Grand Prairie police are looking for the driver who hit and killed a 6-year-old boy Thursday night.

Police say John Paul Raidy, a first-grader at Austin Elementary, was crossing the street with his mother and sister at North Carrier Parkway and Holiday Hills Drive at 7:30 p.m. when he was hit by a car.

"This is one of the most horrific scenes I have ever seen, as far the dynamics of the crash and the circumstances surrounding it," said Grand Prairie police Sgt. Eric Hansen.

Police said the driver ran a red light that investigators determined had been red for 14 seconds.

The collision, police said, was so powerful that Raidy landed on the hood of the car and was carried 100 yards before landing on the pavement.

"I pray they grow a conscience and turn themselves in for doing this to a 6-year-old boy," said John's mother, Lauren Raidy.

Investigators said the vehicle that hit him stopped briefly and then drove off southbound on Carrier Parkway.

"We believe that the driver is aware of what occurred and, whether they got scared or what made them leave the scene, we hope they will contact us," said Hansen.

Raidy was taken by ambulance to Arlington Memorial Hospital where he died.

"He's just gone. I'll never be able to hold my son again, I'll never be able to tell him that I love him," said Lauren Raidy.

The vehicle is described as a black or very dark-colored 4-door hatchback.

Police released a traffic camera photo (left) of the small dark hatchback involved in the fatal hit-and-run.

Grand Prairie police said the vehicle will likely have minor damage to the front bumper and hood.

Anyone with information about the vehicle is encouraged to contact the Grand Prairie Police Department's Traffic Division at 972-237-8790.

This is the second traffic fatality in Grand Prairie this year.

Grief counselors spent the day at Austin Elementary to help students and staff.

Faulty Rail Crossing Causes Major Traffic Headaches

A group of Hood County officials say safety improvements to a rail crossing along U.S. Route 377 are actually creating more safety problems.

The issues started this week, when railroad crossing arms were activated for the Fort Worth & Western Railroad crossing on U.S. 377 just north of state Highway 171, about halfway between Benbrook and Granbury in Cresson.

On four of the first five days of operation, the arms would lower when no trains were trying to cross. And the arms would stay lowered for 30 to 45 minutes, causing traffic backups measuring three miles long.

"I couldn't see any road," said Tasha Walker, a business owner on U.S. 377. "I could only see cars -- as far as you could see that way (south) it was backed up."

The backup happened at about 2:30 p.m. Officials say nearly 500 vehicles were stuck, leading to 47 calls to 911 and citizens trying to lift the gates themselves.

"The Cresson train is notorious for upsetting people, you could say," Walker said.

Cresson's mayor, Hood County's sheriff, the county judge and a county commissioner are among those upset with the new crossing gates.

"We didn't want them, but if we're going to have to have them, someone needs to be accountable to make them work," Commissioner Steve Berry. "It happens at the most inconvenient time; people are going to work in rush hour mornings or coming home in the afternoon."

Berry said studies have shown that 20,000 vehicles pass through the U.S. 377-SH 171 interchange every rush-hour period. Traffic can back up even if there are trains crossing the road, but safety issues come up when the arms lower but no train is crossing.

"We had a number of different times in the last few days where citizens tried to raise the arms on their own, and that's not a safe deal to do that, so we can't have them doing that," Hood County Sheriff Roger Deeds said. "We need to make sure they get fixed and working like they're supposed to and we don't have these kinds of issues where people are waiting 30, 45 minutes to an hour waiting on traffic."

Cresson Mayor Bob Cornett, also a city volunteer fire department assistant chief, said he has received numerous calls himself.

"No, they are not happy, and a lot of them have my cellphone number. I'm getting called all day and night," he said. "It's just something that's not acceptable. To me, it would be an easy fix if they would just fix it."

Cornett said he worries there could be issues if the arms are down during an emergency because U.S. 377 is the only direct route from Granbury to Fort Worth.

"If you've got a 30-minute delay because you can't get through because there's no train, and you've got heart attack or stroke victim or wreck or whatever, people are going to die," he said. "And that's a shame."

Fort Worth & Western Railroad operates the crossing and is in charge of the safety improvement project, according to the Texas Department of Transportation.

TxDOT funded the improvement project, agency spokesman Val Lopez said.

NBC 5 contacted the railroad's corporate office but were told no one was present to take the call for comment. The vice president of the railroad NBC 5 was referred to did not return an e-mailed request for comment.

Man Arrested, Accused of Being Fake Dentist

Plano police arrested Jose Santiago Delao Thursday morning in connection to practicing dentistry without a license.

Police released the arrest affidavit in the case of the Plano man accused of practicing dentistry without a license.

Officers arrested Jose Santiago Delao, 63, and confiscated all of his equipment that he used in his business Thursday morning.

An arrest affidavit details what the patient, who reported the home-based dentistry, claims happened to her.

The patient, whose identity has not been released, went to Delao's home for a filling on Jan. 14.

The woman went to the home after receiving a business card at church. The business card offers an array of dental services including full and partial dentures.

She tried to leave the home because it did not look like a proper dentist's office, according to the document.

The affidavit states "Delao would not let her leave, saying that she had already cost him time and money."

