. Davis, 30, escaped during a Parkland Hospital visit, the Dallas County Sheriff's Office said.

The deputy was not injured.

Davis dropped the gun he took from the deputy at the hospital somewhere along Wycliff Avenue while fleeing. Authorities recovered the gun and knew he wasn't armed, so officers went in to arrest him.

Davis had left Parkland in hospital-issued pants and was not wearing a shirt, the sheriff's office said.

NBC 5's Stefan Gorman contributed to this report.

Early Flu Outbreak Brings Concerns for Children

Flu Season Is Already Here

Most counties in North Texas are seeing an increase in the number of flu cases.

Doctors Seeing Early Start to Flu

Doctors are seeing an early start to the flu season, with some patients presenting symptoms even after they've had a flu shot.

More Photos and Videos

Pediatricians say they are alarmed by the number of flu cases they are seeing in children.

Flu season has arrived surprisingly early in North Texas, and it's shaping up to be a bad one.

"I've seen four confirmed cases today and saw three more last night working in the evening," Dr. Christopher Dreilling, of Pediatric Associates of Dallas, said Tuesday.

According to the U.S. Centers for Disease Control and Prevention, people are getting the flu more than a month earlier than usual -- and the primary strain circulating tends to make people sicker than normal.

"It's horrible," Tara Rowell said. "The first day that we got it, we thought we were dying and didn't want to get out of bed."

She and her husband are still recovering from their dual bout with the flu.

But children are among doctors' biggest worries this flu season.

"We're seeing kids of all ages and teenagers getting sick," Dreilling said. "Interestingly, the flu hits young adults and teens the hardest -- the sickest kids I've seen are 13 and 14 year olds."

But there is some good news. Drelling said that the strains of the flu that are circulating seem to be a good match for the flu vaccine.

"I think if I had known, I would have gotten a flu shot earlier," Rowell said.

The CDC is encouraging people to get vaccinated now before the rates of infection rise further.

Frisco Woman Robbed at Gunpoint in Her Garage

A Frisco woman says she is thankful to be alive after a man put a gun to her head and stole her purse Friday.

The woman, who did not want to be identified, said the robbery happened in front of her daughter as they pulled into their apartment garage after grocery shopping.

On the 911 call, the woman tells the dispatcher what happened.

"I was just robbed at gunpoint," the victim told the operator when she called 911. "My daughter was standing outside, and the guy came up to me, and I was talking on the phone, and he put a gun to my head and said, 'Give me your purse now.'"

In the 911 call, the woman said the man tried to cover her eyes.

"He put his hands over my eyes and he goes, 'Give me your, give me your purse now.' And I went, 'What?'" she said. "And I turned to him, and he let his hands down, and I saw him perfectly."

The woman told NBC 5 she is a teacher and that pays attention to detail. Her description of the suspect helped police catch the man a few hundred yards away in a field.

"Blond hair, short blond hair, black jogging suit, black cap on -- I think he had a black gun -- short kind of a Magnum kind of thingamajigs, not an old-fashioned one -- like a semi-automatic or something," she said during the 911 call. "He was good-looking, young. I say he's maybe in his early 20s."

A few minutes later, she can be heard saying a prayer on the phone.

"Thank you, Jesus, that he didn't shoot me," she whispered. "That would have been it. Thank you, Jesus. Thank you, Jesus."

Police arrested 28-year-old Dallas Fisher in a nearby field. He faces one count of aggravated robbery with a deadly weapon.

The woman told NBC 5 that she is praying that Fisher sees the error of his ways.

Socialism, Capitalism Most Searched Words of 2012

advertisement

Merriam-Webster's most looked-up words of 2012 are socialism and capitalism.

Traffic for the two words on Merriam-Webster's website doubled this year as the health care debate reached a fever pitch and discussion over "American capitalism" and "European socialism" intensified, Merriam-Webster's editor-at-large Peter Sokolowski told The Associated Press.

"They're words that sort of encapsulate the zeitgeist. They're words that are in the national conversation," Sokolowski told the AP. "The thing about an election year is it generates a huge amount of very specific interest."

Last year's top word was austerity, and before that it was pragmatic

Politically-charged runner ups that made Merriam-Webster's top ten this year include democracy, globalization, marriage and bigot.

Malarkey can credit its popularity to Vice President Joe Biden, who famously used the word during his vice presidential debate with Paul Ryan in October.

Look-ups of malarkey spiked 3,000 percent in a single 24-hour period this year, making it the largest increase of a single word by percentage, the AP reported.

Another popular word inspired by politics — as well as weather — is bluster, which topped Dictionary.com's word searches in 2012. It means, according to the site, 1) to roar and be tumultuous or 2) to to be loud, noisy or swaggering.

The word was chosen based on information gathered from the site, and according to head of content Jay Schwartz, the data reveals what people were thinking about in 2012.

