Customers' names, email addresses, dates of birth and encrypted passwords stored on the company's servers may have been accessed, a company spokesman confirmed in an email to NBCWashington.

The first news of the hacking was reported by All Things Digital.

Credit card information was not accessed or affected, according to the company. Nor was merchants' financial or banking information.

LivingSocial suggests all customers change their passwords on their accounts. The company is in the process of emailing the customers who were affected to help them reset their passwords.

They are also working with law enforcement to investigate the breach.

"The security of our customer and merchant information is our priority," said LivingSocial CEO Tim O'Shaughnessy in the email to customers. "We always strive to ensure the security of our customer information, and we are redoubling efforts to prevent any issues in the future."

Here is the email that LivingSocial is sending to affected customers:

A group of Garland firefighters is among those honoring fallen first responders in West by covering their shifts during funerals.

It's second nature for first responders to want to help, and it rings closer to home when it's a call to cover one of your own.

"Fire services are a pretty tight-knit family," Garland firefighter Levi Massicotte said. "It doesn't matter if you know somebody or not, they're still your brother or your sister. We're pretty close."

The Garland firefighters are joining a group of first responders from all over the state to man the West fire department as the community continues to bury those killed in last week's fertilizer plant explosion.

"It makes it a little closer to home," Massicotte said. "It touches you a little bit more when you know it could have been you instead, but I'm just happy to go out and help any way we can."

They are also bringing their equipment. The Garland crew is driving a stocked-up engine because a lot of West's equipment was obliterated in the blast.

"Hopefully, they realize they are not alone -- that other communities throughout the state and throughout the nation want to do anything they can and will be willing to help in any way possible," Capt. Robert Fultz said.

"Our hearts and prayers to go out to the family and friends and the community that were impacted by this tragedy," he said.

New Bridge to Ease Traffic, Spark Development

advertisement

A major part of the historic, 165-year-old Edwards Ranch in Fort Worth is about to change forever.

The changes have been in the works for decades but can finally happen after a major bridge project opened on Friday.

The Clearfork Main Street bridge connects Hulen Street and Bryant Irvin Road, making it a major arterial street in the heart of the city.

City officials cut the ribbon at a ceremony on Friday morning, and traffic was allowed over by early afternoon.

"It gives us another way to get between Bryant Irvin Road and Hulen, instead of just Vickery or I-30 right now, and you know what that's like," City Councilman and Mayor Pro Tem Zim Zimmerman .

The bridge is actually a twin set of spans that cross the Trinity River with a pedestrian bridge below.

"As you come across the Hulen bridge, this will be a major asset," Mayor Betsy Price said.

More importantly the bridge, coupled with the nearby Chisholm Trail Parkway, means development of the Clearfork section of Edwards Ranch can get started.

"This truly was the main piece that we needed to begin development, because it's really the first connection into the property," said Paxton Motheral, Cassco Development Co. vice president.

Cassco, owned by the Edwards family, plans on developing 270 acres of property, mostly south of the new toll road. The project will feature apartments, townhomes, retail and green space.

Infrastructure work on the project has been underway for the last seven years with help from the city but, in September, the first phase will begin. Construction on a 50-acre portion of the site should be completed by the end of 2014.

The project is one of many in the city's core, as development is just as important inside Loop 820 as it is outside.

"You never want a city to die from within. You never want all the development to be on the edges; you certainly want to keep your core city vibrant and strong," Price said.

"There's a lot of land yet to be developed inside the loop, and we're starting to try and focus on that before we really try to jump to the outskirts," Zimmerman said.

So while the bridge leads to very little right now, that won't always be the case.

"We want the city of Fort Worth to be proud of what's happening out here on the property," Motheral said.

The first residential phase will feature 398 units of townhomes, contemporary lofts and upscale apartments. The pedestrian bridge is set to open later this spring.

Family Wants Charges in Fatal Officer-Involved Shooting

advertisement

The family of a man who was shot and killed by Dallas police officer is asking the department to take another look at the case.

Clinton Allen, 25, was killed March 10 during a disturbance call at an apartment complex in the 3300 block of Southern Oaks Boulevard.

"I am outraged that this policeman that has no respect for human life is back on the streets of Dallas with a gun again, and you should be outraged," said Allen's mother, Collette Flannagan.

She and the group Justice Seekers Texas say the police account of the shooting does not match up with the autopsy and toxicology reports.

They said that police initially said Allen was high on drugs. The toxicology report shows that the PCP and marijuana in his system was likely smoked two or three days before the shooting, Justice Seekers Texas said.

"Everybody was under the assumption that this was one of those cases where one of these young men were on drugs and they attacked a police officer but, from the information that we have and the witnesses, that is not true. That is a lie," said the Rev. Ronald Wright, director of Justice Seekers Texas.

Police said Allen was knocking on the door of a female resident and threatening her. He also sent her numerous text messages threatening to kick in her door, investigators said.

Officer Clark Staller responded after the woman, who knew Allen through mutual friends, called 911.

Police said Staller pulled his weapon and shouted at Allen to show his hands after he saw the man jump over a fence. Staller put his gun away and pulled out his stun gun when Allen complied, but Allen grabbed Staller collar, police said.

Staller shocked Allen twice during the ensuing scuffle, but the officer said it had no effect, police said. Staller said Allen began choking him and, in fear of his life, he pulled out his gun and fired, according to Dallas police.

The autopsy report shows that Allen was shot seven times four times in the chest, once in the abdomen, once in the arm and once in the back, his family said.

"Executed like a rabid animal. Who does that to another human being?" Flannagan said. "You can't even shoot an animal seven times and not go to jail."

His family said Allen was the father of twins younger than 2 years old.

Wright said Justice Seekers Texas has new witness affidavits from people who were in the area at the time of the shooting. He said he has forwarded the affidavits and the toxicology and autopsy reports to police department's internal investigations unit.

Wright said the group's next move would be to try to schedule a meeting with the district attorney in the hopes of getting the case in front of a grand jury.