The affidavit continues to say that she was taken to a back room of the house and wound up in a dental chair. She received two injections, but when Delao started drilling, she started waiving her arms due to the pain.

Records say Delao "..pushed her hand back down and told her to stop complaining."

The document says the patient was still in so much pain eight days after her visit that she could not open her mouth.

"This guy has been operating probably for at least four years," Plano Police Officer David Tilley said.

Plano police worked with the Texas State Board of Dental Examiners, the state licensing agency for dentists, to confirm that Delao does not have a license to practice dentistry within the state.

Texas A&M Baylor College of Dentistry expert, Dean Hudson, said many aspects of the allegations are very egregious.

"I would be very concerned about not only the quality of care and any prescription drugs that he prescribed but also infection control and general patient safety," Hudson said.

Hudson added that patients should never accept care unless proper licenses to practice and prescribe drugs are posted in dental offices, as required.

Dental schools offers discounted services and other lower cost options to help patients, Hudson said.

"We believe that most of his clients were uninsured," Tilley said.

Delao is still in Collin County Jail as of Friday evening. He is being held on $25,000 bond.

Wylie police officers finished up some "shocking" training on Friday morning as part of their certification to use Tasers.

The city recently approved its first purchase of 51 Taser X26s, something some senior officers called "a long time coming."

Sgt. Donna Valdepena said the stun guns are documented to show a decrease in on-the-job injuries to officers, as well as suspects because they prevent hand-to-hand struggles.

"Using a Taser, you don't have to go hands-on," she said. "You don't have to put yourself at risk of getting injured."

But Valdepena said going through the voluntary shock demonstration was "probably the longest five seconds" of her life.

"It does totally incapacitate your body for those five seconds," she said.

Patrol Lt. Anthony Henderson echoed the sentiment.

"It feels like a really large cramp," he said. "Your entire body cramps up; you can't move."

Henderson said he and other officers felt it was necessary to experience being stunned.

"We're able to say, 'Yes, we have been through that,' and we know what it could do to benefit us, and we also know what it could do to hinder us if it was used against us," he said.

But Henderson also added that it wasn't something he wanted to go through again.

Police said the shooter ran over the victim while driving off.

The worst of the flu season appears to be over in North Texas.

"We've actually peaked as of approximately two weeks ago and so we're seeing a decline as far as overall number of flu cases in Dallas County," says Dr. Christopher Perkins, Medical Director at Dallas County Department of Health & Human Services.

The latest weekly reports from both Dallas and Tarrant Counties, for the week ending Jan. 19, show a decline in the number of flu cases, now at their lowest since the holidays.

"We generally see our peak in January, but we saw our peak this time around in December," says Perkins.

But that doesn't mean the flu season is over, and it's not too late for a flu shot.

"We've had the community getting vaccinated so that prepares us for this extended long flu season which the CDC is predicting might last as long as into March," says Perkins.

Former Prosecutor: Tarrant County DA Sexually Harassed Her

A former Tarrant County prosecutor claimed she was sexually harassed by District Attorney Joe Shannon "over a long period of time" and later received a $375,000 settlement, according to documents released late Friday.

The former employee, Sabrina Sabin, said Shannon made graphic sexual comments to her and later retaliated against her.

Shannon denies the accusations.

On a business trip in 2008 in San Antonio, Shannon made comments about "seeing my breasts and how good they look," she wrote in a handwritten statement.

She said similar comments continued weekly when they returned from the trip.

"Joe would constantly make comments about my breasts and tell me he would like to see them and touch them," she said. "He would say things like, 'If you ever decide to surprise me and show them to me, no one has to know.'"

Early on, she said, she feared retaliation.

"I knew that if I said anything or made an issue out of being sexually harrassed, that I would possibly loose my job or that he would make my life miserable," she wrote. "I just kept quite and continued to focus on doing my job well." [Eds: The spellings "harrassed," "loose" and "quite" are in the original document.]

She said she worked directly for Shannon when he supervised the economic crimes unit before he became district attorney.

"It wasn't until I moved up into the position as an economic crimes prosecutor under Joe Shannon that things at work started becoming uncomfortable and at times unbearable and stressful," she said. "I didn't know what to say. Things are never going to change. This is never going to get better until he is gone."

In a written statement Friday, Shannon, 72, denied the accusations.

"An objective review of the documents will clearly demonstrate what I have said all along -- there are two sides to this controversy," he said. "The claims have been vigorously denied and disputed. I did not agree to the payment of any money."

In April 2009, Sabin said Shannon told her he had a dream about her.

"We were somewhere like a locker room or swimming pool dressing room and that he followed me in and took my shirt and showed him my breasts and that one breast had two nipples," she said. "He said they looked great though."

She said the conversation continued in graphic details about dreams Shannon said he had.

In January 2009, Sabin wrote she bought a pen that recorded audio to document inappropriate conversations.

In April 2009, she said 'Joe came up from behind me and grabbed and petted my hair. He then leaned down and smelled it."

Earlier, in 2008, she described an incident she said happened in the office after co-workers had left.

"When I turned around, Joe slapped my ass. I could not believe what had just happened. I knew what it would mean for my career if I said anything but I was furious."

In an e-mail last April, Sabin wrote that she was concerned the county was retaliating against her after she complained.