"People don't just use online dictionaries to know how to spell something or what a difficult word means," Schwartz told The Huffington Post.

"People often look at definitions to satisfy curiosity, or to reassure themselves. There's something in re-learning the meaning of a word that has a value beyond simply satisfying the intellect. Being able to name something that has affected you positively or negatively is very powerful."

Other common weather-related word searches on Dictionary.com were hurricane, harbinger, ecosystem and climate.

Dallas police are investigating a deadly crash that caused a car to go airborne, stopping just short of Turtle Creek Tuesday morning.

The wreck happened in Uptown Dallas at about 1 a.m.

According to police, the car ran off the road on Turtle Creek Boulevard near Blackburn Street and hit several trees.  The driver, Galen Weston Swank, 31, was killed.

Police believe speed contributed to the crash.

Witnesses tell police the driver had been going too fast around a curve, lost control, and plowed through a fence. Swank's Mercedes got caught up in the trees right at the water's edge.

Rescue crews found Swank dead inside of the car.

Witnesses said right before the wreck, Swank peeled out from Blackburn Street heading north on Turtle Creek Boulevard.

Records show he was just seven blocks from home.

Authorities are investigating the crash.

High school students are leading an effort to send treats to troops overseas.

Texas Trust Credit Union's Youth Advisory Council is collecting donations and sending more than 340 boxes to soldiers in Afghanistan.

Sophomore Angel Reyes said the requests include simple items such as Band-Aids and energy drinks.

"People take the little things for granted and, once you go over there, you don't have that much stuff," he said.

Sgt. First Class Myrick Lewis, who has been in the Army for 10 years, said he really appreciated random acts of kindness while deployed in Iraq during Christmas.

"It definitely means a lot -- especially for single soldiers, because most of them don't have a wife or kids or anything to get anything from," he said.

Junior Tiffany Lopez said it's nice to know they can do something to make service members feel loved during the Christmas season.

"It gives me a good feeling inside knowing that we're helping them, you know?" she said. "When they're away from their families, they don't really have a lot of things like we do here, and so we feel that if we give back to them, it's going to help them a lot."

Donations will be accepted at Texas Trust locations through Saturday.

Accusations of Bullying in 13-Year-Old's Death

advertisement

More than 100 angry parents and students demonstrated outside Furlough Middle School in Terrell on Monday over a death they blame on bullying.

Zusette Moreno died in the hospital Friday on her 13th birthday after telling relatives she was assaulted in a school restroom Tuesday.

"One of the girls backed up on her neck and pushed her back up into the wall, basically. And another girl kicked her in the stomach with her foot," said the girl's aunt, Lupita Primero.

Primero said the girl attended the school for about a month after moving to Terrell with her mother to be closer to other family members there.

The aunt said another bullying incident happened to Moreno with the same girls before Thanksgiving, but that Zusette did not want her mother to report it to the school.

"She said 'No, I can't handle that, Mom.' She said, 'I can't mention that,'" Primero said.

Some parents at the protest said their daughter were also bullied but that the school did not take action when they complained.

"My daughter was one," Carla McLenee said. "She's been bullied by these people, and I'm here to stand behind the parents that lost their little girl Friday morning."

"It needs to stop," Hope Beech said. "A parent shouldn't have to worry if their kids are going to be safe or not at school."

Terrell Independent School District police investigated the girl's death, and Superintendent Kelly Rodgers said preliminary autopsy results from the Dallas County Medical Examiner indicate that there was no assault on Moreno.

"Our police officers looked into every rumor allegation, and there's nothing indicating that anything traumatic happened to the student physically at the school," he said.

Rodgers said grief counselors have been at the school since Friday and will remain there as students and staff cope with the death.

"She was a very, very likable student -- well-liked by the staff and students here -- and that's the way we want to remember her," Rodgers said.

The superintendent said a separate investigation is under way about the accusations of past bullying against Moreno.

"I think our officers receive that complaint from the parent Saturday, and they're investigating bullying," Rodgers said.

The demonstrators are demanding answers and changes from the school.

"They need more guards at the bathrooms," McLenee said. "They need more teachers to hire. Funding doesn't allow it, so we lose our children because of it. It's not fair."

Two Mexican Nationals Charged in Death of Coast Guard Officer

Coast Guard Officer Killed in Collision at Sea

A suspected "panga" boat collided with a Coast Guard vessel, killing a Coast Guard officer who lived in Redondo Beach. John Cadiz Klemack reports for the NBC4 News at 9pm on Sunday, December 2, 2012

More Photos and Videos

Federal prosecutors charged two Mexican nationals in the death of a 14-year Coast Guard veteran, who was killed Sunday after his vessel was slammed by a suspicious fishing boat, sending him overboard.