"It was a grievous murder, and it's unfortunate this family has to go through this," he said.
Dallas police said the shooting is under investigation. When the investigation is concluded, the case will be forwarded to the district attorney's office for presentation to a grand jury.

Staller, who has been with the Dallas Police Department for nearly five years, has returned to his regular duties.

Ballpark Hosts Texas' Largest Food Truck Festival

Trucks started pulling in to Arlington Friday morning for the biggest food truck festival in the state.

The Texas Food Truckin' Festival is being held Friday and Saturday.

"It's so much fun," said Barbara Tucker, owner of Aunt Sweet Tooth's food truck. "We just love events like this. We love big crowds of people and just have a blast on this truck."

Tucker and her family made the drive from Gainesville to take part in the festival.

It takes a certain kind of person to run a food truck, she said.

"It's a complete kitchen built inside of this truck, so you have to be a little bit insane to even want to do that," Tucker said.

But you only have to be hungry to attend the festival.

"The food options are great," said Decima Cooper, of the city visitor's bureau. "There are all different types of food cuisines."

Trucks from all over the state are offering up food from all over the world, each with something unique to offer.

"We have the best hamburgers ever," Tucker said. "We have something called the Holy Burger that's actually two patties of meat with all the good stuff in between."

Sean Decker of Texas Rangers Enterprises said food truck owners are "amazing chefs who don't want to make the investment in a brick-and-mortar shop, so this is a more cost-effective way to do it."

"They're churning out incredible food," Decker said. "What's unique about this is that, never in North Texas have we had this many trucks in one location."

Decker said the team would like to get to the point where the ballpark is more than just a place to catch a ballgame.

We're trying to bring folks to the ballpark for things other than baseball events," Decker said. "We want 50,000-plus for all 81 home games and the playoffs, but we want folks coming all year long."

A percentage of the proceeds from the festival will benefit the American Cancer Society.

Arlington's Massive Viridian Community Taking Shape

advertisement

Progress is being made at the massive Viridian community in North Arlington.

The new development on Collins Street is expected to add 15,000 residents, more than 3,000 houses, condos and retail on more than 2,300 acres of land in the heart of North Texas.

Viridian is expected to boast a more than $1.5 billion tax base upon completion.

It will be at least another 15 years before the development is complete, but that hasn't stopped some people from wanting to move in early.

"I'm just moving in. I'm very excited," said Laurie Stephan.

Phase one of the development - currently one of the largest mixed use residential projects in the country - is sold out. Phase two is being developed with more than 200 homes expected to be sold this year with townhomes, condos and an elementary school on the horizon.

"I don't think anyone expected the kind of success or velocity we're having this early in the process," said Robert Kimball, President of JCKPL developers, the group in charge of Viridian.

While today there's no sign of development slowing down, there was a time when folks wondered if anything would ever be built here.

For years developers said permitting and the terrain were just too complicated to work with.

"I think we've surprised some of the people who have seen this property struggle over the last 100 years - it's been a long time," said Kimball. "We've got an unprecedented location. We're close to all the employment centers in DFW."

Kimball credits an improving housing market, a public-private partnership that uses tax dollars to pay for infrastructure and location.

Kimball said home values have gone up an average of $20,000 in six months, adding thatViridian is resonating.

"It's not lot size or landscaping or architecture or street trees or the layering of all the landscaping on the parks and trails - it's all of those things combined," said Kimball.

Laurie Stephan agreed.

"It looks like it will be a community it's not just going to be a house," she said.

Dallas police arrested a woman early Friday after Texas Department of Transportation cameras show she was driving the wrong way on U.S. Highway 75.

The incident happened shortly before 4 a.m. Officers managed to pull over and arrest Tiffany Amber Summitt, 33, charging her with DWI.

Video from TxDOT traffic cameras shows a vehicle heading south in the northbound lanes of U.S. Highway 75 in the area of the High Five interchange at Interstate 635 in north Dallas.

In 2011, the most recent year for which there is data available, there were 3,088 wrong way crashes on Texas roads, according to the TxDOT. Those crashes resulted in 213 deaths.

According to a 2004 study from the Texas Transportation Institute and Texas A & M University, wrong way crashes are most likely to happen between midnight and six a.m., With the most frequent time period being from 2 - 3 a.m.

Wrong-way crashes most commonly occur in the left lane of the highway, according to the study, because the driver at fault believes they are in the right lane.  And more than half of the wrong way drivers had some influence of alcohol or drugs cited by the investigating officer, according to the study.

Up in the Air With T. Boone Pickens

advertisement

Even at 30,000 feet, T. Boone Pickens rarely stops.

Most Texans know the 84-year-old as an oilman. He is on the Forbes list every year and, according to it, is worth $1.2 billion.

On a recent day, a Gulfstream 550 with orange and black stripes awaits the billionaire, whose birthday and initials are on the jet's tail, at Dallas Love Field at 11 a.m.

He arrives by car on the tarmac and, in less than four minutes, his G-5 is wheels up. Before noon, he is 30,000 feet in the air.

Each seat has a monitor that shows the plane's location and speed.

"Yeah, we are right on 600," Pickens said from his leather chair.

The trading day is still young. Pickens dials up the trading desk at his Dallas Hedge Fund, BP Capital.

"I want to know what the market is doing anyway," he said.

Still in the skies over Dallas, Pickens is calling the shots.

"Thirteen billion? OK, so you're down now on the oil, you're down $12 this month," he said to the trader at the other end of the phone.

He watches Bloomberg TV on one of 10 TVs on the luxury jet. On another, he keeps up with news reports.

But now it is meeting time. Jay Rosser, BP Capital vice president of public affairs Pickens' chief of staff, briefs him on media coverage and the day ahead.

"See, we've been working on that New York Times story -- natural gas, heavy-duty trucks," Rosser said.

The two go over several articles and an itinerary for the day in South Carolina, today's destination.