"I need my job and do not want to be retaliated against," she wrote. "I hope this can be resolved in a peaceful and discreet manner."

In June, she asked that Shannon no longer contact her on the telephone.

The DA's office released documents in the case late Friday after Attorney General Greg Abbott ruled they were public.

Tarrant County reached a $375,000 settlement with the woman last September. Part of the deal included a confidentiality agreement, but Sabin later wrote she wanted to withdraw from it.

Late Friday, Sabin told NBC 5 she is glad the details of her allegations have been released.

"I'm really glad everything has come out because the whole thing was I wanted the truth to come out," she said in an interview. "I stand by my diary and what I wrote in my diary 100 percent -- 100 percent. Everything I wrote in there was true."

She defended waiting several years to report the alleged harassment because she was worried about losing her job.

"It just kept going and I just at the time felt like enough was enough and maybe I needed to speak up to prevent someone else from going through the same thing," she said.

Media organizations requested county documents on the case under the state's open records law, but county officials argued they should be kept secret and asked the attorney general for an opinion on whether the documents must be released. The attorney general ruled many of them were public.

Shannon was elected at the age of 24 to the Texas House of Representatives. He joined the Tarrant County District Attorney's office in 1972, where he was later the lead prosecutor in the famous Cullen Davis murder case.

In May 2009, he was serving as chief of the economic crimes unit when then-District Attorney Tim Curry died. Shannon was appointed to replace him and later was elected to the post.

He is the former president of the Tarrant County Bar Association and an adjunct professor of law at Texas Wesleyan University.

Two men and a teenage boy were arrested in connection with a series of race-based attacks on an African American family in an attempt to drive them out of Compton, in Los Angeles County, sheriff's officials said.

A group of Latino males who claimed to be in a local street gang used metal pipes and shouted racial epithets at a black man who had recently moved into the neighborhood, sheriff's officials said.

One of the suspects, identified as Efren Marquez, 21, allegedly pointed a gun at the victim and threatened to shoot him while he was being beaten with a metal pipe allegedly by a second suspect, identified as Jeffrey Aguilar, 19, officials said.

After the attack, the group left in a black sport utility vehicle.

Marquez and Aguilar returned 30 minutes later with a group of up to 20 gang members, who surrounded the front of the victims' home shouting racial epithets and telling them that members of the African American race (using the 'n-word') were not allowed to live in the neighborhood, sheriff's officials said.

An unidentified member of the group threw a beer bottle through the front living room window.

Sheriff's officials said the suspects continued to drive by the home of the family -- which includes four children -- several times a day, shouting racial epithets while ordering the family to leave the neighborhood.

Aguilar, Marquez and a juvenile were arrested on Thursday, said Capt. Mike Parker of the Los Angeles County Sheriff's Headquarters Bureau.

They face hate crime charges.

A North Texas jury has sentenced a 27-year-old man to 55 years in prison for the scalding death of his young daughter.

The Tarrant County jury sentenced Charles Bellamy on Thursday in Fort Worth hours after finding him guilty of murdering 2-year-old Jaz'mine Howard. Bellamy had admitted responsibility for the March 15, 2011, death of the child, but his attorneys had argued for a lesser verdict of criminally negligent homicide.

The sided with prosecutors, who had argued that Bellamy serve at least half of his sentence before becoming eligible for parole.

The child's 21-year-old mother previously testified that she had never seen Bellamy mistreat any of his other eight children. Joy Howard said, however, that once he appeared upset when Jaz'mine had a potty-training mishap.

Irving Approves Changes to Alcohol Ordinance

Restaurants in Irving soon will be able to sell more alcohol -- and eateries in Las Colinas will be able to sell a lot more.

The City Council on Thursday night voted to change Irving's alcohol ordinance to allow all restaurants to have a 50-50 ratio of alcohol to food sales.

North of state Highway 114 in Las Colinas, sales of alcohol can now be up to 70 percent of a restaurant's sales.

The previous ordinance, which was more than 30 years old, required all restaurants to maintain a ratio of 60 percent food to 40 percent alcohol.

Proponents of changing the ordinance said raising the alcohol limit would boost business. The local chamber of commerce has said that keeping the old ordinance would jeopardize developments such as the $125 million Water Street project.

But those who were in favor of keeping the 60-40 ratio said they feared raising the alcohol level would lead to negative changes in parts of the city.

It was not immediately known when the new measure, which passed by a 7-2 vote, would take effect.

A man stole a car with a sleeping toddler inside in Fort Worth on Thursday afternoon.

Fabiola Garcia said the thief jumped into her still-running car when she stopped at a garage sale at about 3:30 p.m. in the 1900 block of South Henderson Street.

Her son, 2-year-old Ricardo Calderon, was sleeping inside the car.

"They came across the street and told me the little boy was in the car, and I called the police back and told them it was a kidnapping," witness Bobby Duncan said.

Police say the car thief didn't go very far before stopping the car and letting little boy out about 15 minutes later.

Garcia said she thanks God that Ricardo was not harmed, and the family is happy he and his three brothers are all safe.

"I hope they catch that man," a cousin said. "He should pay for what he did."

The stolen car is still missing, and police are searching for the thief.