A criminal complaint filed Monday charged Jose Meija-Leyva and Manuel Beltran-Higuera with killing Chief Petty Officer Terrell, Horne III while he was engaged in official duties, according to the U.S. Attorney's office in Los Angeles.

Horne was one of four members sent in a small inflatable Coast Guard boat to investigate a suspicious vessel—a 30-foot long open-bowed fishing boat or "panga"—passing through Smuggler's Cove near Santa Cruz Island, Calif. at about 1:20 a.m. Dec. 2.

The panga sped toward the small Coast Guard vessel after it activated the its police lights, the U.S. Attorney's office said. Despite firing warning shots, the panga continued to speed toward the small vessel, eventually striking it and sending two officers, including Horne, overboard.

Horne was struck by a propeller and was later pronounced dead after sustaining a traumatic head injury.

The Coast Guard still managed to stop the fleeing panga 20 miles north of the initial incident, detain the two suspects and seize drugs found onboard, according to the U.S. Attorney's office. Details about the kind or quantity of drugs on board were not available.

Homeland Security Secretary Janet Napolitano said in a statement Monday that the "tragedy reminds us of the dangers our men and women in uniform face every day, and the great risks they willingly take, as they protect our nation." She added that "our thoughts and prayers are with the family of BMC Horne and all of our Coast Guard personnel at this difficult time."

Three Coast Guard members who served with Horne described him Monday as a mentor who remained calm during stressful situations. Casey Curry, of Coast Guard Station Long Beach, met Horne in 2001 when they were stationed in South Carolina.

"My first impression of him was that this is one squared-away Third Class," said Curry. "His true sense of leadership echoed throughout the station. He was that type of guy who would give you the shirt off his back. Everyone just remembers how loyal, level-headed, and what a friend he was."

Horne (pictured, above, with son) joined the Coast Guard at age 18, Curry said.

Another Guardsman talked about the time the Halibut encountered a group of kayakers who were blown off-shore by an unexpected storm. The kayakers were cold and exhausted, but Horne guided the crew as they pulled the kayakers from the water, then retrieved blankets and hot chocolate for them.

Meija-Leyva and Beltran-Higuera were expected to make initial court appearances in Los Angeles Monday, according to the U.S. Attorney's office.

Doctors Seeing Early Start to Flu

Doctors are seeing an early start to the flu season, with some patients presenting symptoms even after they've had a flu shot.

More Photos and Videos

North Texas counties are showing a spike in cases that doesn't typically occur until after Christmas.

Tarrant County said it's already seeing widespread influenza activity, and Dallas County has had a dramatic spike in cases in the last 30 days.

In November, 217 confirmed flu cases were reported, up from just 24 cases in October.

Many patients with flu-like symptoms are showing up at hospital emergency rooms.

"We've probably been seeing somewhere between five, maybe five to 10 a day," said Dr. Mark Till of Texas Health Presbyterian Dallas.

Dr. Jane Sadler, of Baylor Medical Center of Garland, said she wonders if the flu vaccine covers all of the strains that are circulating. She has seen three patients in recent days who tested positive for influenza Type A even though they had a flu shot.

"I actually thought I had pneumonia, because everything was kind of in my chest and it hurt when I coughed," said Amy Bartis, one of the patients.

"I guess I was relieved that I didn't have pneumonia, but I was still shocked that I had the flu since I had a flu shot," she said.

Sadler said she was also surprised.

"Really, the flu shot this year offers great coverage for the flu," she said. "But she's not the only person that we've had with a positively test despite receiving a flu shot."

Doctors said people who have not had a flu shot need to get one immediately.

People who have a fever higher than 101.5 degrees, severe body aches and a sore throat or cough should have their symptoms quickly evaluated because antivirals such as Tamiflu work best if administered early.

NBC 5's Omar Villafranca contributed to this report.

A month after Alicia Moore disappeared on her way home from school and her body was found inside a trunk, her family is still waiting for news of an arrest.

"It's still the same -- no answers," said Moore's aunt, Jessica Byrd. "It's just getting frustrating."

The 16-year-old disappeared after getting off the bus just a block from her home.

Highway workers discovered her body several days later in a trunk along the side of the road about 40 miles away.

An employee of the Texas Department of Transportation called 911.

"I'm on (Highway) 47 north of Wills Point. And we found a body," the man said.

"You found a body?" the 911 operator asked.

"Yes, ma'am," he answered.

Investigators released video of a van that caught on camera behind the Moore's bus.

They also have questioned a man who was charged with sexually assaulting the girl earlier this year.

NBC 5 generally does not identify victims of alleged sexual assault, but Moore's identity was made public before NBC 5 learned of the allegations.

So far, nobody has been arrested in the slaying.

"I just don't want the case to go cold," Byrd said. "I just don't want anybody to put it on the back end. No, I want it up front."