In less than two hours, Pickens lands in Pickens County. Today, he is tracing his ancestry. Two genealogists and several other members of his BP Capital staff are on board with him.

When asked if he enjoys his busy life, Pickens said, "Yeah, I like this life. I don't find anything wrong with it."

The $50 million jet itself is key in his fast-paced life.

"Well, I couldn't do it on the airlines, but I could do it on a smaller plane," he said with a smile.

His G-550 has 18 seats, two bathrooms, four phones, two large TVs, eight smaller ones, a fridge and two full-time pilots with a combined 65 years of experience.

But it's not a cheap way to travel. Pickens said the fuel costs $7,000 per hour.

"It's worth it," he said.

Marine Colonel Dismissed in Quantico Murder-Suicide Fallout

A commander who oversaw the school that employed three Marines killed in a murder-suicide in Virginia has been relieved of his job, the Marine Corps Times reported.

Col. Kris J. Stillings will no longer lead the Officer Candidates School (OCS) at the Quantico Base, due to the deaths of Sgt. Eusebio Lopez, Cpl. Jacob Wooley and Lance Cpl. Sara Castromata.

Lopez, 25, shot and killed Wooley and Castromata in March before taking his own life in the barracks. All three were assigned to the OCS.

A general who spoke to the Marine Corps Times about Stillings' dismissal called the decision "painful" but said it came down to a matter of accountability.

City Hall in the town of West was closed Thursday so that employees could attend the memorial in Waco for the victims of last week's explosion.

A block away from City Hall, at the fire station, there were no West firefighters present, but the station was far from empty.

"It's an honor to be here and to fill in when they're under such duress, taking care of their services and just kind of regrouping after the disaster," said John Rodgers, a Waxahachie Battalion Chief.

Twelve firefighters from a three-city mutual aid group consisting of Waxahachie, Red Oak and Cedar Hill are in West answering all emergency calls while West's firefighters attend Thursday's memorial and honor five of their own.

The visiting firefighters have been here for a week.

"In our down time we've been doing normal fire station duties, checking trucks, cleaning trucks, maintaining the station," said Rodgers. "We constructed a memorial. It's a firefighter's nature to stay busy."

The memorial consists of a firefighter statue donated by the Hempstead Fire Department near Houston.  There's also a display of patches and T-shirts representing all the departments that have dropped by to lend support.

"We just wanted a place where we could display those and know the fire department here in West has everyone's support," said Rodgers.

Rodgers said his 12-member team will be replaced Friday by firefighters from Flower Mound, Little Elm and Lewisville.

MedStar Crew Saves Woman From Burning Car

advertisement

Two EMTs pulled an unconscious driver out of her overturned pickup truck moments before it exploded in west Fort Worth early Thursday morning.

Kayden Bathory and Robert Long responded to a report of a vehicle on fire following a crash along West Freeway at Chapel Creek Boulevard just after 1 a.m.

"We pulled up there, and we saw a red pickup truck just fully engulfed in flames," Bathory said.

As the first emergency crew to arrive on the scene, Bathory and Long had to act quickly to rescue the driver, a woman who was going in and out of consciousness. They used a fire extinguisher to suppress the flames while they tried to pull her to safety.

"The fire extinguisher didn't do much, so ... we actually ended up taking turns," Long said. "We'd run in and we'd grab her and we'd try to free her up, and it was a little too hot, so we'd have to back up take a break.

Each ambulance in MedStar EMS' fleet is outfitted with a fire extinguisher, similar to what anyone can purchase at a store. But beyond that, fighting fires is not typically in a paramedic's job description.

"We're not really trained on that," said Bathory, who has six years of experience as an EMT with MedStar.

You can find just about anything you'd need to save a life on-board a MedStar ambulance, with one exception - firefighting equipment.

Eventually, the pair successfully freed the victim. But they weren't out of the woods yet.

"Well, I tell you what -- after we got her pulled out, as soon as we got her to safety -- I don't know if it was the gas tank, what it was, something exploded in the vehicle, and it actually knocked us both on the ground," Long said.

Both Bathory and Long sustained flash burns -- essentially, intense sunburns from exposure to the heat. The pair immediately recovered from being thrown to the ground, stabilized the patient and transferred her to a medical helicopter that flew her to a Dallas-area burn center.

At last check, the victim was listed in critical condition.

Bathory and Long, who were back on the job Thursday evening, said they cannot help but consider what could have happened.

"If there'd have been a five, six, seven-second delay with anything, we might've been right up against that car when it exploded," Long said.

MedStar will formally recognize Bathory and Long for their actions, according to a press release.

The Fort Worth police and fire departments also responded to the crash. Fort Worth firefighters extinguished the vehicle fire.

NBC 5's Greg Janda contributed to this report.

A local rabbi is coming out of retirement to start a new business venture -- one that's catching a lot of people by surprise. Rabbi Jeffrey Kahn is getting ready to open one of D.C.'s first legal medical marijuana dispensaries, the Takoma Wellness Center, next week.

"We're very excited. It's been a long time in the making," Kahn said. "...For me, it's a chance to really do something else that's important to me, and I guess for my wife and I both, it was a mid-life change of careers."

Kahn retired from his duties as a rabbi in 2007, but is still active at local synagogues. He says he's honoring his father-in-law by opening the medical marijuana dispensary with his wife, Stephanie.

Stephanie Kahn says medical marijuana helped her father when he was suffering from multiple sclerosis in the '70s.

"When he finally tried it, it made a huge difference," she said.

In addition to three kinds of marijuana, the Takoma Wellness Center will sell vaporizers, a machine that makes marijuana butter for brownies and cookies, and books about pot politics.

Only people with HIV/AIDS, cancer, glaucoma and multiple sclerosis can get doctors' recommendations in the District. They will have to display a Department of Health-issued medical marijuana card to even be able to enter the facility.

"The people who are coming to this dispensary are people who are really sick," Kahn said.