And tonight police are still searching for both the thief and the stolen car.

Man Accused of Practicing Dentistry Without License

A Plano man is behind bars, charged in connection to practicing dentistry without a license.

Plano police served an arrest and search warrant at the home and makeshift dentist's office on the 1900 block of East Park Boulevard Thursday morning.

Officers arrested Jose Santiago Delao, 63, and confiscated all of his equipment that he used in his business, according to police.

"We were given information that this is apparently starting to become a problem," said David Tilley, Plano police spokesperson.  "Probably not just in this field, but in other fields as well."

Tilley told NBC 5 a patient of Delao's had come to them to report concerns about work Delao had done on them, and that they were concerned about the legality of his practice.

Plano police worked with the Texas State Board of Dental Examiners, the state licensing agency for dentists, to confirm that Delao does not have a license to practice dentistry within the state. 

Investigators are currently working to find out if Delao has legitimate dental experience in any other state or country.

A car was parked in Delao's driveway Thursday night, hours after his arrest. 

A woman inside the car said she was dropping off her mother for an appointment to have a tooth pulled, unaware Delao was behind bars and his business had been shut down.

She told NBC 5 her mother and other relatives had been seeing Delao for at least four years.  She said her mother does not have dental insurance and always pays in cash.

The woman pulled from her wallet a business card for Delao that appears to have been professionally made.  The business card lists the procedures he performs and the services he provides, including "dental lab tech, orthodontic adults - children, cranio-facial (TMJ) and orthognathic surgery appliances" as well as "full and partial dentures," "relines," "flippers, etc," and "emergencies same day."

Investigators now want to speak with other patients of Delao's to determine the scope of his practice and to determine if anyone has been harmed while under his care.

Confession: Horror Movie Gave Teen Idea to Kill Family

A Parker County 17-year-old wrote in a confession released Thursday that the horror movie remake of "Halloween" gave him the idea to kill his mother and sister.

Jake Evans is on trial for the Oct. 3 slayings of his 15-year-old sister, Mallory, and mother, Jami in their upscale Aledo home. The confession was introduced as evidence.

In a four-page written confession to police hours after his arrest, Evans said he had watched the remake of "Halloween" three times earlier that week.

The 2007 Rob Zombie film is about a 10-year-old boy who murders several people and kills a number of others 15 years later.

"While watching it, I was amazed at how at ease the boy was during the murders and how little remorse he had," Evans wrote. "Afterward, I was thinking to myself it would be the same for me when I kill someone."

Later, as his mother and sister watched the presidential debate that night, he said he "just sat in the living room thinking about how I was going to kill my family."

He wrote that he got a knife.

"I went back upstairs and kept pacing back and forth imagining killing Mallory," he said. "Thoughts of causing her pain kept entering my mind and were really bothering me. But then I'd think about the times she hurt my feelings."

He later knocked on her bedroom door and asked her to watch the comedy movie "Water Boy."

Then he changed his plans.

"After a while, I thought to myself that if I were to kill my mom and Mallory, I wouldn't want them to feel anything, so I decided to kill them both with the .22 revolver I stole from my Grandpa," he wrote.

He said he thought about it some more.

"I then spent probably over an hour walking nervously around the house thinking how life will never be the same and how I would never see them again," he wrote.

He said he knocked on sister's door again and told her their mother needed her.

"She came out and out of the corner of her eye she saw me pointing the gun at her," he said. "She thought I was joking and told me that I was freaking her out. I shot her in the back and then the head."

He then went to the study and shot his mother three times.

"In shock, I ran to my room and was screaming at the top of my lungs that I am really messed up and that I killed my mom and sister," he wrote.

"As I emptied the shells on my bed, I heard noizes (sic) and realized that Mallory was still alive," he said. "While I loaded the gun back up, I was shouting that I was sorry and then ran as fast as I could to kill her. I made sure my mom was dead and shot her again in the head."

He said he placed the gun on the counter and called 911.

Sheriff's deputies found the bodies of his mother and sister and arrested him.

In the last lines of his confession, he wrote: "I know now though that I'm done with killing. It's the most dreadful and terrifying thing I will ever experience. And what happened last night will haunt me forever."

Later, as his mother and sister watched the presidential debate that night, he said he "just sat in the living room thinking about how I was going to kill my family."

He wrote that he got a knife.

"I went back upstairs and kept pacing back and forth imagining killing Mallory," he said. "Thoughts of causing her pain kept entering my mind and were really bothering me. But then I'd think about the times she hurt my feelings."

He later knocked on her bedroom door and asked her to watch the comedy movie "Water Boy."

Then he changed his plans.

"After a while, I thought to myself that if I were to kill my mom and Mallory, I wouldn't want them to feel anything, so I decided to kill them both with the .22 revolver I stole from my Grandpa," he wrote.

He said he thought about it some more.

"I then spent probably over an hour walking nervously around the house thinking how life will never be the same and how I would never see them again," he wrote.

He said he knocked on sister's door again and told her their mother needed her.

"She came out and out of the corner of her eye she saw me pointing the gun at her," he said. "She thought I was joking and told me that I was freaking her out. I shot her in the back and then the head."

He then went to the study and shot his mother three times.