Byrd is appealing for anyone with information to talk to police.

"Just come forward," she said. "I don't care how small it is, just call it in."

Police in Fort Worth are investigating a disturbing case of animal cruelty.

Using a bow and arrow, someone shot and killed a donkey on private land between Old Decatur Road and state Highway 287 in north Fort Worth.

This is the third such killing endured by the family in the last 13 months.

"'Are you kidding me?' That's exactly what went through my head," said Karen Oney, owner of the donkey.

Her family has about 15 donkeys on its land near Saginaw. A Fort Worth police officer driving by spotted one of the donkeys with two arrows in her mid-section.

"This morning at seven, she was alive and standing up," Oney said. "At 8:30, she was lying down and, by 10, she was gone," Oney said.

In Oct., 2011, someone killed two of Oney's other donkeys -- also with a bow and arrow.

Police never made any arrests in the first two cases. Now there is even more pressure to find the person seemingly using the animals for target practice.

"What pleasure do you get? We see how friendly they are -- they come right up to you -- so what kind of sport is that? I don't get it at all," Oney said.

Fort Worth police seized the arrows as evidence in the case.

Oney said she believes investigators have some leads in the case that they are not sharing.

The man accused of hitting and killing a North Texas Kindergarten teacher in a 2007 crash heads to court on Monday.

It's been five years since the horrific crash killed Leann Selkirk and her unborn child.

Selkirk's husband, Alex, wants justice for his pregnant wife's death. After five years of court delays, new judges and five prosecutors, the driver indicted for killing her, finally is going to trial.

The Anna kindergarten teacher was driving to work on April 30, 2007.

Alberto Espinosa had been driving a dump truck, when his brakes failed and the truck jack-knifed, landing on Selkirk's car, killing her. She was 18 weeks pregnant.

Selkirk was just blocks from her home that she shared with her husband. Alex Selkirk had been working outside and heard the crash.

Espinosa has been indicted for criminally negligent homicide, but there have been several delays in the case.

"Now that it's just been drawn out so long, it's just so frustrating," said her husband, Alex Selkirk.

For the past five years, Selkirk's been living without his wife, while seeing Espinosa around town continuing to live his life.

"I see him almost every day driving down the road, and that's hard to see him and know what he took from me," Selkirk said.

Espinosa's trial is set to start Monday at 1 p.m.

Selkirk is expected to be the first to testify against his wife's accused killer.

"Until this is over one way or another, I can't move past that," Selkirk said.

There's an eerie scene in McKinney. There are dozens of dead birds lining White Avenue and Central Expressway.

An NBC 5 viewer emailed pictures of the dead birds to isee@nbcdfw.com.

We contacted the Collin County Game Wardens Office. A member came out and looked at that bird. While it was bleeding from it's mouth it had not been shot and appeared to die only recently.

By our count there are close to 50 dead birds, mostly Grackles, Starlings and Pigeons.

While this is a heavily traveled area, no one seems to know how or why the birds are dying.

The Collin County Game Warden's office visited had not received any calls about the birds prior to NBC 5 contacting them this afternoon.

December 2nd Heat Sets Record

We are really feeling the December heat wave!  We started the month with temperatures well above average in the 80s.

In fact, on Saturday, we tied our record high of 83 degrees at DFW International Airport.  The previous record of 83 was set in 1950.  It was even mild late at night, with temperatures only dipping into the 60s overnight.

Sunday turned out to be another record-setting day across North Texas.  We set a new record high at DFW International Airport when the temperature reached 83 degrees Sunday afternoon.  The previous record high for Sunday was 81 set back in 2007 and 1995.  We also set a new record high minimum temperature Sunday of 67.  The previous record was 63 back in 1922 and 1993.

A cold front will arrive by Tuesday to bring us slightly cooler air.  But at this time, a big outbreak of very chilly air is not expected at least over the next seven days.

These very warm temperatures are far from average for North Texas this time of the year.  Normally, we would have afternoon highs near 60 and overnight lows near 40.  That means that temperatures are running over 20 degrees above average.  Temperatures are expected to stay above average for at least the next seven days.

One of the biggest showdowns of the bowl season will take place in North Texas at Cowboys Stadium in Arlington.

The January 4, 2013 match up locally is the AT&T Cotton Bowl at Cowboys Stadium. It will be the Oklahoma University Sooners versus the Texas A&M Aggies.

Aggie Quarterback Johnny Manziel dominated in the S.E.C. this year. The Aggies have played their share of games at Jerry World so it's a homecoming of sorts.

OU fans really wanted an at-large BCS invitation. Now they have to face an old rival fresh in the toughest conference in college football.

Both teams' fan bases run deep locally so this sets up to be the best non-BCS match up of Bowl season.

This also a recruiting dream match for both schools who heavily recruit North Texas.   This sets up to be a battle on and off the field.