But not all religious leaders approve of the rabbi's new venture. Some believe marijuana is immoral. Kahn disputes that charge.

"Morality is not part of the issue," Kahn said. "And what we're dealing with here is getting sick people medicine. We're talking about easing suffering."

Flames ripped through the roof of the Word of Life Church on U.S. 287. Mansfield firefighters spent hours on scene battling the blaze and putting out hot spots.

The fire destroyed the church offices, as well as a smaller side sanctuary. The pastor said the church's main sanctuary isn't damaged.

"It's crazy," said pastor Wayne Biggs. "Totally crazy. We're gonna be okay. The Lord's gonna take care of us."

There were no injuries. Witnesses say the fire spread quickly.

"It was a tornado of fire as it shot through the roof," said David Williams. "About 20 min before that, there was a small flame on the other side of the peek and it flowed over to the other side of the church. It just shot through the roof and it was a spectacular fire. It turned into a tornado of flame."

Police have charged a New Jersey mother who allegedly lied and said her son was suffering with cancer in order to deceive friends and loved ones out of thousands of dollars.

Investigators say Susan Stillwagon, 35, stole as much as $3,500 through cupcake and bracelet fundraisers by claiming that her 9-year-old son had a type of lymphoma and needed medical care.

"You tell people your son has cancer and they want to help," said Pennsauken Police Lieutenant Michael Probasco.

Police got a tip earlier this week that Stillwagon's story about her son wasn't adding up. Investigators subpoenaed medical records and discovered Stillwagon had been lying.

Probasco says Stillwagon even convinced her son he was sick to carry out the scheme.

The suspect's mother, who did not tell NBC10.com her name, says that her daughter is being treated at a local hospital.

"I will just tell you my daughter is sick and something snapped in her head. That's why she is where she is so that we can find out what's wrong with her," said Stillwagon's mother. "I am very concerned for my daughter, very concerned. We will get through this but people have to leave us alone or we will never get through it."

New Jersey's Division of Youth and Families checked on Stillwagon's four children Tuesday.

"They came to make sure the house is livable, food in fridge and that the kids aren't being mistreated and they didn't find any of that," said Lieutenant Michael Probasco.

Tamara Disalvo, a neighbor, says her thoughts are with the little boy.

"Just as a friend and neighbor you do feel deceived by this. He must be pretty confused because of he was deceived this way by his mother, that's got to feel awful," said Disalvo.

Stillwagon was charged with theft by deception and using her own son to commit a crime.

Police say a man that seriously injured a woman after firing into a Dallas nightclub is now in custody.

It happened around 1:30 a.m. at Pacio Night Club, 3602 Samuell Boulevard, not far from Interstate 30 and Dolphin Road.

The shooting victim's brother tells NBC 5 that his sister, Dexy Alcala, had been hanging out at Pacio with their sister when Dexy was shot three times.

"It was just a night for them. They hardly do that. They hardly have babysitters," says brother Pablo Solis. Solis had been watching the kids for his two sisters, so the moms could enjoy a Thursday night out.  Pacio's is their typical neighborhood hangout.  "They just chill there, because they say it's real calm."

The calm turned to chaos when police say security tossed a man out of the nightclub for fighting. Officers tell us, he left, but headed to his black Ford pickup truck, grabbed a gun, and shot into the club.

Dexy Alcala got his by the barrage of bullets.  "It took a minute to sink in," says Solis.  "My sister's at Baylor right now, she says she got one to the foot and one to the side of the stomach."

Paramedics rushed Alcala to the hospital in serious condition.  Her brother says she will be okay.  He's still watching the kids, while the wounded mom is recovering.  "Picking up my sisters cars and taking the kids to school.  It doesn't seem real, but it happened," says Solis.

Investigators have been talking with witnesses and getting the tips they need to lead them to the gunman.

For the second year, RISE Adaptive Sports and the city of Irving are hosting an adaptive skate event for disabled children, adults and veterans.

Among the participants is Jon Comer, a professional skateboarder who lost his leg when he was four years old. Comer said his physical disability didn't keep him from pursuing his passion, and on Saturday he will be inspiring others to do the same.

"I got hit by a car when I was four years old and then lost my foot when I was seven just due to complications from that," said Comer.

Since he was 10 years old, skateboarding became a passion and Comer never saw his amputation as a disability and has been a professional skateboarder since 1997. He's hoping to inspire the kids to push the limits no matter what their disabilities are.

"I would destroy my prosthetics all the time," said Comer. "And I'd go in and I'd get fixed up so I can get back out there and skate some more."

Nonprofit Rise Adaptive Sports is working with the city of Irving for the second year to help raise awareness and inspiration.

"We want people to realize that we have a diverse population, which includes people with physical and mental disabilities, and we ought to be providing services for them as well," said Joseph Moses, city of Irving recreation superintendent.

Chris Goad, executive director of Rise Adaptive Sports, hopes the event inspires those reaching for their dreams, like Comer.

"Doing something like this really helps with self-esteem and confidence," said Goad. "And especially if we can get kids in the fold at an early age, it helps them with school, knowing that they can accomplish things despite disabilities."

The event begins at 10 a.m. at the Lively Pointe Skate Park on Saturday, April 27.

Bombing Survivor: "Glass Everywhere and then I Blacked Out"

advertisement

Connecticut couple Amy and Mike Garofolo were in Boston last Monday to cheer on a friend in the marathon, but more importantly to mark a rebirth in Amy's fight with cancer.

They were mere feet away from one of the explosions.

For four hours the Middletown couple was on the sidewalk outside Forum Restaurant, waiting for their friend to cross the finish line. His slow time may have saved their lives.

"I remember him being blown back into the restaurant and going down like a rag doll. Glass everywhere and then I blacked out," said Amy Garofolo, who says when she came to, her son Ryan was carrying her away from all the chaos.

She says it felt like she got hit by a ton of bricks. "And as we were evacuating out the back of the restaurant, I could feel blood trickling down my face."