"In shock, I ran to my room and was screaming at the top of my lungs that I am really messed up and that I killed my mom and sister," he wrote.

"As I emptied the shells on my bed, I heard noizes (sic) and realized that Mallory was still alive," he said. "While I loaded the gun back up, I was shouting that I was sorry and then ran as fast as I could to kill her. I made sure my mom was dead and shot her again in the head."

He said he placed the gun on the counter and called 911.

Sheriff's deputies found the bodies of his mother and sister and arrested him.

In the last lines of his confession, he wrote: "I know now though that I'm done with killing. It's the most dreadful and terrifying thing I will ever experience. And what happened last night will haunt me forever."

Violence erupted outside Chaucer's Sushi and Grille early Friday morning.

Police arrived to investigate a shooting in the parking lot around 3 a.m. One person was shot in the leg outside the Arlington restaurant in the Lincoln Square shopping center.

The injured victim arrived at an area hospital in a private car. Authorities say the victim will survive his injuries.

It's not clear what led to the violence but police say "lots of folks" were leaving when they got there.

Officers talked to witnesses and are continuing there investigation and search for the shooter.

As of 8 a.m., police have not located the shooter.

A retired U.S. Air Force pilot from Mineral Wells is praising the military's decision to lift the ban on women in combat.

"What an exciting day for women in the military," retired Col. Kimberly Olson said. "I couldn't be more proud of our nation."

Olson helped pave the way for women in the military, flying more than 4,000 hours in places such as Iraq and Bosnia.

"Women have been involved in this arena for a long time," she said. "And combat knows no gender."

Women make up about 15 percent of active military members but until now, they've officially been barred from direct combat roles.

In practice, Olson said, women have already been there and done that.

"Women have been in combat, I would argue, for the last decade since we've been on two fronts -- in Iraq and Afghanistan," Olson said. "The area of operation is where combat occurs."

She said old stereotypes have changed.

"The men of this generation of military members have had women next to the men on the soccer fields, they've sat next to them in engineering classes, they have strong mothers as role models, they've been beaten up by their sisters, so women in nontraditional roles is not an anomaly anymore," she said.

Olson now runs a nonprofit group, Grace Under Fire, that helps female veterans.

She said women coming home from wars need the same support as men -- especially with more in future combat roles.

It was just a matter of time before the Pentagon reversed its ban on women in combat, she said, adding that the timing of Wednesday's announcement was still a surprise.

"That's what I'm most proud of," she said. "My generation of women who served made women going into combat a nonevent."

A bankruptcy judge has granted permission for American Airlines to buy new, fuel-efficient Boeing and Airbus planes.

Parent company AMR Corp. said Wednesday the move will allow American to sign contracts with aircraft and engine manufacturers to make its fleet the youngest among top U.S. airlines by 2017.

Fort Worth-based American plans to take delivery of nearly 60 planes this year and has 550 aircraft on order.

American in July 2011 announced that it would buy 460 new Boeing 737 and Airbus A320-series planes in the coming years with $13 billion in manufacturer financing and take options to buy additional jets.

AMR filed for bankruptcy reorganization in November 2011. The company is considering whether to join with US Airways Group Inc.

Dallas police are searching for two armed attempted carjackers who shot a man early Thursday morning.

Police say two men tried to steal the victim's car at gunpoint off Old Hickory Trail near Interstate 20.  The victim refused to give up his car, and the carjackers opened fire.

The man says he had been leaving his girlfriend's apartment at Providence on the Park Apartments, 8501 Old Hickory Trail, when the two armed carjackers confronted him and demanded his vehicle.

After he refused to give up his car, the man hopped in and tried to drive away.  Police say the carjackers then started shooting.

At least one bullet pierced the car and hit the man in the back.  The wounded victim plowed through the gate of the apartment complex trying to escape, but he only made it about two blocks.

Police discovered the victim nearby in the 2700 block of Wheatland Road.  He was still sitting in his vehicle, which was riddled with bullets.

Paramedics rushed the man to Methodist Hospital. He is recovering from the injury.

Police do not have any information whether the carjackers had been in a car or how they got away. Investigators are searching for the two men.

A Grapevine police search affidavit reveals drug paraphernalia was found in the home where two Carroll Senior High School students were found dead Saturday from what appears drug overdoses.

Two high school students who were found dead earlier this month died of mixed-drug toxicity, according to the Tarrant County Medical Examiner's Office.

Kyle McNutt, 17, and Chase Nunez, 18, were found dead in a Grapevine home Jan. 5. Both lived in Grapevine and attended Carroll Senior High School.

The Tarrant County medical examiner has ruled that the McNutt and Nunez both died of a toxic mix of heroin, codeine, alprazolam and diphenhydramine.

Police have said that the teenagers were hanging out with Cullen Marino, 22, the night of Jan. 4. His father called 911 the next morning and told the operator that he "might have two dead kids upstairs in my house."

Investigators said Marino moved them to a different room in his house instead of calling 911 after he discovered during the night that they were unresponsive.

Marino is charged with criminally negligent homicide.

Police discovered narcotics and drug paraphernalia in the home, according to a search affidavit.

The document says officers "observed, in plain view, a clear baggie with powdery residue on the table beside the bed..." The document goes on to describe, in an adjacent room, a spoon believed to contain heroin residue and what appeared to be the makings of a mobile meth lab.

According to the affidavit, pipes and bongs for smoking marijuana, a small bottle of Xanax, white powder, an orange pill, a baggie containing possible marijuana and scales were all removed from the home.

Irving Considering Options for Alcohol Ordinance Change

Thursday could be a monumental day, where the city of Irving's 30-year-old alcohol ordinance could be changed.

The Irving City Council will likely decide on Thursday whether or not to change the city's 30-year-old alcohol ordinance.

A number of proposals are under consideration.

Mayor Beth Van Duyne said she came up with a plan earlier this month after talking to community members for about five and a half hours.

"We came up with something I think brings something for everybody," she said. "It's a compromise."

Van Duyne said she preferred that the city's ordinance be left as it is. Businesses that need more relaxed ratio of alcohol sales can petition for it, she said.

The current ordinance allows restaurants to sell up to 40 percent alcohol and 60 percent food.

But staff members recommended a different plan -- a 70 percent alcohol ratio in Las Colinas to adopt 70 percent alcohol sales and an increase to 60 percent for the rest of the city.

But Van Duyne said she doesn't think that proposal is what citizens want.

"There are certain areas of the city that don't want it," she said. "They don't have as many regulations in those areas, they're not master-planned communities, and they don't want it."

The Greater Irving-Las Colinas Chamber of Commerce said it fears that if a decision to raise the alcohol level is not made Thursday, multiple developments, including the $125 million Water Street project could fall apart.

"They have letters of intent with several restaurants now that are pending on this bigger issue, so it's very important that the council act quickly, but it needs to be sensible in terms of pro-business," said Christ Wallace, chamber president and CEO.

The City Council's work session starts at 2 p.m. Thursday. The special meeting begins at 5 p.m.

Portions of I-35 E in Dallas were closed after a truck carrying Little Debbie snacks caught fire.

Police say two men in an 18-wheeler that showed a check engine light as it was traveling on I-35 E south of Hiline Dr.

Once the driver pulled the big rig over, he discovered the truck was on fire and disconnected the trailer before moving the tractor down the frontage road.

By the time firefighters arrived, the truck was fully engulfed in flames.

Emergency crews shut down the frontage road and most southbound lanes of the freeway while they fought the fire.

No one was injured and the 2700 cases of Little Debbie snacks in the trailer are safe and sound.

A church youth leader is charged with sexual assault of a child and online solicitation after an alleged sexual relationship with a teenager.

Police said James Ackley, a 25-year-old youth leader at University Park United Methodist Church, had a relationship with a teenager younger than 17.

According to the probable cause affidavit, the relationship began in August 2012 at a retreat he was chaperoning.

The victim told police that "... during the retreat they held hands and kissed, but was unable to do anything else because Defendant Ackley had a girlfriend who was also attending the retreat."

When they returned home, "they would exchange text messages describing sex acts that they would perform on each other," she told police.

The victim told police the two had sex in his truck in October at a parking lot outside St. Michael's Church.

In a letter to parishioners, UPUMC said it was working with police:

"We will also continue to take action to protect the children and youth of our church family by providing them a safe and secure environment," the church wrote. "Our hearts and prayers go out to all involved as we seek the Spirit's guidance, healing and care at every turn."

Ackley did some contract work at Bishop Lynch High School, helping with lighting events, and substituted on two half days. He was not a full-time school employee.

UPUMC said he underwent training in order to be a youth leader and a background check.

Jay Ratliff Arrested on Suspicion of DUI

A Dallas Cowboys player was arrested on suspicion of intoxicated driving in Grapevine on Monday night.

Defense lineman Jay Ratliff was arrested after he collided with an 18-wheeler in the 2800 block of East Highway 114.

A Grapevine police officer told NBC 5 that Ratliff did not even realize he had caused a wreck when officers questioned him at the crash scene.

"He had no idea how the crash occurred; and so I would just leave it at that," Senior Police Officer Sam Shemwell said.

Shemwell said Ratliff knew he had been involved in a crash but didn't know what had caused it.

Police said Ratliff refused sobriety tests at the scene and was arrested. Police obtained a search warrant, and he was taken to a hospital for a mandatory blood draw.

The results of the test are pending.

Ratliff was released on $500 bail on Tuesday morning.

The driver of the 18-wheeler was not injured, Grapevine police said. Ratliff, who was driving a Ford pickup truck, complained of minor injuries but refused medical treatment, police said.

The Dallas Cowboys declined to comment on Ratliff's arrest.

Ratliff is the second Cowboy to be arrested in a drunken-driving crash since December. Josh Brent, who replaced Ratliff on the field because of an injury, was arrested Dec. 8 on suspicion of intoxication manslaughter in a one-car crash that killed Cowboys practice-squad member Jerry Brown Jr.

The epicenter of the 3.0-magnitude quake was 5 miles north-northwest of Irving at a depth of 10 miles, according to the website of the U.S. Geological Survey's Earthquake Hazards Program.

Numerous residents in Euless, Farmers Branch and Irving reported feeling the shaking at about 10:16 p.m.