Amy sustained serious injuries as did her husband Michael. He has perforated ear drums, staples in his head and burns on his hand.

"There was lots of glass. I remember the falling glass," said Michael. "Thinking to myself this isn't good."

It's still difficult to process for the Garofolo's of Middletown. They were in Boston that Monday for a cancer fundraiser at Forum; they were also in town to celebrate Amy's first anniversary of her stem cell transplant.

They had come in just 30 minutes before the first bomb went off and then the second exploded.

"We were literally out by the road cheering for four hours," Amy said.

"I think of the what ifs. The thousand different decisions. Little decisions that were made by myself or Amy and a lot of different people that affected where we were," Michael added.

Both Mike and Amy were blown back into the restaurant. They found their kids and were evacuated out back. Mike though went back in to help out; he saw the front glass blown out and pure terror.

"And then once I got out there, it was pretty horrific," Mike said. Within a split second one minute they are cheering on their friends they're on the ground missing body parts wondering what the heck just happened."

Mike was taken to Massachusetts General Hospital to be checked out and was released several hours later.

"I'm just thankful," said Mike.

Neither one of them has taken me down and I'm going to fight back against both of them," Amy added.

Amy has been battling multiple myloma for two years and says an incident like this has made her even stronger. As for her marathon injuries she says she had glass in her hands, cuts in her head and down her nose but the Garofolo's know luck was on their side.

Two MedStar first responders saved a woman from a fiery rollover crash early Thursday morning.

Kayden Bathory and Robert Long of MedStar arrived to the scene of a burning, rolled over vehicle on West Freeway at Chapel Creek Boulevard in Fort Worth.

The pair was first on scene to the crash and used a fire extinguisher to temporarily fight the fire and pull the woman from out of the burning vehicle.

As the pair dragged the woman out, the fuel tank ignited and the vehicle exploded.

Both of the first responders received flash burns, but were able to get the patient to a stable condition for transport by CareFlite to an area burn center.

The victim of the crash suffered serious burns and is in critical condition, according to MedStar.

Bathory and Long will be formally recognized for their actions by MedStar in the near future, according to a press release.

Fort Worth Police and Fire Departments also responded to the crash. Fort Worth firefighters were able to extinguish the vehicle fire around 1 a.m.

A memorial service is planned Thursday in Waco, Texas, to honor the first responders who died in last week's explosion in West. Fifteen people died in the explosion, and at least 10 of them were first responders.

President Obama will fly to Waco for the service after attending the dedication of the George W. Bush presidential library in Dallas.

Gov. Rick Perry, Sen. John Cornyn and other public officials also plan to be there.

It is set to start at 2 p.m. at the Ferrell Center at Baylor University, but officials urged people to arrive early because of the extraordinary security.

The event is organized by the National Fallen Firefighters Foundation and Texas Line of Duty Death Task Force.

It was the largest life of first responders in Texas in recent memory.

"Patience is a wonderful thing and we encourage a heavy dose of it," said Baylor University police chief Jim Doak. "But the program -- I've seen what they are going to do -- it will be well worth the wait. The firefighters who are putting this on have put a lot of thought into it, a lot of emotion. There are some real heavy hearts."

A number of fire departments from North Texas are participating in the service, including Irving, Lewisville, Coppell and Red Oak.

Crash, Closures Snarl US 75 Traffic

advertisement

Major traffic issues on U.S. 75 are delaying drivers in Dallas and McKinney.

Southbound U.S. 75 lanes are closed in McKinney where a truck rolled over just north of Virginia Ave.

U.S. 75 is closed from U.S. 380 to Virginia due to that single vehicle accident. No one is reportedly injured.

All southbound drivers on U.S. 75 are being forced off at U.S. 380.

In Dallas, road closures due to the dedication of the George W. Bush Presidential Center on the campus of Southern Methodist University may have drivers seeing delays or seeking alternate routes.

All streets around the Southern Methodist University campus are expected to busier than normal between Wednesday and Friday.

Drivers who use streets that border the campus of SMU and Mockingbird Lane near U.S. 75/Central Expressway are advised to find alternate routes Thursday.  Additionally, the southbound Central Expressway frontage road between University Boulevard and Mockingbird Lane will be closed Thursday.

While Central Expressway will remain open Thursday, drivers should expect delays.

2013 Cowboys Mock Draft

advertisement

Just hours away from the draft, the number of potential paths for the Cowboys seems endless. Sitting at No. 18, it's difficult to project even the Cowboys' first pick because this draft could unfold in so many different ways. I really believe Dallas will be targeting one of the two elite guards in this class, but I think the odds of one of them being available are just 50/50.

For the sake of this mock draft, I'm going to assume that both Chance Warmack and Jonathan Cooper are off of the board when the Cowboys are on the clock. I'm also going to assume that offensive tackle D.J. Fluker is gone, which seems like a legitimate possibility at this point.
Note that this mock draft is my best guess of what the Cowboys will do with their picks, not what I personally would do.

Round 1: Sylvester Williams, DT, UNC

With Kenny Vaccaro still on the board, I think the Cowboys will realize the safety position is so deep that drafting Vaccaro won't maximize overall value. If that's the case, Williams might be a major consideration. From my Williams scouting report:

Williams is a big, powerful defensive tackle who nonetheless can move with speed. He's extremely quick off of the ball—consistently the first person off of the snap at UNC—despite his 6-3, 313-pound frame. Like Purdue's Kawann Short, Williams is one of the few defensive tackles in this draft that I see being scheme versatile. He's strong enough to hold up at the point, but he's fast enough to penetrate as a one-gap defensive tackle. He was used as the latter sort of defensive tackle at UNC.

As a pass rusher, Williams parlays his quickness and strength into an excellent bull rush. When he gets a jump on the ball, he can quickly drive interior linemen into the backfield. He combines his bull rush with an outstanding swim move—probably the best in this draft class. Williams also has great play recognition; I saw about a half-dozen screens thrown against him and he wasn't fooled by one.