Video of a close call with a stunt airplane has received thousands of views since someone posted it on YouTube on Monday.

The video shows a stunt airplane owned by Lancaster-based Viper Airshows nearly slamming into a person with a camera on the runway of the Lancaster Municipal Airport.

Someone on an all-terrain vehicle can be seen riding around in the background.

Efforts to reach the pilot of the plane were unsuccessful as of Tuesday night.

Lancaster City Manager Opal Mauldin-Robertson said the pilot has an aerobatic waiver with the Federal Aviation Administration that allows him to perform practice routines for his stunt shows at the airport, provided he does so during the day in good weather, stays within specifically outlined boundaries and follows other safety measures.

"As long as he's in compliance with what's required of him in the FAA waiver, he doesn't need to come in and say, 'I'm going to do a practice run,'" she said after viewing the video.

Mauldin-Robertson said she confirmed Tuesday that the pilot's special waiver was still current. She questioned the role of the photographer and the person on the ATV, but said she would reserve any judgment or comment until a trained eye could see the video and speak directly with the pilot.

"We are reaching out to the FAA and making them aware that it has been brought to our attention, and we'll rely on their judgment and their decision making related to the activities," she said.

Mark Divita, the airport manager, said he spoke with the pilot Tuesday. He said the pilot posted the video on the Internet to drum up attention and promote his upcoming stunt shows.

It was not immediately clear who posted the video, which does not appear on Viper Airshows' YouTube channel.

Mr. Chairman, Ranking Member, members of the Committee, thank you for this opportunity.

The terrorist attacks in Benghazi on September 11, 2012 that claimed the lives of four brave Americans -- Chris Stevens, Sean Smith, Tyrone Woods, and Glen Doherty -- are part of a broader strategic challenge to the United States and our partners in North Africa. Today, I want to offer some context for this challenge and share what we've learned, how we are protecting our people, and where we can work together to honor our fallen colleagues and continue to champion America's interests and values.

Any clear-eyed examination of this matter must begin with this sobering fact: Since 1988, there have been 19 Accountability Review Boards investigating attacks on American diplomats and their facilities. Benghazi joins a long list of tragedies, for our Department and for other agencies: hostages taken in Tehran in 1979, our embassy and Marine barracks bombed in Beirut in 1983, Khobar Towers in Saudi Arabia in 1996, our embassies in East Africa in 1998, consulate staff murdered in Jeddah in 2004, the Khost attack in 2009, and too many others.

Of course, the list of attacks foiled, crises averted, and lives saved is even longer. We should never forget that our security professionals get it right 99 percent of the time, against difficult odds all over the world. That's why, like my predecessors, I trust them with my life.

Let's also remember that administrations of both parties, in partnership with Congress, have made concerted and good faith efforts to learn from the tragedies that have occurred, to implement recommendations from the Review Boards, to seek necessary resources, and to better protect our people from constantly evolving threats. That's what the men and women who serve our country deserve. And it's what we are doing again now, with your help. As Secretary, I have had no higher priority, and no greater responsibility.

As I have said many times since September 11, I take responsibility. Nobody is more committed to getting this right. I am determined to leave the State Department and our country safer, stronger, and more secure.

Taking responsibility meant moving quickly in those first uncertain hours and days to respond to the immediate crisis and further protect our people and posts in high-threat areas across the region and the world. It meant launching an independent investigation to determine exactly what happened in Benghazi and to recommend steps for improvement. And it meant intensifying our efforts to combat terrorism and support emerging democracies in North Africa and beyond.

Let me share some of the lessons we have learned, the steps we have taken, and the work we continue to do.

First, let's start on the night of September 11 itself and those difficult early days. I directed our response from the State Department and stayed in close contact with officials from across our government and the Libyan government. So I saw first-hand what Ambassador Thomas Pickering and former Chairman of the Joint Chiefs of Staff Admiral Mike Mullen called "timely" and "exceptional" coordination. No delays in decision-making. No denials of support from Washington or from the military. And I want to echo the Review Board's praise for the valor and courage of our people on the ground - especially the security professionals in Benghazi and Tripoli. The Board said our response saved American lives in real time - and it did.

The very next morning, I told the American people that "heavily armed militants assaulted our compound" and vowed to bring them to justice. And I stood with President Obama as he spoke of "an act of terror."

You may recall that in that same period, we also saw violent attacks on our embassies in Cairo, Sanaa, Tunis, and Khartoum, as well as large protests outside many other posts where thousands of our diplomats serve.

So I immediately ordered a review of our security posture around the world, with particular scrutiny for high-threat posts. We asked the Department of Defense to join Interagency Security Assessment Teams and to dispatch hundreds of additional Marine Security Guards. I named the first Deputy Assistant Secretary of State for High Threat Posts, so Missions in dangerous places get the attention they need. And we reached out to Congress to help address physical vulnerabilities, including risks from fire, and to hire additional Diplomatic Security personnel.

Second, even as we took these steps, I also appointed the Accountability Review Board led by Ambassador Pickering and Admiral Mullen so that we could more fully understand what went wrong and how to fix it.

I have accepted every one of their recommendations -- and I asked the Deputy Secretary for Management and Resources to lead a task force to ensure that all 29 of them are implemented quickly and completely… as well as to pursue additional steps above and beyond those in the Board's report.