Williams can play both defensive tackle positions and would eventually take over for one of the Cowboys' two aging interior defensive linemen.

Round 2: Justin Pugh, G, Syracuse

I'm not very high on Pugh, but a lot of teams think he has guard/tackle versatility. The Cowboys have visited with Pugh.

Pugh is one of those "what if?" players, but we probably won't get to uncover the answer to the question "what if Pugh stayed at offensive tackle in the NFL?" The reason is that, although he has 6-5 height, Pugh's arms measure only 32 inches. That's a death sentence for an offensive tackle in the NFL; arm length is strongly correlated with success because tackles need to be able to fend off tall defensive ends.

You can already see signs of Pugh's potential struggles when you watch tape of him at Syracuse. While he generally did an admirable job in pass protection, he can be neutralized if a longer defender gets his hands into Pugh's chest. At the next level, Pugh will face the best of the best—defensive ends and linebackers who all know how to use their length to control offensive tackles with short arms. On top of that, Pugh struggled at the Senior Bowl when he lined up outside.

Pugh would be a starting guard right off the bat.

Round 3: JJ Wilcox, S, Georgia Southern

As far as mid-round picks go, I think Wilcox is by far the most likely to come to Dallas. He's a favorite of mine and the 'Boys have shown a lot of interest.

Wilcox has excellent size at 6-0, 213 pounds. He turned in a solid 40 time at 4.51 and a remarkable 4.09 short shuttle, showing why he was used at receiver for three seasons. As you'd expect, Wilcox is an outstanding athlete; he moves fluidly and shows excellent lateral quickness. Despite little experience at safety, Wilcox is a good tackler. He doesn't wait for ball-carriers to reach him, but instead attacks the line and breaks down well in space.

Wilcox didn't play much from a single-high position at Georgia Southern, but he got time there at the Senior Bowl. He performed surprisingly well, and his measurables suggest he should be able to play deep. He showed good ball skills at the Senior Bowl—and during his time on offense in college—so he has the ability to make big plays in the secondary.

Wilcox has a higher ceiling than Vaccaro at a fraction of the price.

Round 4: Marcus Lattimore, RB, South Carolina

I'm not a huge fan of Lattimore's simply because I don't think he was an elite running back even before he got injured. It's difficult to say whether or not the Cowboys will target Lattimore; on one hand, they've had some success finding value on injured players, but on the other hand, Lattimore's injury was potentially career-threatening and he might not be able to play this year. I'd much prefer Vanderbilt's Zac Stacy or Texas A&M's Christine Michael, but I have a feeling that Lattimore will drop far enough to at least entice Dallas.

Round 5: Stansly Maponga, DE, TCU

Maponga is a pass-rusher in whom the Cowboys have shown interest. He's undersized at only 6-2, but he has 34-inch arms. While others emphasize height, the Cowboys could potentially find value on a player who actually has the physical tools to excel in the NFL but will drop because of a perceived weakness that doesn't actually affect production.

Round 6: Chris Gragg, TE, Arkansas

One of the things I like about the Cowboys' draft strategy under Jason Garrett is that, even when searching for the "right kind of guys," they've still been able to find athletes. Gragg is an extraordinary athlete; at 244 pounds, he ran a sub-4.50 40-yard dash. He's the exact type of high-upside player that teams should target in the late rounds and a potential future replacement for Jason Witten.

Missing Brown University Student Found Dead in Providence River

advertisement

A body pulled from a river in Providence, Rhode Island two days ago has been positively identified as missing Brown University student, Sunil Tripathi.

The state's Department of Health made the announcement this morning, formally ending the 38 day search for Bryn Mawr native. The medical examiner used dental records to identify Tripathi. His cause of death is still being investigated but the ME said no foul play was suspected.

Tripathi, 22, had been missing since March 16. He was last seen on surveillance video early that morning, not far from his apartment on Brook Street, near campus.

Sunil's case was thrust back into the spotlight last week after a viral onslaught of erroneous speculation that Tripathi was connected to the Boston Marathon bombings.

The family this morning posted a message on the Facebook page they'd been using in the search for Sunil:

"As we carry indescribably grief, we also feel incredible gratitude. To each one of you -- from our hometown to many distant lands -- we extend our thanks for the words of encouragement, for your thoughts, for your hands, for your prayers, and for the love you have so generously shared."

His body was found by members of the school's crew team in the water near India Point Park, which is a few blocks away from Tripathi's apartment.

Tripathi, a graduate of Radnor High School, moved to Providence to attend Brown. He was studying philosophy but took a leave this semester. Sunil battled depression and was working through a "tough time," his sister Sangeeta said last month. The family felt that in the weeks before he disappeared, however, Sunil was doing well.

On the day his brother went missing, Ravi Tripathi made the trip from Philadelphia to Providence, R.I. as fast as he could.

"We dropped everything. We didn't even pack. And then a couple of days turned into over a month."

Providence was ground zero in the search for Sunil Tripathi. His immediate family, extended family and close friends were all there together. Every day they met and collaborate on what they can do next.

"It's a very scary thing to be on the other side of it and see how quickly our voices got drowned out and hysteria took over," Ravi Tripathi said in an interview on Monday.

The Tripathi family has been posting the latest information and messages of hope on their "Help Us Find Sunil Tripathi" Facebook page.

"It's been a roller coaster for all of us," Ravi said earlier this week, reflecting back on the five weeks they've spent searching for Sunil.  Ravi said he would always be grateful for the time everyone has spent together, saying the support of family and friends has been "beautiful. A gift."

George W. Bush: I "Really Don't" Miss Being President

advertisement

George W. Bush is back in the Oval Office. Fortunately for him, it is just a replica of his old workplace.

Bush took a walk through the new George W. Bush Presidential Center in Dallas on Thursday and told NBC's Matt Lauer that he does not miss his old job.

"I had all the fame and power I needed for eight years," Bush said. "Laura and I knew when our time was up, it was time to come home."