Because of the effort we began in the days after the attacks, work is already well underway. And, as I pledged in my letter to you last month, implementation has now begun on all 29 recommendations. Our task force started by translating the recommendations into 64 specific action items. All of these action items were assigned to specific bureaus and offices, with clear timelines for completion. Fully 85 percent are on track to be completed by the end of March, with a number completed already.

We are taking a top-to-bottom look, and rethinking how we make decisions on where, when, and how our people operate in high threat areas, and how we respond to threats and crises.

As part of our effort to go above and beyond the Review Board's recommendations, we are initiating an annual High Threat Post Review chaired by the Secretary of State, and ongoing reviews by the Deputy Secretaries, to ensure pivotal questions about security reach the highest levels. And we will regularize protocols for sharing information with Congress.

All of these actions are designed to increase the safety of our diplomats and development experts and reduce the chances of another Benghazi happening again.

Now, in addition to the immediate action we took and the Review Board process, we have been moving forward on a third front: addressing the broader strategic challenge in North Africa and the wider region.

Because Benghazi didn't happen in a vacuum. The Arab revolutions have scrambled power dynamics and shattered security forces across the region. And instability in Mali has created an expanding safe haven for terrorists who look to extend their influence and plot further attacks of the kind we saw just last week in Algeria.

And let me offer my deepest condolences to the families of the Americans and all the people from many nations who were killed and injured in the recent hostage crisis. We remain in close touch with the Government of Algeria and stand ready to provide assistance if needed. We are seeking to gain a fuller understanding of what took place so that we can work together to prevent terrorist attacks like this in the future.

Concerns about terrorism and instability in North Africa are not new. Indeed they have been a top priority for our entire national security team. But after Benghazi, we accelerated a diplomatic campaign to increase pressure on al Qaeda in the Islamic Maghreb and other terrorist groups across the region.

In the first hours and days, I conferred with the President of Libya and the Foreign Ministers of Tunisia and Morocco. Two weeks later, I met with regional leaders at the United Nations General Assembly and held a special meeting focused on Mali and the Sahel. In October, I flew to Algeria to discuss the fight against AQIM. In November, I sent Deputy Secretary Bill Burns to follow up in Algiers. And then in December, he co-chaired the Global Counterterrorism Forum in Abu Dhabi and a meeting in Tunis of leaders working to build new democracies and reform security services.

In all these diplomatic engagements, and in near-constant contacts at every level, we have focused on targeting al Qaeda's syndicate of terror - closing safe havens, cutting off finances, countering extremist ideology, and slowing the flow of new recruits. We continue to hunt the terrorists responsible for the attacks in Benghazi and are determined to bring them to justice. And we're also using all our diplomatic and economic tools to support the emerging democracies of the region, including Libya, to strengthen security forces and provide a path away from extremism.

The United States must continue to lead… in the Middle East and all around the globe. We have come a long way in the past four years. We cannot afford to retreat now. When America is absent, especially from unstable environments, there are consequences. Extremism takes root, our interests suffer, and our security at home is threatened.

That's why Chris Stevens went to Benghazi in the first place. Nobody knew the dangers better than Chris, first during the revolution and then during the transition. A weak Libyan government, marauding militias, even terrorist groups… a bomb exploded in the parking lot of his hotel, but he didn't waver. Because he understood that it was critical for America to be represented in that pivotal place at that pivotal time.

Our men and women who serve overseas understand that we accept a level of risk to protect this country we love. They represent the best traditions of a bold and generous nation. And they cannot work in bunkers and do their jobs.

It is our responsibility to make sure they have the resources they need to do their jobs and to do everything we can to reduce the risks they face.

For me, this is not just a matter of policy… it's personal.

I stood next to President Obama as the Marines carried those flag-draped caskets off the plane at Andrews. I put my arms around the mothers and fathers, sisters and brothers, sons and daughters.

It has been one of the greatest honors of my life to lead the men and women of the State Department and USAID. Nearly 70,000 serving here in Washington and at more than 275 posts around the world. They get up and go to work every day - often in difficult and dangerous circumstances thousands of miles from home - because they believe the United States is the most extraordinary force for peace and progress the earth has ever known.

And when we suffer tragedies overseas, the number of Americans applying to the Foreign Service actually increases. That tells us everything we need to know about what kind of patriots I'm talking about. They ask what they can do for their country. And America is stronger for it.

Today, after four years in this job, after traveling nearly 1 million miles and visiting 112 countries around the world, my faith in our country and our future is stronger than ever. Every time that blue and white airplane carrying the words "United States of America" touches down in some far-off capital, I feel again the honor it is to represent the world's indispensible nation. And I am confident that, with your help, we will continue to keep the United States safe, strong, and exceptional.

So I want to thank this committee for your partnership and your support of our diplomats and development experts around the world. You know the importance of the work they do day-in and day-out, and that America's values and vital national security interests are at stake. It is absolutely critical that we work together to ensure they have the resources and support they need to face increasingly complex threats.

I know that you share our sense of responsibility and urgency. And while we all may not agree on everything, let's stay focused on what really matters: protecting our people and the country we all love.