Bush and wife Laura reflected on their eight years in the White House on the day that five living past and present U.S. presidents gathered to help dedicate the George W. Bush Presidential Center in a ceremony that is expected to attract more than 8,000 spectators.

The event also marks Bush's first return to the spotlight since he left the real Oval Office four years ago when he left behind a presidency that was punctuated with low approval ratings and controversial decisions -- decisions that Bush unabashedly says he does not regret.

"We were successful in protecting the homeland," he said. "People are going argue whether such and such yielded information and I am telling you that it did and without it, you cannot protect the homeland."

The tour of the center with the Bushes included a stop at the display of hanging chads - a relic of the Florida election recount where the Supreme Court ultimately ruled in favored of Bush after the 2000 presidential election.

The decision marked the beginning of a presidency for which Bush said he had high hopes: economic development, tax relief, education reform and faith based initiatives.

But that all went out the window on Sept. 11, 2001.

"I became a wartime president, something I did not want to be," Bush said.

Still, Laura Bush says her husband is at peace. And while the former president does not miss being Commander in Chief, he has no qualms about encouraging his brother Jeb Bush to run in 2016. Bush said in an interview that aired on ABC on Wednesday that his younger brother would make a "marvelous candidate."

But their mother Barbara Bush disagreed.

"We've had enough Bushes," she said in a separate interview with Lauer, adding that Jeb is "by far the best-qualified man," but thought there were many worthy candidates.

Two North Texas shelters are preparing dozens of dogs from Waco for adoption.

The SPCA of Texas is housing 57 dogs that were transferred from a Waco shelter so room could be made there for animals displaced by the explosion in West.

"These were dogs that were already available for adoption before the horrific explosion," SPCA spokeswoman Maura Davies said. "We were there within 24 hours of the blast."

The SPCA shelters in McKinney and Dallas are getting the animals ready for adoption. Many of them are being spayed or neutered and getting health checks.

The group's adoption Web page will be updated as each Waco dog becomes available.

In McKinney, the new arrivals are mainly being housed in overflow kennel space outside. As they become adoptable, they are moved inside the main kennel to meet potential owners.

Davies said taking in dogs from Waco is a way to help shelters there.

"This is our way of being able to help the animals there," she said. "There are some dogs that have already gone up for adoption, and others will continue coming up as they are ready."

After Hurricane Katrina, shelters formed networks to help relocate adoptable pets to other facilities in order to make room in a disaster zone for lost or newly homeless pets, she said.

"When you bring in 57, 100, 200 dogs, it does put a big strain on our resources," Davies said.

Jurors in Russell Told to Pack a Bag

The judge in Dr. David Russell's sexual misconduct trial told jurors to "pack a bag" in preparation for deliberations.

Jury to Deliberate Chiropractor Charges on Tuesday

A Collin County jury will begin deliberation Tuesday morning on sexual assault charges against a McKinney chiropractor accused of sexually assaulting several of his patients.

More Photos and Videos

A McKinney chiropractor accused of sexually assaulting several of his patients has been found guilty of charges involving four victims.

The Collin County jury convicted Dr. David Russell of sexual assault, sexual assault of a child and indecency with a child.

Russell was found guilty of sexual assault of a child and indecency with the same child. He was also convicted of another indecency charge related to another child and two sexual assaults of adults.

He was found not guilty on the other charges.

Russell faced up to 12 counts of sexual misconduct related to five female patients, four of them teenagers.

Aggravated sexual assault of a child was the most serious charge, but the jury could consider a charge of indecency with a child by contact if there was not sufficient evidence to support the other charge.

The judge last week tossed out one count of indecency with a child because of insufficient evidence.

The jury began deliberating Tuesday at about 8:30 a.m. and finished at about 11:20 p.m. During their deliberation, the jurors came back and asked a couple of questions related to victim testimony, NBC 5's Randy McIlwain reported Tuesday afternoon.

Jurors were told to come back Wednesday morning for sentencing.

After the verdicts were announced, members of Russell's family appeared visibly shaken, NBC 5's Ray Villeda reported. Sobs from victims seated on the other side of the courtroom could be heard.

During closing arguments, prosecutors argued that the patients' stories are too detailed and similar to simply be made up.

One victim testified that Russell had touched her breasts and commented on her underwear during a treatment session. During another session, he inappropriately touched her private parts, putting a finger inside her vagina, she said.

Another victim shared a similar story.

Also Monday morning, the prosecution introduced three rebuttal witnesses, all adult women who said Russell made inappropriate advances toward them while they were patients in his care.

No charges were filed in those cases because the statute of limitations had expired before they came forward.

Russell and his defense team have denied much of the testimony, adding that it is possible for a chiropractor's hand to make accidental, brushing contact to the area the women described when treating a groin injury.

During closing arguments, the defense said McKinney police made Russell "public enemy No. 1" when he was arrested.

Defense attorney Todd Shapiro said a floodgate of accusers opened up when his client was arrested and his mug shot was released. Shapiro said there is no direct evidence that Russell did anything wrong, saying that only one witness to any alleged misconduct testified during the trial.

Russell did not testify in his own defense.

NBC 5's Catherine Ross, Randy McIlwain and Ray Villeda contributed to this report.

The Hunt Is on for Barry Bonds Plaque Thief

Kent Wilhoit

The plaque was to the left of the Comcast sign next to the bleachers. (Close up photo below).

The memory of Giants slugger Barry Bonds may be waning in San Francisco, but it looks like someone still wants a piece of him.

Sometime over the last week, someone took a memorial honoring Bonds.  The six-foot high plaque that used to hang beyond right center field is missing, as the San Francisco Chronicle first reported.

The badge, which is a large, orange shield with the number 756, was bolted securely to the spot inside AT&T Park where Bonds hit his record-setting 756th home run in 2007.

It was in a public area next to the bleachers in the outfield. If you know the park, it was hung to the left of the Comcast SportsNet sign on the brick wall below the Coors bar in the outfield.

Bonds was one of the franchise's greatest and most popular players. He is also a felon appealing his federal obstruction-of-justice conviction related to the BALCO steroids drug case.

Giants spokeswoman Staci Slaughter told NBC Bay Area in a simple email that the team is having the plaque replaced and the Giants aren't involving police because it would be a "waste of taxpayer money" to involve them at this point.

The most important thing, she said, is to get the plaque replaced.

The only other mention of Bonds at AT&T Park is still there. Bonds' name listing all the Giants with 500 home runs hangs on the arcade archway closest to center field.

Team and stadium officials did say they do plan to look at a week's worth of security video to find out whodunit.

A week after Dzhokar Tsarnaev allegedly detonated a homemade bomb near the finish line of the Boston Marathon, federal prosecutors charged the teen with using and conspiring to use a weapon of mass destruction and maliciously damaging and destroying property, resulting in death.

The first charge resurrects a term that stirred fears a decade ago about nuclear-armed regimes and the prospect of the world's deadliest weapons falling into the hands of terrorists.

In President George W. Bush's famous "weapons of mass destruction" speech, which laid out the rationale for U.S. military intervention in Iraq, he warned that without action, enemies of the United States could one day get their hands on chemical, biological or even nuclear weapons, killing "thousands or hundreds of thousands of innocent people."

The Tsarnaev brothers are accused of killing three people and injuring more than 260 others on April 15 with a pair of improvised explosive devices: pressure cookers packed with low-grade explosives, metallic BBs and nails.

To the many who took to Twitter to complain or publicly scratch their heads, the weapon of mass destruction charge appeared incongruous with the details of the Boston attack.

Some questioned why assault rifles used in deadlier mass shootings were not considered weapons of mass destruction while others objected to the idea of improvised explosive devices being placed in the same category as nuclear warheads. "So Iraq was invaded because of pressure cookers?" one person tweeted.

The Defense and Justice Departments have varying definitions of WMDs. The former limits its definition to chemical, biological, radiological and nuclear weapons capable of causing mass casualties, while the latter lists a host of other weapons that can fall under the same umbrella. Bombs, mines, grenades, even certain guns are classified as WMDs in the federal criminal code, whose revision in 1994 gave prosecutors much more flexibility in their use of the term.

"That statute defines WMD extremely broadly, including more or less any explosive device—and certainly the devices used in [the Boston bombings]," Robert Chesney, a professor at the University of Texas School of Law wrote in a blog post early Monday, correctly predicting that the feds might opt for the WMD charge in Boston case.

Since the Federal Death Penalty Act was passed in 1994, tacking a long list of items to the WMD definition, prosecutors have classified everything from pipe bombs to RPGs as weapons of mass destruction. Shoe bomber Richard Reid, who unsuccessfully attempted to down a plane with explosives hidden in his shoe, was sentenced to life in prison in 2003 on eight charges including attempted use of a weapon of mass destruction.

The same WMD designation was assigned recently to U.S. Army veteran Eric Harroun, who boasted online about joining Syrian rebels in their fight to depose Bashar al-Assad. The government's criminal complaint accused him of fighting alongside a U.S.-designated terror group and conspiring to use a weapon of mass destruction—a rocket propelled grenade—outside of the U.S. That charge brought the legal definition of WMDs into the spotlight last month and prompted articles with headlines such as, "Let's All Stop Saying 'Weapons of Mass Destruction' Forever."

Stephen Vladeck, a professor at American University's Washington College of Law says that while the WMD statute may be "inaptly named," it clearly incorporates both RPGs and the sort of bomb the Boston suspects are accused of detonating.

"This statute has been historically designated for bombings," he said. "For better or for worse, there is no general bombing statute."

Indeed, analysts predicting charges against Tsarnaev in the days and hours before they were announced invaribly placed the WMD charge at the top of their lists. Former FBI agent Donald Borelli casually mentioned the term "weapon of mass destruction" to describe the marathon bombs in an interview with MSNBC last Wednesday, causing host Chris Hayes to pause. "Weapon of mass destruction? Is that specifically the term we're using for this pressure cooker bomb?" he interjected.

"Well, you can use it under the WMD statute,"  Borelli replied. "A bomb like that can be considered a WMD. So there's your terrorism charge."

In his quest to define the confusing term, W. Seth Carus, deputy director of the Center for the Study of Weapons of Mass Destruction encountered more than 50 definitions for WMDs issued by federal or international organizations. In a report he wrote on the matter, he criticized the 1994 law, which he said, turns "the original meaning of WMD on its head." That law, he points out, inspired 21 states and the District of Columbia to adopt their own varying WMD definitions.

He argued for the return to the original definition developed by the UN in the 1940s, which included only the deadliest weapons, like atomic bombs and radioactive weapons, in its characterization of WMDs.

But Carus' outlook was not optimistic. "It is unlikely that the U.S. Congress or the law enforcement and defense communities will follow such a path," the report concluded.

An employee accused of stealing $10,000-worth of chicken wings from a meat and poultry company in Connecticut has been arrested.

The owner of County Distributors - located in the town of South Windsor - reviewed surveillance footage from his warehouse and noted that an employee, identified as Boris Delisser, had taken products from the warehouse and loaded them into a vehicle, according to police.

The complaint was filed in February 2012, according to police, and the investigation determined that Delisser had done this on several occasions. The total loss is estimated in excess of $10,000 worth of chicken wings and meat.

This chicken wing theft is the latest in a spate of food heists that took place in recent months. An Illinois man was arrested in March for stealing 21 tons of cheese from Wisconsin, while a Pennsylvania man was charged for pilfering and drining $100,000-worth of whiskey that belonged to his boss.

Police obtained a warrant charging 43-year-old Delisser with larceny in the first degree, which was served on Tuesday.

He was released on a $10,000 surety bond and is scheduled to appear at Manchester Superior Court on May 2.
